The Pasig Regional Trial Court Branch 159 dismissed actress Katrina Halili’s case against model-singer Hayden Kho, Jr. last Tuesday due to “insufficiency of evidence,” PEP.ph reports. Hayden was charged with violating the Anti-Violence Against Women and Children Act of 2004 on two accounts, “(a) the act of taking a video of the sexual encounter without the knowledge and consent of private complainant (Halili), causing her psychological and emotional distress; and (b) the act of uploading the sex video on the Internet, causing (Halili) mental and/or emotional anguish and humiliation."“On the charge of uploading the video in the internet,” Hayden’s legal counsel told PEP.ph in a statement, “the prosecution failed to present ANY evidence on the charge of illegally uploading the videos. In fact, the prosecution readily admitted and acknowledged that there was no evidence that the accused uploaded the said videos.”
Ocular inspection of the video camera placement also revealed that it was placed, “in an open and unconcealed place which cannot escape unnoticed,” the statement said. Thus, they concluded that, "the camera was never hidden from private complainant, and that it was in plain view."
Katrina expressed her dismay over the decision, PEP.ph reports, but her counsel vowed to file an appeal in court. Senator Bong Revilla was also saddened by the result, claiming others might follow Hayden’s example.
Meanwhile, Dr. Vicki Belo, Hayden’s former flame, expressed her happiness about the decision. “It's been wonderful,” she told PEP.ph. “Sobrang napakalaking blessing, di ba, na nangyari before Christmas. It's the best Christmas gift I could ever hope for. I'm sure Hayden knows.”
