^Non news about the extension. SSS did a sort of a remote registration when they went to BSP last week to accept documents for helpers and employers' registration.  I remember seeing a ticker news at dZMM about a one-stop shop on Jul. 5, but till now no details yet.

^^Oo nga eh, wala akong naririnig na may news on the extension :(

^sis, correct me if I am wrong but alam ko 15 is the age limit of SSS for giving SSS numbers.  Any younger than that, hindi ata pwede bigyan.

sorry sis I won't be of help, but I think you better call DOLE just to be sure kung paano since minor..  ako kasi personally, I'm scared of minors e.. 17yo lang nga di ko tinatanggap kasi natatakot ako with them.. :(

My helpers all have SSS, PhilHealth & Pag-Ibig membership -- I pay for all the premiums kasi  meron dyan  ayaw ng PhilHealth & Pag-Ibig.
Como I pay for 100percent of all premiums - I make them register as self-employed, using their own addresses.
They are all in the max contribution bracket.
My lawyer says I am less prone to syndicate shakedown (& future BIR investigation) pag ganyan kesa ako ang registered employer.

Do I think I am in violation of The KBill?
Nope -- full coverage naman sila.  And the level of their coverage corresponds to their pay scale.
Abonado pa nga ako.
In case of gulo, I can always deny they are always everyday in my employ. I will just state hindi lang ako amo nyan. 


IMO, better not to hire minors.

^sis tanong ko lang pwede pala yun na kahit nandito sila sa manila, ang address na ilalagay nila sa province? So like yung sss id, it will be mailed sa province na nila? Saka ano pala sinasabi nilang source of income kung self employed dineclare nila? Kasi ang alam ko tinatanong pa ng sss kung ano pinagkakakitaan pag self employed eh.

Last, what do you mean by syndicate shakedown? Sorry for the ignorance.

Or they use the address of a MManila or nearby relatives';  basta don't use my address.
Payment of contributions naman  eh kahit saan accept.    :)

My helpers already have SSS & PhilHealth - minimum -- pagdating sa amin.  A few had no Pag-Ibig; but that's  easy to get membership for coz PagIbig just bases  it on the SSS remittance receipt/record.
I don't employ kasi mga greenhorns.  My basic requirement is always: has a basic skill with proficiency, & has been employed in a household in a village/subdivision similar to mine. So all have SSS, minimum pag dating sa amin.   

I got the idea of their paying as Self-Employed from them too.
May mga go on bakasyon for a year, couple of months -- they can afford eh.  So, they continue on their  own as self-employed; they can afford that too.

Their jobs? Well,  they declare housemaid, Lavandera, market vendor, yaya --  whatever. Ang importante lang sa SSS eh regular remittance. 

Some people anticipate that certain "enterprising groups" will make it a business:  shaking down employers,  since now there is a law regulating their rights & corresponding benefits .  Where there is a law, there is opportunity in differences interpretation & partial non-compliance.  Kung pre-law, pinag usapan na lang: eh now hahaha - kelangan kumita pati mga asungot.  Kung dati, the amount is near whatever the discrepancy is; eh now malamang ginawa ng negosyo.  Lol

Now, since they are  "self-employed" -- compliance is their look-out, not mine.  The burden shifts to them:  the correctness, record-keeping, etc.  di demanda nila sarili nila, Lolz

My problem is, I hav 2HH who claim that their birth and baptismal certificates were never registered. I am aware that there are other papers that can be submitted in place of the above mentioned ones, but I also read somewhere here in GT that they can't claim their benefits without the birth cert. The 2 of them are also saying that they are not interested in getting the said benefits because ayaw na nila ayusin papers nila. But it's a law na kasi. Ano laban namin right? My parents told me let them sign daw a waiver but what good is a waiver vs the law? Is it enough to let them sign a waiver? Both of them are refusing to fix the benefits, eh willing naman kami to give it to them.

^no - it is not up to them, nor you, to waive requirements of the law.
Compliance is a must.

If they will sign  a waiver -- might as well have  them sign that they are self-employed and you are not their solo full-time employer.
But, IMO, so what if they will later on be unable to claim benefits?  Basta you are  not the one to be sued  under the law; deliver on your legal obligations.

The resistance is due to deductions in take-home pay due to their share of contributions.
Think if they are worth it.
If yes, pay for 100% of all contributions -- almost P1thou per maid per month -- as self-employed.
Believe me, they will get greedy and sign as self-employed; sign all 3 agencies' docs with hardly any comprehension -- pero they sure look forward to drawing down benefits later.  If they have a hard time later -- what can you  do? It's their fault. Basta while servicing your requirements - the 3 agencies  got their  pound of flesh, este taxes,  este contributions pala.  The burden of proving wrong on your part is on the maids -- ano offense nila?? They refused to comply with  their legal obligation to pay their share.

i had one HH gusto ko sana sya magpa register as Voluntary member sa SSS para hassle free ako pwede kaya yun hindi kaya madami tanong pag nag apply sya sa SSS? On my part naman na to prove ako nagbabayad sa sss nya ipa receive ko sa kanya proving na ako talaga ang nag papay?

Pls, enlighten me kung pwede ganito na lang gawin ko rather filling pa ng Household employer.. tia

@aquacharly - if they are self employed, you just give them the money and bahala na sila mag bayad? I've looked some of the forms over (SSS, pagIbig, philhealth), and there are some items there that I'm not sure how to answer. IMO, only one of them is worth it, but since my husband is in desperate need of both, no choice. Do u just let them sign the forms and bahala ka na with filling the rest of it up or do they answer them also? Sorry, I' m feeling horribly confused at the moment. Thank you for your help!

Are the breakfast/lunch/dinner breaks inclusive in the 8hrs aggregate rest period? My problem with my maids ang babagal kumain. I gues they use that as chimisan time which is really not a big problem for me. Kaso I have a rule na by 10pm lights off. So any work dapat tapos nila by then; work beyond that is considered OT as per their contract. Eh kaso yun nga ang babagal kumain. We finish dinner by 7pm. Kids are in bed by 730 pm. We rarely make utos after that. That gives them enough time to take their dinner and wash the dishes plus clean up. But how will they accomplish that when, like now its 9pm already hindi pa sila tapos kumain?

Isang beses lang naman ang employer registration. After that, bayad na lang ng bayad monthly. Pwedeng iutos na lang sa kanila yun. Pero the employer must keep all the records of payment.

For reasons I don't wanna explain here, I really prefer they contribute as self-employed.
I am not out to convince others to do that, I am just sharing  my approach vis-a-vis the KBill.

I don't see any difficulty with the SSS.
1 of my junior accountants brought all their docs there 1 afternoon & had them registered as such.
Pa prima sa kanila, bumalik si accountant to submit -- tapos.
Ang advantage, this way, for the helpers, is -- when you terminate their employment -- they are able to just continue on their  own, without fear/hesitance to deal with the 3 agencies.

All my office does is to have them sign for each peso  they get from me.
Even their OT and extras when I have parties in the house, bonuses, etc --  receipt by them recorded.
That is all.
Como self-employed, hindi na kami maintain remittance of contribution records for each helper for 3 agencies.  That is the helper's burden. 
Happy sila - kasi they receive their pay buo - no deductions,  tapos I pay for all 3 agencies, & they get their receipts.



Isang beses lang naman ang employer registration. After that, bayad na lang ng bayad monthly. Pwedeng iutos na lang sa kanila yun. Pero the employer must keep all the records of payment.

If I register pa as the employer -- it is less simple, IMO.   Iisa isahin  ko pa yang pag pay ng contribution share, give my share as employer for them to pay -- habulin ko pa  binayaran ko --  pay, then habol for proof of payment?  Tapos, record keeping pa?  No, I don't think so it's simpler for us both. 

Who cares how the contributions are paid? Basta bayad.

Lol.  Sabihin ni Inday Kay SSS: 'Teh! Self-employed akong kasambahay kasi lumulubog lumilitaw ako eh.  Pag hindi ko feel mag work kasi fiesta, pagod sa gimmick, wala trabaho si Mr o ang BF ko kya naka istambay/ Kasi manonood kami sa Luneta, babarilin uli si Rizal/2 bahay kong pinapasukan as a Lavandera --  ano pa say ni SSS...sino 1 amo papayag akuhin ang total obligation for 1 kasambahay na 2 or more ang amo??

Don't look at me as if I sprouted horns.

1.    I give my maids 48 hrs off per month, and 1 full month with full pay plus plus after only 11 months.
They also have birthday off, hubby's bday off, either NYear or Xmas 48 hrs off;  48 hrs minimum off when my entire family goes abroad (at least 3x a year). 
I just object to the 1 day off after 6 days. Eh sila nga mismo  ayaw ng weekly off eh!

2.  3 years record-keeping?!   You gotta be kidding.  Hindi ako pay more than  going rate  for each helper to be their record keeper, nor add to my secretary's/a jr accountant's office load for 7 kaTULONGs. 
Pag exit ng helper for bakasyon or termination -- aside from the Quit Claim I have them sign NOT in my presence but in the presence of our village General Manager para never ever ma say hindi nya understand prima lang sya; or pwersahan pirma sya  --  she also signs receipt for a copy of the SSS etc receipt tallies  of  contributions made to her account.    Tapos ang record keeping. 
Ako na mag bayad ako pa archives?!  Saya mo, Teh. Lol

^Given the choice, gusto ko rin na magvoluntary / self-employed payment ang kasambahay ko. I very much agree, too much hassle for the employer ang bagong batas na ito.

But based sa mga nakita at nabalitaan ko, dumadaan sa butas ng karayom ang isang kasambahay bago makapag-voluntary payment. I am referring to those na first time lang magko-contribute sa SSS ha.

I act as an Admin/HR Manager din of our business kaya familiar ako sa mga scenarios sa SSS. Madalas ako sa SSS kasi inaalam ko talaga lahat ng procedures bago ako mag-utos sa staff.

Katulad nung isang aunt ko, mga two years ago, gusto niyang ipa-SSS yung kasambahay niya. Sinabihan niyang mag-voluntary, inutusan sa SSS, ayun hindi pinayagan. Ginisa ng SSS staff. Ang sabi, ng SSS staff, andami na raw gumagawa ng ganyan... pinagvovolunteer yung mga kasambahay para nga daw less hassle, hindi daw nila papayagan.

Hindi rin daw kasi believable na yung isang freelance labandera o plantsadora ay magvovoluntary sa SSS. Ideally, dapat naman talaga ganun. But then dahil ka karamihan sa Pinoy isang kahig isang tuka, di na talaga nila napaprioritize ang pagbabayad ng social security.

I've seen in my eyes several times kung papano ini-interrogate yung mga gustong mag-self-employed o voluntary. I swear, napapaamin din yung mga tinatanong na may mga amo sila talaga. Btw, pag self-employed kelangan me mga proof of income pa.

Mas ok ang VOLUNTARY payment kung ang kasambahay ay may dati ng pinapasukan at nahulugan na sa SSS dati pa. Pag lumipat sayo, itutuloy lang ang payment as voluntary. Pero dapat same bracket para walang tanong.

Halimbawa, kung 3k ang sweldo niya sa past amo niya at 312 ang SSS contribution nya dati, dapat 312 din ang voluntary contribution niya. No need to register, magbabayad lang agad as voluntary.

Ay yung sinasabi kong sila na lang ang utusan na magbayad, ang ibig kong sabihin ay sila ang physically magpunta sa SSS o bank to pay. Pero yung preparation ng form, yung amo na dapat ang magprepare. Tapos yung form, dapat ibalik sa amo pagkabayad para maifile. Again, hassle. Pero kung makakasanayan na naman, paulit-ulit lang naman monthly so magiging madali na rin.

Pero sabagay, isa lang naman ang kasambahay ko kaya walang problema. Mahirap kapag maraming household staff, yun talaga ang sobrang matrabaho.

^With all due respect, my husband and I own businesses that are labor intensive. May HR Dept din kami.  We have 2 accountants na walang ginawa but to attend to  the BIR, SSS, PhilHealth & PagIbig requirements of our employees and labor force. 

Contrary to your experience, we have had no problems having my house staff categorized as self -employed.  My sisters too have been able to pull it off.   Sa QC, Pasig & Mandaluyong.

What is not "believable" about a self-employed lavandera or planchadora, or even a cook?
Marunong pa yang SSS factotum?
Hindi ba ok na contributions  are paid, kahit na ba kaninong bulsa  galing?
Siguro, nasa manner of answering.  Who is an SSS factotum to know better? Or to deny? 
Dapat  barahin: 'Teh, taga assist ka lang para ma bayaran contribution.  Lol

what i don't understand in the law is, it says if a househelp leaves within 6 months from hiring, you can deduct your "pamasahe" expense from their, salary, but you also still have to pay them 15 days work, e paano kung bigla na lang umaalis ng walang paalam, ( it always happens ) paano mo ma dededuct yung pamasahe na inabonohan mo sa kanila, and does it mean that you did not comply in giving them their half a months work if they just left without notice? can they come to haunt you?

can anyone enlighten me on this?  BTW, complied fully with the sss, pagibig and philhealth.

^Exactly!  Especially those who took their day-off and never came back.  But maybe treat it as one would treat an AWOL employee in a company.  And maybe sa contract nila (pagpasok pa lang), it's already stipulated there, example if AWOL after a certain amount of time wala ng habol whatsoever.

What bothers me with this law is the lack of protection for the employers (sabagay kaya nga Kasambahay Law).  But it's too one-sided, I mean alisin na yang mga contributions, for me it doesn't really offer anything new.  Sabi nga the SSS contribution "law" was already in place since the 90s.  So anong bago?  I mean there are other aspects aside from the big hullabaloo about the SSS/PhilHealth/Pag-Ibig issues.  Just look at what happend to the 3 month old baby in the news just yesterday.  The employers did everything right even the background check and current address check.  But look where is the yaya now?  Nawawala na.   Imagine the suffering of that child and parents if in the long run the baby would suffer the effects of the shaken baby syndrome.  And swerte  pa that this couple have CCTV camera installed, pano yung mga walang means to do these??

Lahat talaga ng disadvantages nasa employers.  The gastos in the fares and contributions among others, pati "overtime" pay pa ha (eto talagang di ko matanggap).  Tapos biglang ganyan makikita mong ginagawa sa anak mo or yung nanakawan ka sabay alis or yung nagday-off na di na bumalik.  All that hassles and stress, without even a single protection for us employers.  :P
