hi sis. just went through this process as my dad died last march. kaming 2 lang ng mom ko since i'm an only child also.
family house is exempted up to 1M (fair market value). first, you have to file a notice of death sa bir office within 2 months ng time of death. then the estate tax should be field/paid not later than 6month after time of death.
there are exemptions too. i will mention some here.
medical expenses up to 500k
burial expenses (pati sinerve an food sa burol, etc) - 5% of gross estate or up to 200k, whichever is lower
standard deduction of 1m
share of surviving spouse - 1/2 of value
unpaid taxes
judicial expense
sss is exempted from estate tax. and also, meron pa palang burial benefit sa pag-big, 7k. noon lang namin nalaman. insurance, exempted if irrevocable. that's accdg to law. if revocable, isama sa estate but di rin ito nasusunod haha
if yung house & lot na lang talaga, na im assuming e family home niyo to.
first:
- get a family home certification from the barangay captain
- local munisipyo - get updated tax declaration and tax clearance for the land and house. note: land AND house. minsan kasi some of us pay only the lot.
- provincial munisipyo (sorry, don't know the term here haha) - get aggregate total land holdings para patunayan na wala ng ibang properties ang dad mo
prepare the title of the property
then, go to an attorney. magpa extrajudicial settlement kayo. kami, ginawa namin ng mom ko, both of us e nasa title, so ang labas e 50/50 kami sa property/ies. we asked around ano maganda. if sa akin lang, since obviously im younger. but sabi nga, di mo naman alam sino mauuna haha so we decided na kaming 2 na lang. we also decided that we will sell some of the properties. masakit din pala sa ulo pag madami.
you also have to gather all the receipts that you can para sa exemption
then, fill up form 1801. sabi diyan dapat CPA. so mas okay if you'll get a CPA lawyer para isahan na lang.
after ma compute, time to check if may babayaran kayo or wala. if the net estate is not over 200,000, exempted. mas okay din if you'll take time to study how to compute para di kayo madaya. honestly, ang dami kong natutunan sa paglalakad nito kasi ako mismo ang gumawa.
then, wait for a few months again. ilalabas ng BIR yung CAR. yan ang dadalhin naman ninyo para ma change yung property sa name niyo/mo.
