Expanded Maternity Law (EML)

Hello Mommies and Daddies. I am currently in my 29th week of pregnancy and our due is on 29th April 2019. I have read that the Expanded Maternity Leave (EML) will lapse into law by February 14, 2019.  "A bill may become a law, even without the President's signature, if the President does not sign a bill within 30 days from receipt in his office," i quoted from an article. Meaning, it is indeed a Happy Valentine's Day for us who are expecting!  I am not an attorney or someone that knows the nitty-gritty about a bill becoming a law.  Hehe

We are a group of mommies who will give birth on the second quarter of 2019 and we are hopefuls for this law. Aabot pa kaya kami dito? I saw the draft and the DOLE and other assigned agencies will have 6 months to draft the IRR. And it will be effective 15 days after posting in the Official Gazette. Ano ang napo-post sa Official Gazette, ang law o ang IRR? either way, kahit approved na sya ng Feb. 14, kung walang IRR hindi pa rin ba kami aabot or maghihintay pa ng 6 months na matapos ang drafting ng IRR? or pwede retroactive?

Questions:

1. How is the "full pay" computed? Is this your full salary when you are working?
2. Is the counting of Maternity Leave include weekends and holidays?

guys, do you know already the computation on this one? and if na update na sa office nyo ang leave from 60 to 105?

1. Full pay of your basic pay since the salary difference from the sss benefit will be shouldered by your company. In our case, they give the sss benefit during the ml and the difference when we return to work (not yet tried since this is my first pregnancy)

2. Calendar days (including holidays and weekends)

May IRR na ang SSS so applicable na sya but the details are not yet clear especially regarding the "pasa-leave". Ongoing transition pa kasi but once you file for ml now, applicable na ang 105 days.

sa company namin, for this year daw per our Benefits team, based pa din sa average daily rate which is around 533 pesos a day, so times sa 105 days, mga nasa 55K plus...but next year sa 2020, applicable na yung 70K na makukuha ng preggy sa SSS...

ang kinagandahan ng company namin, may sahod pa din kahit naka ML so malaking kaginhawaan...

^aaazcha1988, napakalaking tulong sis. Kasi kung si SSS maternity benefit pambayad na sa ospital,  at least continuous ang sahod pang gastos during ML

kaya nga sis, ang galing nman ng company nyo. kaya ako, naiisip ko ang hirap ng walang sahud ng 105 days kasi ang  matatanggap sa sss na abunohan ng company is pangbayad pa hospital. xempre andyan c hubby for other expenses pero mahirap pag isa lang ang may work for few months.

Same with our company, sis FayeP, we still get paid din kahit naka Maternity Leave. Yan ang dream job ko, maging paid housewife hahaha

Nagpa compute nako sa HR namin and since April lang nag start yung new deductions, ang masasama lang na new rate will be April to June. My EDD is December kase. Sa computation nila, around 63k makukuha. Okay na din.

Sorry, hindi ko na-gets.  So apart from what you can get from SSS (salary credit X 105 days), you still get your full salary from the company?  Ganun ba ang computation?

^Company benefit yung paid ML so it depends on your company if it's offered. In our company kase, ever since talaga, kahit naka ML yung employee, continuous pay pa din.

^yes sis twelvth_goddess, not bad un 63K. Bukod naman sa sahod...so glad nga na itong company na to eh may paid ML...ika-3rd baby ko na dito sa company na to..binibiro na nga ako ng mga officemates ko na tinotodo ko daw un Mat Benefits....

sis PrettyEomma303, yes bukod sa SSS maternity pay, meron pa din kami sahod sa company, unlike sa karamihan ng mga companies dito sa Philippines, na walang sahod pag mat leave...

True sis, pambili ko na yan ng gamit ni baby boy hehe. In our company though, 112 days ang paid maternity leave whereas 105 lang sa sss. Sagarin ko na talaga sayang yung time with the baby.

FayeP napakagenerous naman ng company nyo. Samin kasi kung ano lang sabi sa law. Syempre meron talagang maternity benefits si sss na bawas sa hospital pero mababa lang. Si company rin naman may bawas sa bill, 30k (or 25k) for nsd and 35k for cs. Kaya kung nsd walang babayaran masyado. Hay kaso mukhang macs ako since I have to be induced on Monday kahit mataas si baby at 0cm pa.

Regarding the salary, within one month of ml, kelangan na palang ibigay yung buong basic salary for the whole ml (sakin 98 days since I gave 7 to my hubby) minus the usual deductions (sss, philhealth, pag ibig and tax) unlike before na pagbalik mo pa lang galing ml tsaka ibibigay salary differential. Pandagdag pambayad sa bill kaso pagnaubos agad lagot for the 3mos. Haha

Sis Panchama, oo nga sis ang hirap since bibigay na ng buo a month before mag ML ang buong sahod mo...delikado maubos..

Sa new Mat Benefit ng SSS, mas magbebenefit dito yung mga next year manganganak kasi sa kanila applicable un bagong rate na 70k..plus if may additional benefits sa company, like tulad samin sahod during the entire maternity leave, may ibang companies sagot naman ng HMO nila yun panganak kaya wala na din babayaran...depende talaga sa company kung anong benefit nila para sa women workers nila...

I got clarification na from our HR regarding EML. So sa company namin, we still get paid the full salary for the 3.5 months na naka ML. Si company na ang bahala mag reimburse sa SSS. So basically, our company will pay for the difference ng 3.5 mos na salary and SSS benefit. Ok na rin at least I can get my full salary while on ML, and our HMO paid for my hospital bills kaya malaking tipid din. 😁👍
