My maid will be leaving soon. Naka 6 months and 10 days siya sa akin. Actually nagkasagutan kami and dahil doon she wanted to leave na. So shempre because of her attitude naman talgang hindi na siya pwede magtagal pa sa akin. Now I am bothered whether I should give her 13th month pay and bonus?

^13th month pay is mandatory. but pro-rated i think. when our yaya left last september after 4 months of service, i gave her 13th month na pang-4 months service lang din. That was documented in the last pay she signed for me (I didn't issue payslips na since buo naman yung salary nya kada a-kinse kahit me absences sya).

ETA:

From the IRR:

"Section 8. Thirteenth month pay. - The Kasambahay who has rendered at least one (1) month of service is entitled to a thirteenth month pay which shall not be less than one-twelfth (1/12) of his/her total basic salary earned in a calendar year.

The thirteenth month pay shall be paid not later than December 24 of every year or upon separation from employment."

^Kahit sa English naman mapamura ako alam niya pa rin yun lalo na for a fact nakapag tapos na siya ng pag aaral and now teacher na  ;D Kaya nga lalo lumaki ulo eh!

Maganda nga sana yung naintindihan niya para mag sink in sa kanya lalo.  ;D Sa pagkakabasa ko naman ng KB parang wala namang offense saka hindi pa naman yun dapat kasama sa psychological effect.

Wala gusto ko lang masigurado, kasi ang pinakasigurado lang ako is hindi mo dapat siya sasaktan or physical abuse pero emotional or verbal abuse parang wala namang nakalagay na offense eh!

IMO, & this may not apply or be the best course of action:  if I  want to vent an irritation or anger at a maid --  I will curse, but in a language unfamiliar to her.   I do so because she is the one with inferior education/experience/background/comprehension/familiarity kaya may palpak or pagkukulang.  And the inferiority can't be helped, at least until further training or change in her attitude/comprehension. So I separate the palpak act/oversight from the inferior person.  Yung ginawa nakaka bw1set, not the person.

That is as far as venting goes.

But to make the helper correct her palpak -- yan, I even simplify my communication, or spend time to even explain the obvious para ma "getz" at baka no more repeat same/similar palpak.

When it is the person already at fault as in matigas ulo, disrespectful, mali attitude -- as in. "Getz" but won't deliver --  sarcasm is my usual approach.  Baka madaan  sa hiya.  Or ma challenge to deliver.

But well, each helper has her unique ugali & diskarte  na ng amo how to correct/motivate.
But well, nowadays they just leave when they are challenged. Lol

So? Puede delay payment of 13th month pay UNTIL separation from employment.
So...  For those who find the social expenses of Christmas already burdensome...  Puede pay at the end of the agreed upon end of contract.
Don't they usually say they can commit for 6 months or a year?
So, may konting incentive for giving the amo due notice (hindi basta pag nag off eh hindi na bumalik) --  kasi naka pending the 13th month pay.

^ the 13th month is equal nga to 1 month salary, assuming na hindi ka nag-increase ng salary nya within the year. ang understanding ko sis,

sum of monthly salary for the year divided by 12.

sa case ko since 4 months lang sa akin si yaya, 4 months lang yung sweldo na pinag-add add ko, then divided by 12 pa rin.

sa ibang mga sis natin, pa-clarify na lang din. :)


sis aquacharly, yung "upon separation from employment" ang intindi ko is if hindi umabot ng december yung helper syo. but then debatable nga because hindi clear yung statement. so pwedeng january or february magbigay ng 13th month for helpers? baka maireklamo naman tayo sa baranggay? hehe...

For my sisters who have 1-4 helpers,
I told them to keep  a notebook, 1 maid per page.
But I warned them to always safekeep well the notebook.

 Aug. 15/13.   Advance for day-off                   P 1,000.      Signature
 Aug. 31/13.   Complete sweldo for
                      Aug 1-31 less Aug 15 Advance.  P 4,000      Signature

Every time the maid gets paid - have her sign for the amount
Write mo din dyan any payments you add for her contributions

If you will follow the paper rqmnts para kang naging PA ng maid mo. Hello
So just learn how to simplify to your advantage - but be sure to protect yourself
A notebook, in our opinion is enough --  what for receipt booklets pa?

When she asked for bale the last she had her day off, I maid her sign in a notepad lang.  She was referred by our yaya in Valle so I'm hoping she is matino.  So far she's careful naman with my delicate dresses.  SSS can be given after 6 months that she's with us right?  We are not sure if she will stay long enough. on my case late na ko nakapag-register as employer kaya puro penalty ako. until now, pag-ibig hindi pa ko nakapaghulog. hay buhay!

i just got a new yaya 2 days ago. so I don't need to give her 13th month.

I think I will start keeping a formal log of my yaya's salary para walang confusion sa mga advance.

What was the basis of the penalty?  Is it because you registered late (after May 2013)? 

You can pay PagIbig through their website - you can even use your credit card, with a 3.6% surcharge.

Please be aware that aside from the payments, we should also file our reports of these payments pa.

happie that's my understanding as well. Just make sure to have a contract that states that you are the one paying for the fees if below 5k the salary of your maid.

Question lang mga sis. I have registred na sa sss and october na employ maids ko. If i register sa philhealth this january, can i declare na january lang sila dumating? Mkikita ba na sa sss records nila is october ang employment date nila? Ayaw ko na kasi magka penalty pa. Abala talaga aabsent pa ako para lang lakarin ang requirements..hay...

may question lang ako tungkol sa philhealth ng kasambahay ko. voluntary na syang nagbabayad bago pa sya pumunta sa kin.  nung pagpasok sya, ako nagbayad ng philhealth nya thru BDO. one quarter na yung binayaran ko.  pero nung nag inquire sya sa Philhealth, wala raw contribution na natanggap.  kailangan rin ba mag post ng payments kahit voluntary member?

hi, yung sa mga nagpopost ng payment sa sss madali lang ba?  parang nakakatakot kasi baka ma-virus yung laptop ko kung dahil iba ibang usb yung magagamit.  yung ibang brances kasi ng sss hindi na tumatanggap ng manual posting

Maids are getting too cunning now because of this whole Kasambahay Law. I interviewed someone yesterday and goodness, pipigain ka talaga. Wala naman masama if they assert their rights, but may iba talaga who borders to mananamtala. For example:

1) By law they are allowed 4 days off per month. Gusto daw niya to take it 2 days straight at a time, 15th and 30th of the month. I agreed. Pero ang siste, gusto niya aalis siya ng Friday night, tapos babalik siya early Monday morning. Eh hindi na 2 days iyon di ba? In short parang she's insisting na dapat ang day off is 48 hours straight at hindi kasama duon ang travel time niya. Ano siya hilo?

2) She is supposed to start on the 21st pero gusto niya mag day off na siya at the end of that week! Ni hindi pa isang linggo nag-trabaho, day off na kaagad. Talo pa ang employee sa opisina na nakakakuha lang ng leave with pay credits after 6months.

3) By law they should be allowed to practice their religion. Iglesia siya so she asked if she can leave for a few hours on Thursdays to make samba. I dont have anything against that pero that should go against her day off credits, dont you think? Apparently, iba pa daw dapat yon  ??? ::). Although malapit lang naman sa amin and sabi niya an hour lang naman the service but if you factor in her prep time and her travel time to and from, eh mahina na ang 2 oras na mawawala siya. Again, I will have to shoulder whatever load shes doing. Bakit pa ako nag-yaya kung ganun?

Alarming bell for me was when she said na ayaw daw niya maghatid sa son ko to a nearby preschool. The son of her former employer goes to the same school. Sinabihan daw siya ng amo niya before she left that huwag na huwag daw niyang papakita pagmumukha niya sa kanya (her own words, not mine). Makes me think na hindi totoo na she left because mababa ang suweldo.
