:D Seriously, a lot of separated couples just go on with their lives. Just look around you and you'll see what I mean.

As for me, I can't do it kaya kahit wala naman akong boyfriend or anything, I still decided to push through with the annulment.

^Agree. I'm a devout Catholic pero I don't believe that God wants you to be abused and to suffer for the rest of your life. No one deserves to be in an abusive relationship, mapa-babae man or lalaki.

Ya, Kung walang pera, separated couples will just go on with their separate lives.

But what is not fair is the guy can have kids bearing his surname, while the girl, magka problem pa sya sa magiging surname ng magiging anak nya sa new partner since technically, she is married and therefore, any child she gives birth to is the legitimate child of her first marriage. If ever naman itago nya na married sya, illegitimate naman itong magiging anak nya sa new partner (kasi wala syang maipakitang marriage cert with the new partner).

Kaya minsan, yung mga singles na di pa kasal, lagi kong sinasabihan to always marry right. Never settle. Kasi in the end, kung sakaling sa pinas ka pa kinasal, kahit hiwalay na kayo, minsan it still haunts you because of all the documentation and annulment process.

That's why para sakin, if possible, never ever get married in the Philippines! kaya lagi Kong first question sa mga nag process na ng annulment then wanting to get married sa pinas again - di pa ba kayo natuto? :))

But then again, perhaps this time around, we are much more wiser na in choosing our partners than before. :D

Hi mga sis! I hope someone can help me.

My ex was the one who filed for the annulment kasi overseas na ko. Last August, natanggap ko yung letter for the decision granting the annulment. That was the last letter na natanggap ko.

Does anyone know kung may matatanggap din akong letter for the Certificate of Finality, at yung Decree of Annulment?

^Request ka ng NSO copy of your marriage certificate. Makikita mo dun kung may annotation sa gilid or wala.

You don't need the final decree of nullity kung may copy ka na ng annotated marriage certificate mo.

Update sa akin: I finally got my annotated NSO copy of marriage certificate. Natapos namin yung sa OSG by Sept 30. Yung paglakad sa civil registry at NSO took about 3 months to finish. This week ko lang finally nakuha yung annotated marriage certificate so this week ko lang napalitan papers ko sa office. I'm scheduled na din to renew and update my passport end of the month.

Finally, it's all done.

Thanks for the tip sis. I'll order the COM from NSO.

As for the other docs - unfortunately, I do need them.

^If you need the final decree, check the decision you received and see kung saang court finile yung annulment. Punta ka dun sa court and ask the court clerk to give you a copy of the final decree.

Please help, im so desperate now.

^I already gave you the email address of my lawyer.

Just to manage your expectations (and expectations of those who are looking for lawyers). I don't know yung definition ninyo ng lawyer pero annulment is an expensive process, ah. And just because a lawyer is affordable, it doesn't automatically mean na one will get the annulment. Hindi ganun yun.

Petitioners should work closely with the lawyer. Like I said in my earlier posts, petitioners have to do their fair share of the work.

Yun, so just be prepared to work just as hard as your lawyer.

In my case, ang dami kong papers na pinrepare like autobiographical accounts, contacting my witnesses, arranging their schedules for interviews with the psychologists and appearing sa hearings, etc.

My lawyer and I just had our last meeting last night. He turned over all the documents na and that ends our engagement. So lahat ng papers ko pertaining to the annulment are now with me.

Overall, I spent 450K total for everything (from the time he accepted my case until the filing of documents sa NSO). The entire annulment process (from the time we first met) was close to three years. The court process (from the time we filed until naregister lahat sa NSO) took exactly two years. Madaming pinagdaanan but it was all worth it.

My civil wedding is presumed void based on bigamous marriage naman. So I think medyo hindi ganung kadugo o kahirap patunayan sa court compared po sa pscy incapacity ang ground naman.

Paki advise po. Tnx

Hello mga sis. Question. Pag walang respondent all throughout the case, diba mas mapapadali ang kaso.  What if di nag appear ang respondent ever. Nag present na ang prosecution ng witnesses and all. tapos na lahat ng hearing sa side ni prosecution, after nun, submission for decision na ba? Since di naman nagpakita ang respondent? o mag set pa rin ng another hearing for the respondent?

So after ng lahat ng hearings ng prosecution, another set of hearings na naman for the respondent? Sa pagkakaintindi ko kasi, dapat hindi na, since hindi na present yung respondent at walang na present na witnesses during the pre trial.

@vienells, to be honest, the church annulment has no bearing. You should start with your civil annulment. Just because you're annulled in church does not mean you can get married again. You will still not be able to change all your government IDs just because you're annulled sa church.

Unahin mo ang civil kasi that will allow you to get married again even if it's just under civil rites.

Ask your lawyer as he will be in the best position to answer that. You can't just choose from a menu, hoping that your marriage will be annulled. You HAVE TO PROVE whatever grounds you're raising. Kung may documents ka to prove na bigamous yung marriage mo, then by all means pursue the civil annulment.

If yes, the judge will schedule one last hearing for the respondent's final appeal (just in case gusto pa nya magpakita). After that, your lawyer needs to submit the final pleas and memorandum for the final decision.

Not mine hehe my friend's. Thank you sis! Kasi she's asking, akala nya after nung last hearing nya for decision na. So after the submission of all the pleas and memorandum, dito na ba mag start yung 90 days para lumabas yung decision?

Thank sis sa advise. Yes, I have 2 MC from NSO that could prove that my marriage was bigamous as I was the 2nd wife legally. He abandoned me and my 3 kids 2 yrs ago pa. I could not go for nullity of marriage in civil because of limited financial resources pa dahil nga mahal din ang pag file ng nullity of marriage. So I cannot move forward with civil case muna.

Then recently I read somewhere na free na sa ang nullity of marriage sa church. Though I am not sure about which grounds can I use. Since free siya, at may docs na ako including baptismal certs, I felt I could move forward with this church option instead of the the civil one.

I respect sacramental laws as well, and I want to re-marry in church in the future once na ayos na ang both civil and church nullity ko.  Atleast unahin ko muna ang nullity of marriage in church.

Anyone who had succesful nullity of marriage in church ?

^Sis, unahin mo pa din ang civil. Like I said, walang effect sa civil court kahit pa magpa-annul ka sa church. Hindi ka pa din makakapagpapalit ng IDs mo, you will still carry your married name, etc. Unahin mo yung civil annulment kasi yan yung "legal" na annulment. When I saw "legal," that means you can change your civil status, your IDs, yung mga government documents and papers mo, etc.

Yung bigamous marriage is covered by the grounds for civil annulment. Nagmamahal lang naman ang civil annulment kasi psychological incapacity yung grounds (which is harder to prove).

If you backread sa mga old threads on annulment, either nauuna ang civil annulment or sabay ang civil at church. Like I said, walang bearing sa civil laws kahit pa annulled ka na sa church. In the eyes of the law, you are still married.
