^No. The surviving spouse is a compulsory heir. Meaning he / she cannot be omitted from the mana or whatever shall be left from the estate of the deceased. Any agreement resulting to a spouse's deprivation of his / her inheritance is invalid and cannot be enforced.

Prenup agreements can cover any financial aspect in a future marriage, however should there be stipulations in the prenup that violate the law, such stipulations will be rendered invalid. Those illegal clauses will just be stricken out and the court will enforce the remainder of the agreement - or just the valid provisions.

Question poh mga ma'am.

Ako po [textspeak!] complainant sa isang qualified theft/robbery case na mag-iisang taon na po. Ito poh sana mga question ko:

-ang isang complainant po ba ay maaring humarap ng contempt of court kung hindi cia pupunta s hearing? abala po kc ako dahil sa pagpapagamot po ng pamangkin ko n may cancer.

-ano po ba ibig sabihin kapag may FAIL NOT UNDER PENALTY OF LAW [textspeak!] subpoena? makukulong po b ako at magmumulta?

-totoo po b [textspeak!] sabi sakin na madidismiss lang po [textspeak!] kaso kung Hindi po ako pupunta sa mga hearing?

It really depends on the judge. After he/she issued to the plaintiff/complainant the show cause order and he/she was not satisfied of the explanation or the latter failed to offer one, the judge may cite the complainant in contempt and will issue a bench warrant of arrest. This is the practice of my judge in our court.

In your case, I think valid naman ang reason mo why you failed to appear during hearing. Just apologize and ensure that you will appear next hearing.

Hi question lang po may expiry date po ba ang notary ng deed of sale? kasi un mother title ng lupa namin un isang nakapangalan namatay last week sa mother title. Pero before that nakagawa na ako ng deed of sale at naipa notary na as of now wala pa kasi kaming pang titulo so gusto ko po malaman kung may expiry po ba un deed of absolute sale na nanotary or wala po. Hindi pa po kasi namin alam kailan pa kami magkakapera pang titulo. Sana po may makasagot.

Another question po. About sa legality ng bata. 9 years old inabanduna na ng ama at walang ibinibigay na sustento kahit singko. Hindi kasal ang magulang pero nakapirma sa birth certificate ang ng bata ang ama, at dala ng bata ang apelyido ng ama nya. The problem is ayaw ng anak ko gamitin ang apelyido ng tatay nya. Is there any possible way para mailagay ko sa apelyido ko ang bata? since hindi naman nagsusustento ang ama kahit piso?

^sis alam ko walang expiration ang  notary of deed of sale.. :) better punta kayo sa munisipyo para ma clear yan kasi baka bigla may maghabol na kamag -anak ng namatay :)

second question mo: Di basta basta pwede di gagamitin ang surname ng biological father lalo na kung ni acknowledge naman pala. since gugulo lang ang record ng bata.. mahirap yan lalo na kung  malaki na siya at need na ng mga legal docu from Gov. better na stay what it is.. or idaan nyo  sa legal pakunsulta kayo sa lawyer para mapa change ang surname ng  bata.. pero wala siya magiging middle initial if ang gagamitin niya yun surname ng nanay niya..  :)

^^Sis wala naman expiration ang notarized document. Kaya lang since deed of sale yan dapat sana nabayaran na yung taxes sa bir na capital gains tax and documentary stamp tax may penalty kasi ang late payment.

question ko lang po..

Ano po ba legal action pwede kong gawin laban sa kapatid ko na lagi po akong pinapadalahan ng degrading messages? since 2010 pa na ganon siya. may mga panahon na bigla po akong aawayin o susumbatan about sa mga nagawa ko na hindi naman siya ang accountable. sobrang nakaka apekto na po kasi sa isipan ko yung ginagawa niya, to think na mas matanda po ako para pagsalitaan ng Langaw, Mayabang, tapos mumurahin ako sa messages.

Paulit ulit lang po kasi, ang ginagawa niya, ib-blocked ako after niya mag message para hindi na ako makasagot. madami siyang sinasabi about sa buhay ko. mga pamimintas o mga salita na hindi man in public sinabi pero nakaka depress na po sa akin dahil matagal na ginagawa sa akin. gusto ko po sana siya ipa-Baranggay kaya lang hindi ko alam anong pwedeng laban sa ganito.

I just want to know if meron bang required number of days na dapat ma-settle ang separation pay due to retrenchment? or okay lang na kasabay na ng last pay yung separation pay?
Say after 30 days from the employee's last day, separation pay must be released.

not a lawyer but a big fan of law and lagi ako nakikinig sa radyo about this topics. grave threat ang pwede ikaso and may kulong dun as far as i know. sa anak mo naman, pwede child abuse or cyberbullying if online. pero mas sure ako na pwede mo kasuhan child abuse... read po vawc, violence against women and children if pwede sya dun. :) kinig ka din sis sa FM radyo 92.3 meron sila for legal questions dun every 12nn. lagi ako nakikinig dun e hehe :)

hi! not a lawyer pero medyo familiar lang sa situation/example
ang basis ng CGT capital gains tax ay six percent (6%) CGT (capital gains tax) is based on the gross selling price or fair market value or zonal value. (disclaimer, 6% pero baka affected na ng TRAIN law, that i don't know)
since na mortgage sa bank un condo, pag binayaran un balance sa bank, need nyo mag request ng certificate of full payment/ statement of account from the bank. kunwari ang nilagay dun 1.5M

if 900k selling price na directly ibabayad sa seller and may 700k ibabayad sa bank which is equal to 1.6M, ang selling price

pero kunwari, ang fair market value is 1.7M and un zonal value is 1.5M,

ang gagamitin ng BIR ay un fair market value = 1.7M as based price kung saan 6% nyan ang babayaran ng seller.. or pwede din naman shoulder din ng buyer (Depende sa usapan)

---> sa SOA statement of account from the bank makikita un amount, (yan un loan amount) and before I forget, SOA and Certified SOA un irerequest sa bank ha, may dry seal kase un certified pag wala at sinabi ng BIR examiner na kelangan merun dry seal, babalik ka ulit... it happened to me actually..may bayad din un certification sa bank or baka depende sa bank, ako kase 200pesos binayad ko per certification, so 400pesos lahat.
so un certification ko, certification of full payment, certified SOA


malalaman ni BIR un selling price based sa notarized deed of absolute sale or kung ano man Deed of Sale ang ipapa execute nyo. Most lawyers may range ng notarization fee. My example is from a lawyer na best option ko sa pag canvass ko, pag 1M-1.5M ang selling price ang fee ay 5k.

mas reputable na law firm or lawyer (so hindi un mga nasa gilid ng makati post office), mas hindi ka i quequestion bakit yan ang selling price. or maybe napatapat lang ako sa BIR examiner na sobrang daming tanong and hinihingi na documents hehe..

^Thank you ng marami sis. Hay magastos pala talaga at maraming proseso pagbenta ng property. I have another problem, kasi hindi namin alam saan makukuha ang fair market value. Sa city hall ba? Gusto kasi namin malaman how much magiging CGT para maka move on na kami sa iba pang dapat ayusin. Totoo bang lagi mas mataas ang FMV sa ZV?

hello sisses, any idea how much it would cost to get a lawyer to do the paper works for dividing the lot for the children as inheritance.

Possible kaya na magdraft na lang ng letter then pa-notarized na lang sa lawyer para cheaper.

Mga sis may queation ako. 17years na po hiwalay parents ko (physically). Namatay po father ko last month, and malaki pa po yung naiwan na utang sa hospital. Ngayon po naglalakad kami ng papers ni papa... ang gusto mangyari ni mama eh makuha lahat ng pera from pension ni papa na wala akong share. Wala po ginastos ni singkong duling si mama nung na confine si papa. What to do? Ang laki pa po ng utang ko sa mga kapatid ni papa. Nag iisang anak lang ako. Lahat daw po eh sa mother ko mapupunta.
