^Sis again PREJUCIDE. Hindi nagkaron ng hearing para bigyan ng chance ang ABS-CBN to explain themselves. Even before pa magkaron ng hearing decided na sila to say NO. LEGAL ang basehan sis. We still live in a DEMOCRACY as far as I know. If moral compass ang basehan sa gobyerno baka walang matira sa government officials and institutions natin. Kung moral ang basehan even sa private companies walang matitira.
Again, hindi po sya court of law, Sister where they need to prove that what they did is legal or not. Eto ay hearing so that they are given the opportunity to plead and ask the Filipino people through the Congress for a favour to give them the franchise. Nanliligaw po sila, Sister. I heard that clarified many times by Congressmen and some lawyers. Yung kaso nila about the violations will be heard in the Blue Ribbon committee. So ibang time and place yon. So kesyo maraming hindi moral sa government, di na tayo pwedeng mag-demand for that? Mali naman ata yon. Ang bottomline lang naman dito, Sister is: WHAT IS IT FOR US, THE FILIPINO PEOPLE to grant them that franchise so they can make money off it? Ano ang mapapala natin? After the hearing, ang daming lumabas na questionable business practice? For instance, tax avoidance. Sure, it is legal but is it moral? Okay lang ba sa atin na hindi sila magbabayad ng tamang tax? At some point pa nga, may utang pa ang gobyerno sa kanila? Okay lang yun sa yo?
Even the state run channel PTV4 has contractual employees, they even had a case with COA in the past years because of unsupported documents to prove that they paid the proper salary and benefits of their contractual employees. Until now, may employees sila na Di pa nila nababayaran. Nasan ang moral dun. Isn't it the same with ABS-CBN?
So yun ba dapat ang golden standard? Kung merong ibang companies na gumagawa ng ganyan, eh di dapat questionin at panagutin kung sino ang may kagagawan yan. Pero hindi dapat yun ang standard. So if we give them the franchise, okay lang sa yo ang ganyang business practice?
It seems magkaiba din tayo ng nakita sa mga hearings. BIR, DOLE, SEC, NTC....even DOJ na ang nagclear sa ABS-CBN. Walang violations. These are according to institutions/government agencies themselves. In paper lahat, documented. STILL IN DENIAL ang congress because again they already made up their minds. Even to the point na halos binabastos na nila yung mga resource persons ng ABS-CBN.
Feeling ko nga magkaiba ang napanood natin...LOL! Just because they were cleared by BIR doesn't mean it is moral. Ang dapat gawin eh tawagin sa Blue Ribbon committee si Henares ang tanungin. Pati so Cordova ng NTC. Ang dami nilang kapalpakan!
Sige kasalanan na ng ABS-CBN kung bakit hindi nila inagahan ang pag-apply, kahit na 4 times pa silang nag submit ng application na laging dinedelay ng congress. Isn't it enough that the president said so himself that he will make sure that the Lopez's are out at hindi mare-renew yan. In what world isn't it clear that someone orchestrated all this...for what...we don't know yet. But for sure we will see it soon kung sino ang bibigyan ng frequency. Tapos now pati legality ng ownership is being questioned. In what world isn't it clear that the Lopez owns ABS-CBN then Marcos seized it so di ba MORALLY right lang din na ibalik sa tamang may-ari ang company after martial law? Nasan ang moral dito?
CORRECTION, Sister. Hindi Congress ang nagdi-delay. Ang ABS-CBN ang hindi nagbibigay ang papeles na hinihingi. Ilang bases na rin yang na-clarified ng ibang lawyers. AGAIN, tinanong sila kung bakit hindi sila nag-cooperate. Ang sagot: they though they had enough time.
Hindi pa nga dumadating sa office ng President, Sister! Sure, sinabi nya yan but did ABS-CBN gave enough proof na hindi questionable ang kanilang business practice and DESERVE to be given that PRIVILEGE? Parang hindi eh! Did you know that the government bailed out the Lopezes many times sa mga pagkakautang nila prior to Martial Law? Technically, pag-aari nga ng taungbayan ang business nila. Ang tinatanong sa kanila is how they manage to get back their properties after EDSA 1. The law requires proper documentation of it. Hindi pa nga natapos yung pagtatanong about their land titles. Wala silang maipakita....LOL! Ang address iba tapos sing laki lang ng condo unit ang size....hahaha! Di rin na-cover ang utang nila sa DBP na bilyon of pesos na nakakagulat na mas malaki pa sa budget ng government at some period of time. Nakakaloka!!!
Moral and legal lang if it's convenient to what they want to push?
ABS-CBN is not a perfect company. Walang ganun kahit saang parte ng mundo. But they admitted their mistakes and are correcting it. Why not give them again a chance for the sake of the employees.
The thing is hindi man lang sinaalang alang ng congress ang mawawalan ng trabaho. Not just the employees of ABS-CBN but also other people who benefits from the business that they get from ABS-CBN. Kahit naman yan 2-5 years franchise lang until matapos ang pandemic then after mag hearing sila uli and check if may ginawa ang company na mareform yung mga ayaw nila.
In this time na halos lahat ng company nagiscale down saan hahanap ng trabaho ang mga employees na matatanggal? Sabi ko nga in one of my posts here, kung bibigyan ng regular work yung matatanggal with same benefits and salary then sige na ipasara nila.
Hindi perfection ang hinahanap, proper business practice lang at a minimum. So sinabi mo na rin na inamin nila na meron pagkakamali, akala ko ba wala? MERON, ang dami and for 25 years hindi nila naitama? Up to now, hindi pa rin nila naitatama. Ang problems Sister, ang batas ang nagsasabi na either bigyan or hindi, hindi pwede ang provisional franchise. Again, they are trying to persuade the Filipino people that they are worthy of that privilege. Refer to my analogy pertaining to panliligaw in my previous post.
Bottomline is, this is probably their best case scenario. Kasi kung nabigyan sila ng franchise, mabubusi pa lalo yung ibang hindi pa na-discuss tapos meron pang quo warranto which I heard eh medyo mas nakakagimbal pa. Eh baka masampahan ng kaso kung merong magsasampa for the violations. In other words, they are surrounded by a cesspool of sewer left, right, top, bottom, east, west, north and south that they themselves created. Susunod na hearing ay Meralco! Ay, kasama na naman sila.
Ang employees nila ang palagi nilang sinasangkalan in this situation. Pero, sa hearing kitang kita that they mistreated a lot them. Nakabinbin pa nga ang around 67 labour cases sa DOLE. Napanood mo ba ang sinabi ni Weng Hidalgo? They are the collateral damage. Hindi kelangan na magkaron sila ng franchise para itama yan. Pwede nilang bigyan ng generous separation package ang mga yan so that they can survive for at least a couple of years. Pero wala akong naririnig. Ang mga artista, meron ba silang ginawa na kahit fund raising for these employees? Nagpa-slash yung iba ng talent fee pero sa management yung mapupunta. Grabe naman, for top executives na between 6-10 people ay almost half a BILLION peso ang yearly salary pwera pa ang ibang benefits. Pero out of the 11,000 that they are claiming, 4K lang ang regular.
Hay naku, bahala na lang kayo manood ulit at mag-research kung bakit hindi sila nabigyan ng PRIVILEGE. Hirap na ako mag-explain.....LOL! Showbiz chika lang naman pinunta ko dito.
ETA: Ang drama nila from the beginning. Kapag hindi sila nabigyan, it is a curtailment of freedom of the press. Hindi lang naman sila ang broadcast network at parang hindi naman sila pinapapatigil mag-broadcast. Hindi siniquester ang kanilang property. They are still operating and still existing as a business. Di na nga lang pwedeng gamitin ang frequency. So Youtuber na lang sila for now...LOL! And if I may add, yung violation nila sa pay-per-view nila during Pacquiao at Mayweather. Ang sagot nila kung bakit pa nila itinuloy kahit pinagsabihan na sila ng NTC that they can not, kesyo nagbayad na raw yung mga subscribers at responsibility nila sa taong bayan na ibigay sa kanila ng pinangako nila. Hahaha, comedy minsan yung hearing. Hindi pedeng i-refund?
