De Facto Relationships (Common Law Partner)

Hi. I'm in one right now and I'd like to know from legal perspective what are the rights (if there is) of each individual in this kind of relationship.

The thing is, I'd like to file a complain at my partner's HR dept. against one of his co-workers for having a relationship with him even if I have already told her to back-off from my common law husband who's got kid and family. Now since they won't stop with their "escapades", I'm planning to get even-- even if it means that my partner will lost his opportunity for career advancement, too.

As far as I know, you have no right to file a complaint against him or his co-worker with their HR Dept.
Even if you have kids.

Thanks mga sis! So dasal lang pala ang magagawa ko for them to stop. I was planning to hit them based on the company's integrity clause sana kasi there was a time na nag-absent pa isa sa kanila just to see each other. Gumawa pa ng excuses tsk tsk. Nakakagalit lang mga pinaggagagawa nila sa pamilya namin at sa trabaho nila.

let karma make its moves...be thankful in one way na hindi kayo kasal at nagawa niya yan sa inyo ng anak mo atleast kung mag
hiwalay kayo e hindi na isang damak mak na paper works...

Under RA9262 defines clearly

"Violence against women and their children" refers to any act or a series of acts committed by any person against a woman who is his wife, former wife, or against a woman with whom the person has or had a sexual or dating relationship, or with whom he has a common child, or against her child whether legitimate or illegitimate, within or without the family abode, which result in or is likely to result in physical, sexual, psychological harm or suffering, or economic abuse including threats of such acts, battery, assault, coercion, harassment or arbitrary deprivation of liberty. It includes, but is not limited to, the following acts:

(e) "Dating relationship" refers to a situation wherein the parties live as husband and wife without the benefit of marriage or are romantically involved over time and on a continuing basis during the course of the relationship. A casual acquaintance or ordinary socialization between two individuals in a business or social context is not a dating relationship.

But make sure before you file the case you are armed with all supporting documents of their affair

wala namang number of years para maconsider na kasal. the law, VAWC is applicable kahit sa gf or bf lang, kahit "dating".

Yes under the VAWC, sad to say Philippines has still not recognized this type of relationship while other countries already recognized and even part of their application visa requirements

Even a legal wife CANT sure her husband for adultery, only concubinage. So you can't sue a man for cheating on you (BUT BEWARE, a husband CAN sue his wife for Adultery. Sad to say it only applies to husbands not the wives). Moreso a common-law partner will have no rights at all, regardless of how many children they may have.

But, having said that. There are many ways to get even =) =)  Usually if you tell HR that your common-law husband is cheating on you-- they usually sack at least the girl because companies do not like messy situations.
