This is just like most of the bills/laws/systems implemented for the last n years; hindi napag-isipang mabuti.

Just like the RH Law, K+12 education system, Cybercrime bill, etc.

Most of these enacted favor those in the upper and the lower class, kahit yung mga laws enacted all of these years. Eh pano nga naman yung nasa middle class?

Anyway OT na ako.

Okay lang naman sana itong law. Pwede naman nating sundin yan eh. Pero sana man lang nagkaroon ng transition period, or wag nilang gawing retroactive yung law.

Its still NOT garbage, FLAWED parin.  This law was created to entice voters.  When you say its garbage it means that itapon mo nalang.  Walang kwenta.  Its not walang kwenta, may kwenta siya - yun lang, naging mas malaki ang benefit ng isang side kesa dun sa isa.  Pero since I respect your view and walang basagan ng trip , then sige - for you its garbage.

I just have a question, don't get mad ha - if you've been giving all these benefits since before it became a law - ano yung garbage for you doon sa law?  What points don't you agree on?

pag sinabing may kwenta, it benefits all... pano mo nasabing may kwenta kung ilan lang ang nakikinabang? still walang kwenta di ba?

hindi ko na iisa-isahin sa iyo kung ano ang hindi ko ina-agree sa law na ito, obviously nailahad na ng ibang sisses dito ang karamihan. so what's the point of you asking me kung anong hindi ko ina-agree sa law? are the flaws you're saying not obvious for you?

if you backread, ang sinabi ko FOR ME garbage sya... lukutin ang papel at itapon, kuha ulit ng bagong malinis na papel at magsulat ng mas makabuluhan, that's what I meant when I said garbage.... good thing you respect my view, and agree na walang basagan ng trip eh, we have different views on this bill, so let's just respect each other, end of discussion  ;D ;D

at the end of the day, this is still a law, whether you like it or not, you have to abide by the law.

Hahaha hindi pa din ako agree for this reasons:

1. ang helper mas mababa ang cost of living sa province
2. ang helper pag nagkasakit sagot naman ni employer lahat ng gamot, gastos minsan pag nabuntis at nakunan sagot pa din ni amo unlike sa normal employment
3. ang helper may advance - usually lista sa hangin. Ang normal employees hindi pwede mag advance.
4. Ang helper pag nagbakasyon sagot ang pamasahe etc. Ang normal employee hindi.
5. Anong protection ng amo kapag bigla nalang lumayas ang yaya sa bill na to, edi wala.

Sis!  Saan mo nakuha ito??  These are not all true!!
1.  Yes, mas mababa nga sa province kaya cheaper :(  (sad truth!  pero mas mababa rin minimum wage nila - nagulat ako sa bicol na minimum wage ng normal employee is less than P300/day!)

2.  Sagot mo lang yung mga pag-magkasakit sila like yung mga lagnat and let's say accident relate to work.  Hindi mo sagot yung mga nagbuntis and nakunan!  Hindi na sakop yung ng law!!  Pagbuntis nga grounds yun for termination kasi hindi na niya magagampanan yung duties niya.  Saan mo ito nabasa sis??

3.  Helpers are allowed advances IF the employers allows it.  Hindi siya mandatory na pwede mo bigyan ng advance!  The law states that IF you agree to give them advances, may limit na up t0 6 months worth !!  I don't think any amo in his right mind will advance 6 months worth of sweldo.  t**** na yan if may pumayag diyan.

4.  Hindi mo sagot ang pamasahe ng helper mo pag magbakasyon!  The law said DEPLOYMENT expenses, meaning yung pamasahe ng katulong na magtatrabaho sa iyo (if galing province)  hindi mo ito pwede ikaltas sa kanya if she stays with you for more than 6 months BUT if less than 6 months siya sayo, its an allowable deduction (since less than 6 months siya sa iyo)

OO nakaasar yung paulit ulit sa TV and sa radio!  Hahaha... Its not that we don't want it but come on - diba?  Hahaha!!  Pero kasi this is their drive to let people know and talk about the law eh... :(  Kelangan ilabas lang ng details.  Ang problema lang is that these helpers of ours think naman na masama tayo kasi di natin sinusunod.  Or nagpapanilawa sa iba na hndi namang alam ng lubos kung what is right and wrong.  In short - maraming mis-informed :(

I also agree with the retroactive.  Its unfair to others.  Kahit na gusto mo gawin ,parang unfair kasi naman diba? I mean pay 37K?  josko, eh di maghanap ka nalang ng ibang katulong kahit ilan pa pwede!! kesa magbayad ka ng 37K..  dapat for me, i-tanggal nila yan, para mas maenganyo yugn mga tao na magregister sa sss.

at the end of the day, this is still a law, whether you like it or not, you have to abide by the law.

first of all, i'm sorry if I offended you and got you all riled up!!  but kasi i find it some kinda contradicting na you say its garbage YET you have been abiding by it even before it became a law..

The SSS Philhealth and Pagibig you will only have to pay after a month of service rendered right (section 9)? I have a new hire (less than 2 weeks only) and kulang kulang her requirements. She has NBI and police clearance but both are expired. Hindi ko alam if hahabulin ko the deadline or I'll delay it for next month.

^Sis, she can still get naman an SSS number kahit kulang kulang papeles.  Yun lang, yung benefits niya, di niya makukuha until she gives the birth certificate or baptismal certificate.

retroactive pala ang kasambahay bill!

is it my fault now that when i hired our yaya/helper a year ago she told me that she doesn't want to avail of sss, philhealth when i asked her? tapos i have to pay the penalties! *sigh*

i'm all for the kasambahays rights and benefits but i agree with most of the feedbacks here that the law isn't fair and wasn't thought of thoroughly by our lawmakers!

kawawa naman tayong mga working class, tsk tsk tsk!

haha. natatawa naman ako. para namang sinasabing im making up stories. yung mga nilahad ko eh info from my yaya of 3 years. sabi nya nga ang private school duon sa kanila eh 500 a year. ang kuryente nila 80 pesos.

Pangalawa, yung pagkakasakit ng yaya, oo pwede mo hindi sagutin yun kung masama kang amo or kung marami kang options na mag alaga sa anak mo. Pero i know a lot of people who shoulder the medical expenses of their helper because they care and because it's so hard to find good help nowadays. Again, madali sabihin na wag bayaran if youre not in a situation na kailangang kailangan mo ng household help.

pangatlo, yung pamasahe nila, oo pwede mo din bayaran yun. pero based from experience ko at sa experience ng marami nating sis dito. often that not, hindi na babalik ang help unless padalhan mo ng pamasahe.

Pang apat, yung advance nila.. sa hirap maghanap ng yaya ngayon pag di mo pinag advance yan bukas makalawa malamang wala na yan sayo.

Haha yun lang. respect naman sa kanya kanyang opinion, di pwedeng sabihing hindi totoo dahil may basis naman ang sinasabi ng sisters natin dito. Hindi ko lang kasi talaga matangap na lagi nalang middle class ang talo sa government na to. :) Peace ulit.

if I may add, kapag di mo pinautang yan kahit 1 beses, makakatulog ka ba ng mahimbing sa gabi, or makakapagtrabaho ka ba ng maayos, considering na pwedeng iniisip nya eh gawan ka ng masama or gantihan ka kasi di mo sya pinautang, di mo alam iniisip ng mga yan. kapag di mo pinagbigyan, most of the time, they will take it against you, feeling api.

@sis can_dice, i think ang sinasabi ni sis Project60 eh based sa experience nya and not based on the KB.

@Sis Project60 nagkamali lang siguro sis can_dice ng pagkaintindi sa sinabi mo kasi yung reply nya refers to the KB.

Basta para sa akin hindi lahat ng amo can afford these added benefits for the kasambahays kahit gustuhin nila. Hindi sa nagmamaramot or nagkukuripot, pero may iba talaga swerte lang that they have extra money to spare or kaya pang isingit sa budget or what. Pero may iba naman like single moms, or couples na enough lang ang kinikita at minsan kapos pa para sa expenses ng pamilya plus nagsusustento pa sa mga parents nila na matatanda na at walang income or pensyon. That's the reality. Hindi lahat can afford. Marami nga no choice lang kaya kumukuha ng hh. Yun nga lang, the sad truth is batas na to at kailangan din sundin. So parang lumalabas eh kung di natin kaya magbayad ng benefits na yan eh wala tayong K kumuha ng hh kahit kailangang kailangan natin? Honestly ako up to now undecided pa ko. Kasi humingi nga ng 1k increase yung maid namin, so 4k na salary nya. Take note: Sya ang humingi. Binigay namin yun, pinilit ko ng pagkasyahin budget namin dun dahil kailangan nya ng pera para sa mga anak nya kahit 4 months pa lang sya sa amin. So now with this bill, hindi ko na alam san pa ko kukuha ng another 600 for her benefits. Additional 1,600 per month yun all in all kung sakali and that's big. San namin huhugutin yung 1,600 di ba? Mula nga nung binigay namin increase nya araw araw gulay ulam namin para lang mapagkasya budget no.

First of all - I'm not saying na gawa gawa mo lang ang mga ito.

What I am saying is BASED SA KASAMBAHAY LAW - walang mga ganyang details.
You are taking it out of context yung mga sinabi ko.  I've read the KASAMBAHAY LAW over and over again to understand the details and WALANG sinasabing KAILANGAN mo gawin or bigyan yung mga iyon.  Discretion yan ng mga amo.  So if you do this and that, its a RISK that you have to take.  And with that risk you took - its not fair to blame that law kung wala naman nakasaad sa law DAPAT mong gawin iyon.. 

Lahat ng mga sinabi mo is DISCRETION ng employer.  Its not MANDATORY according to the law.  If kayo, ganyan ang ginagawa niyo - wag niyong sisihin sa law na madaya or not.

Ang mga pagkakasakit ng kasambahay, i think we should shoulder BUT WITH LIMITATIONS.  I mean, yung panganganak?  Taking advantage na ata yun!  Kelangan mo i-weigh kung worth it ba or hindi eh.  Kasi in the end, kayo rin ang magsusuffer diba? 

Regarding advances - ako, personally - hindi nagvavale or nagaadvance mga katulong ko.  Kasi umpisa palang, sinasabi ko ng hindi ako nagpapa-advance.  Kung kayo nag-papa-advance at nasanay ang mga katulong niyo - then decision niyo yun.  Simple lang naman, lahat ng kilos or gawa may RISK and may consequence. 

I think hindi tayo nag-kakaintindihan - ako kasi, based sa Kasambahay Law, ikaw based sa experience.  If sa experience, then tama ka nga.. Maraming ganyang nangyayari.  I can't argue with you since based pala sa personal experience..  Sorry sorry..  :-*

You can agree with your yaya na bagong pasok lang siya para you don't need to shoulder the penalties.  Ang problem mo lang diyan is IF yaya makes you sumbong.. so you really have to agree on this.  as in solidly agree...

Totoo yan na maguiguilty ka.  I guess I'm very lucky na my helpers, never asked from me.  Kasi umpisa palang i tell them straight na walang advance or vale.  the best thing I can do is to give your salary every 2 weeks and that's it.

I guess I've learned from friends and relatives na nagpapa-advance ng sweldo na hindi nababayaran.  Mahirap eh.  Kasi walang assurance na pag nag-day off sila, babalik pa sila.  So to protect myself, I had to do those things.  I had to set boundaries.  And I'm happy to tell you that these boundaries have worked.  It's just all about getting the info on the table and practicing it.  Totoong mahirap, nakakaguilty talaga but thing of it this way, you are protecting yourself din from future problems.

I had a yaya who stayed with me for 4 months lang.  Ang reason niya for leaving is that hindi ako nag-papa-advance.  Ok lang, wala naman sa akin yun e.  I learned from my other yaya na she went back to her old employer, because that old employer paid for her pamasahe sa bakasyon niya.  Alam niyo ba what happened?  Well, this yaya never came back to work for her old employer.  Wala, naging thank you nalang yung pamasahe.  Nakakapikon diba?  kasi nanloko pa ng tao para lang makapag-bakasyon.

Sis Sonia62 - wow!  ang lakas naman ng loob to ask for a 1K increase??  what gave her the idea na pwede yon?  grabe!!  nashock ako ha!!  WOW!

Sis Project60 - peace na tayo ha.. hahaha!!  i based my opinion on the law itself kasi.. at least naliwanagan tayo ni sis sonia62...

Ako I never really give bales or advances. My maids know that too and I explain my reason why. I want them to learn how to manage their own money like the way I manage ours. My belief is kahit malaki ang suwledo mo o maliit pero di ka marunong mag handle laging kang kukulangin. I think it works. i have a yaya who is a single mom and yet she was able to buy already a lot for her in the province. nag umpisa lang yan sa pagbili nya ng isang baboy. i dont want to give them the impression na basta basta they can ask. Kasi if you give them that option hindi sila magiging masinop sa pera. they dont they take that against me nor on my kids. I think I allowed it once when my yaya's daughter in law had to do emergency CS and they were short. Hindi talaga siya loan but more of advanced her suweldo 10 days earlier. I agree discretion talaga ng amo whether to give or not.

it's not more on "guilty" effect, more on "fear" effect ang akin. yung tipong pag di mo pinabale, baka lagyan ng kung ano yung food or gumawa ng kalokohan sa amin.

Ahh, but ako kasi, I don't like thinking of the negative things they will do to me and my household.  Magwoworry lang ako all the time.  Bahala na ang Lord sa kanila..

But that does happen in reality.  Risk nga talaga siya.

Halos lahat naman tayo may kanya kanyang reaction or issues sa bill na ito dahil syempre iba iba tayo ng mga sitwasyon na kinalalagyan. kaso syempre at the end of the day eh batas na ito so whether we like it or not, sooner or later eh kailangan natin sumunod. Dalawa lang naman pagpipilian natin talaga, sundin o wag sundin. If we choose the latter, we should be ready to face the consequences in the future just in case something happens or what. Kakalungkot lang na maraming malabo sa batas na to like nga sa mga labandera. I read from a blog na yung blogger hires a labandera once a week. Eh kasali labandera sa KB, so she asked her labandera kung ilan ang pinaglalaba nya. Sabi lima ang pinapasukan nya a week. So ano yun? Lima ang magreregister na employer nya at lima ang magbabayad ng sss nya? According naman sa SSS, pag labandera eh voluntary member lang yun. kaso sino pa rin sa mga pinaglalabada nya ang magshoshoulder ng SSS nya? Sana lang maiayos nila ang sistema kasi masyado ngang minadali ang bill na to. At ultimo mga govt offices like sss, etc eh iba iba sagot at nalilito.

^^ of course, di pwedeng di ako mag-isip that she'll take it against me lalo na kung hindi ko pinautang, at kung talagang kailangang kailangan nila ng pera. you never know how these people think. at syempre having that in my mind, kailangan ko maging alerto sa mga ginagawa nya sa paligid ko, hindi ako pwedeng tumunganga lang at ipagpasa-Diyos na lang kung nakikita kong nilalagyan nya ng lason ang pagkain namin or kung nakikita kong naninira sya ng gamit sa bahay.

@tinapay - yes iba ang form ng maid na magmemeber at iba ang form ng amo na kukuha ng employer number/..

thanks sis. i just read your blog pala. pano ka magkakaron ng sss household employer number? di ba sabay-sabay i-submit yung R1, R1-A and E-1?

May mga nakapagparegister na ba ng kasambahay sa barangay? Ano ba dapat unang gawin? Iregister sa barangay O sa SSS, Philhealth at Pagibig?

naguguluhan din ako kung ano ba dapat ang unahin.  pero i think yung contract muna.  tutal naman the benefits will apply pag naka-1 month na sila.  pero same question again, pano ba i-register sa barangay?

^sa pagkaintindi ko sis you have to submit a copy of the contract sa barangay. Bale dapat 3 copies ata yung contract, 1 copy sa barangay, 1 copy sa employer, 1 copy sa hh. Pabackread sis may nagpost ng link ng IRR kasama dun yung employment contract

^thanks sis. got it. na-print ko na rin.  pwede naman sigurong magdagdag ng extra sheet di ba para sa specific duties and responsibilities na dapat na gagawin ng kasambahay?  i'd like to be specific sana like, how many times in a week dapat mag laba, mag floor wax, etc.
