Going to the US: I-130 Petition (Spouse/Immediate Relative) Part 4

^ sis i guess kahit saan state pa nag file pare-pareho lang yung time line nung processing ng petition,unless bumilis yung pag process nila,

mga sis huwag na ma sad, like i said depende yan kung ano category nung petition niyo. Ito mga natatandaan kong category for spouse petition

IR1 and CR1 ( Immigrant Visa for Spouse Petition) Ito yung sa akin, halos 2 years yung waiting but once i got here automatic na LPR na ako (Green Card Holder and may SSN na agad)

K3 (Non-Immigrant Visa for Spouse Petition) ito ang alam ko sandali lang yung processing halos 1 year lang ata, pero pag dating dito since Non-Immigrant kailangan i adjust ang status (sa pagkaka alam ko)

wait natin ang ibang sissies natin na may mas alam , baka may aditional advices sila or pwede niyo i search and basahin yung mga different petition for spouses mga sis,para may idea kayo sa pagkaka iba nila

f2b si bf....filed his petition year 2005...he got his approval letter like 2 or 3 years ago...akala nga namin yun na yun...matagal pa pala aantayin based on VB...question...at sana lang mag dilang anghel...let's mapabilis...at 2005 pa ang pinoprocess at aalis na sya...pede na ba nya ako i fiance visa agad? or ilang months ba dapat sya mag stay sa US before he can file for my fiance visa? and kung aalis na sya sasabay na rin ako sa kanya if ever...i have naman tourist visa...can he file the fiance visa sa US?  ayoko maiwan dito

you can't petition a fiance unless you're a US Citizen and ang inaantay n visa ng bf mo ay pang immigrant.

question: anong status ng nagpetition s bf mo? if resident alien, he can't get married hanggat hindi siya nakakatapak s US soil. if citizen naman, you guys can get married and once his petition is finalized sabay na kayong makakaalis including any minor child(ren)

now if by the time n maayos lahat ng papers ng bf mo, and valid pa ang tourist visa mo, u can follow him... FOLLOW ha, hindi sabay n aalis. either mauna ka or mauna siya.. basta wag sabay. kasi pagdududahan kayo ng immigration.

K3 (Non-Immigrant Visa for Spouse Petition) ito ang alam ko sandali lang yung processing halos 1 year lang ata, pero pag dating dito since Non-Immigrant kailangan i adjust ang status (sa pagkaka alam ko)

K3 is fiance visa... eto ang ginagawa kapag sa US kayo magpapakasal. this is like 6-8mos lahat lahat na. pero may mga narrinig ako n inaabot n rin daw ng 1yr ito minsan. upon arriving s port of entry mo, you and your fiancee needs to get married within 90days, after that adjust n ng status mo. ngayon eto ang madugo, kasi nga medyo mabagal ang processing ng immigration ngayon, ang problema dito hanggat hindi naaadjust yung status mo, hindi ka pwedeng magwork kasi wala kang SS no.

sis prettypurple08 , dagdag ko lang na if you do decide to get married bago pa siya umalis, his category will change to F3. that;s a longer wait but sabay naman kayo aalis. dec2001 palang ang pinaprocess ng march vb and with the current pace mukhang itll take more tme before his case becomes current.

im so happy, more details as soon as mapick up ko yung mail, nag-sign up kasi ako s e-mail notifications ng uscis.

a few days ago lang pinag uusapan natin na baka matagalan pa, pero eto na yung sa inyo.

since pinadala ko yung application a little over 6mos. hindi ko p kasi narreceive yung mismong approval letter kaya wala p akong idea on what to do next, pero kadalasan affividafit for support and visa processing na, then yung pinepetition n ang mag-aayos like medical and interview. malamang ilang months din tatagal ulit yun.

na-gets k n din pala yung time estimate dun s website ng USCIS, you will start counting upon approval of your petition, not based on your NOA1 (receipt of application). so from feb24 (approval date) tatagal ng maximum of 5mos pa ang processing according dun s nakalagay sa website.

Help po.Am new here and the reason I created an account here is because of this thread. I really need some good advice from people who have been through the petition process. I am married to a USC for less than a year. We just filed the petition a month ago in the US via a lawyer. He told us it's gonna be 6-8months waiting time (?). All we got for now is just the receipt of our application from USCIS.

What are the things that we should prepare for while we are waiting for the approval? I learned from one of the replies na joint account and properties are good, pictures and correspondence... Are there any other things na needed? Will unemployment po ba matter kahit na may sponsor kami? please help.

I have been having bad dreams about this coz I've been rejected in one of my visa application in another country. Na-phobia ata ako. Thank you in advance for those who are going to reply.

Mga sis, I have a question. Yung best friend kasi ni hubby married a filipina also. Now, tourist visa in a-apply niya kasi daw mas mabilis and tutal 1 month Lang daw niya plan to stay with her hubby sa US. May question is, meron ba kayong alam na same situation na na-grant ng tourist visa given her background/qualifications?

^^sis i just received an email from USCIS, saying that my husband's petition was approved. i'm still waiting for the letter to arrived. like i said sa previous post ko, waiting period namin for the approval was 6mos.

i still dont know if may additional documents na kailangan pang i-submit since wala p nga yung letter, i didnt include any other docs dun s I-130 kundi yung marriage cert namin, birth certs and 1 valid ID for both of us, passport and naturalization cert k, and yung copy ng joint time deposit namin (na biglaan lang din ang pag-open para lang may maipakita sa immigration)

i suggest ask your husband to look for a job, any job... basta may work lang. kasi iba pa rin naman yung dating ng unemployed tapos magdadala ng dependent diba. kahit p nga in papers may magssign ng affidavit of support niyo.

^sis may nabibigyan p rin talaga visa kahit nasa US ang asawa or kahit nga under petition niya yung applicant. i guess depende n yun s consul n matatapat sayo.

@ sis ldrwifey:  mom nya nag petition sa kanya...not sure but alam ko hinde pa citizen mom nya kasi ang sabe sa min if she changed her status sa US...mag iiba nanaman status ni bf? not really sure but him mom can apply for citizenship anytime...matagal tagal na rin kasi sya andun...since 2002.

@ sis septembernine:  thanks for the reply...that's the sad part...we can't get married...because of his petition...ayaw namin ma change status nya...kasi matagal tagal na rin ang inantay namin...sayang naman...and we're more than 10 years nang mag bf and gf...

they are traveling with me (mother) naman, right?

^Theres a separate thread for Travel clearance.  As far as I know it's not needed as long as the minors travel with the mother.  Me and my daughter went to HK when she was 5 .. I don't recall getting a travel clearance then.  I did get her one for traveling alone to the US.


@prettypurpke- ive been doing some  reading on the immigration process since we are getting ready for an adjustment of status (my husbands a USC) . From what I know it takes a longer time for a permanent resident to petition an immediate relative.  Your bf once he's here in the US will be an LPR, I think it could take more time for an i130 in that case 1-3 years?

sis mag-iiba talaga ang status kasi from overage child(ren) of a permanent resident magiging overage child(ren) of an USC. based sa visa bulletin, naguunahan lang naman yang 2, minsan ahead ang permanent resident, minsan naman yung USC. pero mas maraming perks ang USC, kasi pag citizen ka, pwede mo ipetition ang anak mo kahit may asawa na, a permanent resident can't do that. yung mom ba ng bf mo is nagcconsult sa lawyer? kasi common misconception talaga yung kapag nag-iba ng status yung petitioner baka mas lalong matagalan yung petition. kadalasan free naman ang 1st consultation s mga immigration lawyers
