hi mga sis!

my dad died last september and left no will. kami lang naman ng mom ko ang heirs nya since i'm an only child.

one of my titas told me na we need to pay taxes daw... estate tax ata. iba pa ba yun sa real estate tax? para saan ba yun? is that really required?

[textspeak!]-ano ba ang mga required na dapat gawin after someone dies?

[textspeak!]-ano ang mga taxes, paperwork etc. involved?

any idea about requirements and deadlines and which offices to go to?

so far kasi, yung SSS pension pa lang ang nalalakad ng mom ko.

hi sis. wala ba kayong kilalang lawyer or family lawyer? bakit wala syang iniwan na will? kasi lawyer mismo makakasagot nyan para hindi kayo mahirapan ng mommy mo

we don't have a lawyer. he didn't leave a will kasi kami lang naman ni mommy ang heirs nya.

actually, nalakad na rin namin yung sa life insurance. wala nang active bank accounts si daddy.

yung bahay at lupa na lang talaga. pero since conjugal naman nila ni mommy yun, kailangan na ba talagang gawin yun? required ba talaga ang estate tax?

YES, REQUIRED  ang estate tax/death tax sa conjugal house and lot na yan.
If you delay, there will be penalties to pay later on. 

Start with  a notarized extrajudicial settlement between you and your mom.
Since your mom is the surviving legal spouse, & you have no legitimate/illegitimate siblings ----
75% goes to your mom, 25% to you - computation per Phil law. 
Or, your mom can give you more -- but you must document that sharing.

You must remove your dad's name sa TCT & put in yours (legal age ka na I ba?). 
If you do not -- it will catch up with you 1 day, malaki penalties & more complicated paperwork. 

Really, consult a lawyer; or a competent employee of the Registry of Deeds -- may checklist sila.

You can hardly antedate nowadays Deeds of Sale without paying penalties coz there are deadlines in place already for paying all those taxes/fees due on property sales.  (A  competent broker can explain this to you.). So push the numbers, may be less costly to pay death taxes.

hi sis. just went through this process as my dad died last march. kaming 2 lang ng mom ko since i'm an only child also.

family house is exempted up to 1M (fair market value). first, you have to file a notice of death sa bir office within 2 months ng time of death. then the estate tax should be field/paid not later than 6month after time of death.

there are exemptions too. i will mention some here.
medical expenses up to 500k
burial expenses (pati sinerve an food sa burol, etc) - 5% of gross estate or up to 200k, whichever is lower
standard deduction of 1m
share of surviving spouse - 1/2 of value
unpaid taxes
judicial expense

sss is exempted from estate tax. and also, meron pa palang burial benefit sa pag-big, 7k. noon lang namin nalaman. insurance, exempted if irrevocable. that's accdg to law. if revocable, isama sa estate but di rin ito nasusunod haha

if yung house & lot na lang talaga, na im assuming e family home niyo to.
first:
 - get a family home certification from the barangay captain
 - local munisipyo - get updated tax declaration and tax clearance for the land and house. note: land AND house. minsan kasi some of us pay only the lot.
 - provincial munisipyo (sorry, don't know the term here haha) - get aggregate total land holdings para patunayan na wala ng ibang properties ang dad mo

prepare the title of the property

then, go to an attorney. magpa extrajudicial settlement kayo. kami, ginawa namin ng mom ko, both of us e nasa title, so ang labas e 50/50 kami sa property/ies. we asked around ano maganda. if sa akin lang, since obviously im younger. but sabi nga, di mo naman alam sino mauuna haha so we decided na kaming 2 na lang. we also decided that we will sell some of the properties. masakit din pala sa ulo pag madami.

you also have to gather all the receipts that you can para sa exemption
then, fill up form 1801. sabi diyan dapat CPA. so mas okay if you'll get a CPA lawyer para isahan na lang.

after ma compute, time to check if may babayaran kayo or wala. if the net estate is not over 200,000, exempted. mas okay din if you'll take time to study how to compute para di kayo madaya. honestly, ang dami kong natutunan sa paglalakad nito kasi ako mismo ang gumawa.

then, wait for a few months again. ilalabas ng BIR yung CAR. yan ang dadalhin naman ninyo para ma change yung property sa name niyo/mo.

double check niyo if wala na bang iba talaga, like baka may stocks pala dad mo.
also, make sure na pag nagpapa receive kayo ng papers sa gov't, lagi kayo may receiving copy. mahirap na hehe

thanks for the advice. lumabas na yung CAR pero ang nakalagay na name sa list of transferees is kaming 2 ng mom ko. nakalagay sa extrajudicial settlement namin na my mom waives all her right to me na. tama ba na kaming 2 pa rin ang nakalagay sa CAR kahit may waiver na?

nung tinanong ng mom ko, sinabi raw na dapat daw e mag-deed of sake or donation pa raw. bakit ganun e may waiver na nga? TIA!

^ afaik, ganyan nga dapat. nabanggit rin yan nung nagtanong kami so we decided na sa min na lang ng mom ko ipangalan pareho lahat kasi mas madodoble kami if iwawaive ni mama yung rights niya in favor of me. kasi we decided to sell some of the properties din pag naayos na. so kung iwawaive, may deed of sale/dontation from mama to me, then pag bebenta ko e meron na naman vs kaming 2 ni mama nakapangalan then benta yung property.

yung una kasi naming naisip, i waive rights ni mama para di na madoble doble. and pina check din namin sa attorney re sa double taxation.

buti pa kayo lumabas na CAR. kami di pa haha kasi yung business e dec 31, 2012 kami nag close. ayun, natapos na din ITR and kakasubmit lang namin last week sa bir. yun na lang kasi hinihintay para maging official na lahat.

question lang din (makikisingit lang po). is it true na wala ka ng makukuha sa philhealth kapag namatay na yung may account? i mean wala ng reimbursement sa mga nagastos sa hospital? 1 day lang si MIL sa hospital nun and she immediately passed away last year. umabot ng 80k yung bill and now the children want to get reimbursement sana from philhealth if possible.

@ sis babythug- 60 days upon discharge ang grace period to file for philhealth. dapat na file yun when settling the bill para nabawas na..

muntik na kami di umabot when we filed it kasi matagal mag compute sa hosp.

^sis morning dinala yung patient, afternoon she already passed away. so hindi nila agad naasikaso yung philhealth during the whole day eh. so pwede pa ng reimbursement yun?

^ kami sis, pagbayad namin nung bill, automatic nabawas na philhealth. wala kaming ibang sinubmit kundi updated receipts ng payment ng contributioin for 1yr. around 50k din nabawas.

also, dapat pala sa sss, I file agad yung funeral claim and if may pension na matatanggap or kahit anumamn. kami kasi 2102 death, nung dec 2013 lang kami nag file. may explanation pang pinagawa haha

sa pag-ibig pala meron ding death benefit and ibabalik contributions mo. di ko nga alam to. nakita ko lang sa tarpaulin nung pumunta ko sa office nila kasi may itatanong ako.

^ yung sa pag-ibig, wala kaming nakuha kasi may option pala to get a lump sum pag retire ng member. eh kinuha na kasi ng dad ko yun when he retired kaya di na kami eligible dun sa death benefit. sabi sa pag-ibig nung nag-inquire kami, yung mga hindi lang kumuha ng lump sum ang eligible sa death benefit.

Sisses I need help, [textspeak!] died 2 months ago may mga naiwan na properties pero Hindi namin alam how to process estate tax. Paano pag Hindi nakapangalan sa na namatay and sa spouse yung property kailangan PA ba siya isama sa pagfifile ng estate tax? Actually ang dami problem ng properties  just to give you an idea,

Family home in Manila - not under the name of spouses, still under the name of the old owner. We also discover na ang tagal ng hindi nagbabayad ng amilyar.

Few properties in the province - Hindi rin nakapangalan sa spouses, Meron pang nakasangla. I assume Baka Hindi rin bayad yung mga amilyar.

Property in the province - rights Lang siya wala pang titulo pero yung rights under the name of the spouses na.

Questions: Kahit Hindi PA nakapangalan sa spouses yung title isasama na ba sa pagfifile ng estate tax?
What if nakasangla yung property and malapit na mailit isasama PA rin ba? how about Kung rights lang?

kailangan din bang bayaran Muna lahat ng amilyar ng property? Yung isang property kasi umabot na ng daang Libo sa tagal na Hindi binabayaran.

Ask ko na rin , yung naiwan bang bank accounts isasabay na rin sa pagfile ng estate tax?
Mga magkano ba aabot amount ng tax? What if Hindi kaya bayaran agad?

Sa extra judicial ba lahat ng magkakapatid needs to sign? NASA abroad na kasi lahat isang anak na Lang ang nandito.

Sorry and dami tanong. Dint know where to start sa pagprocess.

i have another question, may property ang lolo ko under his name sa Mindoro. he is already dead and left no will. he has 4 children and pumayag na lahat na ibenta yung property. however, one of the children (my dad) is dead na rin. kami lang ng mom ko ang heirs nya and payag rin kami na ibenta ang property.

nilalakad ng isang tito ko now [textspeak!] estate tax ng lolo ko and biglang kinukulit nya kami ngayon ng mom ko kasi hinihingi raw ng BIR ang birth certificate ko (which I understand), land holdings certificate, certificate of residence and paperwork ng bahay namin here in manila (property declaration, tax clearance, etc) na pinundar ng parents ko na nakapangalan na sa akin ngayon. (nilipat na sa name ko [textspeak!] property after my dad died)

bakit kelangayn yun eh wala namang kinalaman [textspeak!] property sa manila sa property sa Mindoro since sariling pundar na yun ng parents ko at from the start, sa pangalan na nila yung bahay.

ano ba talaga ang process ng estate tax kung patay na ang isa sa mga heirs (my dad) and may heirs ring naiwan yung namatay na heir (kaming 2 ng mom ko)?

also, pwede pa rin ba kaming habulin ng BIR for estate tax ng property ng lolo ko na never naman nalipat sa name ng heirs nya? hindi kasi naming sinama yun nung inayos naming [textspeak!] estate tax ng dad ko since hindi naman sa pangalan ng dad ko yung property sa Mindoro.
