@zieaja, mas less complicated lang yung process kasi wala kayong paghahatiang properties at wala kayong isesettle na custody/child support. We are in similar situation--no kids, no properties (actually hindi ko na hinabol). One more hearing na lang ako.

mga sis.. question lang ha.. for second trial na yung annulment ko, magbibigay daw ng testimony yung psychologist..kaso ang tagal before ma-set yung hearing..sabi ng attorney, inventory daw yung court nung january kaya wala daw hearings pwedeng i-set..

tapos nung february naman, natapos na daw yung inventory but may hinihintay lang daw na requirement from the fiscal tapos tsaka pa makaka-set ng hearing date..

i just wanna confirm kung nasa tama ba 'yung process at hindi nagdadahilan lang si attorney? i'm lost kasi and i'm worried din... matagal ba talaga mag-set ng hearing? wala akong updates from her ngayong month eh..

Yes, usually January and July ang inventory months ng courts. Sinabi din sa akin ng lawyer ko yan (and I have a good lawyer, ah) nung nagsisimula pa lang kami.

Question. Hindi ka ba binigyan ng court ng schedules for the hearings? Yung experience ko kasi, sinet in advance yung mga hearing dates, eh. At hindi fiscal yung nagsset ng hearings. Dapat yung judge. Umaattend ka ba ng hearings?

Thank u sa response sis.  :) walang schedule na binigay sa'kin, natagalan din kami mag-set nung first hearing dahil wala ako sa Pinas kaya hinintay muna na ma-approve yung requested ko na vacation tsaka na-set yung pre-trial at first trial. Sabi tapos sa'kin na hindi na raw ako required umattend ng last hearing kasi psychologist na lang daw. Mahirap din akong makapag-leave.

Kaso 'yun nga, angtagal ma-set, sis. I was getting worried kasi lagpas 3 months na yung pagitan. But I guess hahabaan ko na lang muna 'yung patience ko. Last hearing na rin naman daw. *kaka-stress*  :-\

Ilang months 'yung pagitan ng mga hearings mo, sis, according to your schedule?

my friend who has been estranged from his wife wants to file an annulment na.  considered adult na rin naman yong anak nila.  i think its closing to 10 yrs na na di sila nagsasama and the 'wife' already told the guy na she is ok na to be separated from her.  ang issue nga lang, she insist na yong barkada ko ang mag-file.  iiniisip pa niya ano pwede niya gawing grounds for annulment.  medyo matagalang process din kasi ang annulment cases sa atin.  yong isang friend ko nga 3 years ago pa ata siya nagfile, la pa ko balita kung ano na.

3 hearings ako. Tapos na ako sa two hearings. Every month yung sked ko so next month na yung last hearing ko.

And another question. Kind of stupid. Diba if you were previously married and annulled, di na pwedeng magpakasal sa church, unless ma annul din yung church wedding? What if yung first wedding ay civil lang? Pag na annul yung civil wedding na yun, pwede sya magpakasal sa church?

^ambilis ng process mo sis, kung every month ang hearing mo. You have a good lawyer! Can you share your timeline? From filing ha. Kahit yung months lang. E.g. case filed in RTC. After 2 months, pre trial (or whatever comes next)

Meron akong friend who's going through this tedious process, and mababaliw na sya sa paghihintay. Malala yung sa kanya, nasa 5-6 months ata ang pagitan between the hearings. Tapos na resked pa tong 2nd hearing nya! tapos yung reset date eh 2 months later. We were thinking baka tinatamad na din yung lawyer nya, fully paid na kasi sya eh. Kaya I was asking for a timeline, para masabi ko sa kanya. Tingin ko talagang pinapabayaan na sya ng lawyer nya eh.

In my case gurl, pre-trial, trial (my testimony), then 2nd trial (witness' testimony).. bale yung psychologist ang magiging witness mo to prove the psychological incapacity, kung yan yung ground mo.. and yes, hindi din nag-contest si ex.. after this, wait na kayo for the decision, after decision wait ulit ng ilang days kung hindi kokontra ang OSG, then pag nakuha mo na yung finality, start na sa pag-update ng records sa LCR then NSO.. I'm interested din to know sis rochelle's timeline dahil magaling and matino yung attorney niya..para ma-compare natin yung ideal vs shady na process...

Sa akin naman, civil wedding din kami ni ex and I'm getting a civil annulment. I'm not sure about church annulment although I know na required yan ng Catholic church if you wanna get married again. Madami kasing arguments about this if you try reading online so I guess, the best way to find out is to ask your church.  ;)

Timeline ko is this:
April-May 2013: Interviewed several lawyers
May 2013: Chose a lawyer na
June to Aug 2013: Psych evaluation, interviews with key witnesses
Aug 2013 - Dec 2013: Psych report preparation. Dapat one month lang ito pero ang tagal natapos nung psychologist yung report
December 2013: Filed the petition in court
December 2013: Inaccept ni exH yung invitation ng psychologist for interview/psych test.
January 2014: Psych evals/interview ni exH so kinailangang ulitin ni psychologist yung psych report.
March 2014: Submitted all the initial papers (psych report, etc)
May 2014: Collusion investigation
August 2014: Submitted all judicial affidavit
September 2014: Pre-trial
Feb 2015: First hearing (I'm the witness)
March 2015: Second hearing (2nd witness)
April 2015: Third hearing (final witness)

The judge said he will decide within 90 days. So fingers-crossed, by July 2015, may desisyon na at sana in my favor.

I was married in church so sinabay ko na yung pagfile ng civil at church annulment. Yung church ang mabagal, susmio. August 2014 ako nagsubmit ng petition at lahat ng supporting documents pero until now, wala pang movement.

Per the chancery, mahaba kasi yung pila ng annulment sa diocese namin and isa lang yung priest na may toka dun. They're trying to declog naman daw so sana daw within the year, mastart na yung interviews.

I have a good lawyer. I really spent time interviewing lawyers kasi critical sya, eh. Sa kanya nakasalalay yung future ko.

Nashare ko na ito before. I interviewed three lawyers--one from a law firm, a dad of a good friend, and a solo practitioner. I chose my lawyer because from the three, sya yung clearly interested sa case ko. First meeting pa lang namin, nakita ko agad na nakikinig sya sa mga kwento ko. He asked intelligent questions.

He also asked me agad for a written autobiography of what happened kasi gusto nya aralin kung may case nga ba ako. He did this without any payment, ah. Even yung first meeting namin, hindi sya nagpabayad. Nilibre ko lang sya ng lunch.

From there, he sent me a proposal detailing his services and fees. Sya mismo ang nagsabi sa akin na ayaw nya ng package. Naiintindihan nya yung situation ko as petitioner na mabigat yung maglalabas ka ng pera ng isang bagsakan. So he bills me when he needs to bill me.

My lawyer has always reiterated na we need to work together for the petition. Lahat ng documents namin, malinis. Pinagpaguran talaga namin iprepare. Walang hocus-pocus. Lahat maayos, lahat in order. Ang lagi nyang katwiran, hindi puwedeng magkabutas yung petition namin so we have to work hard in preparing all the necessary documents.

Thank you sa timeline, sis.  :) You've been very helpful. It pays to be very careful talaga sa pagpili ng attorney.

Sa akin naman, I guess, I'll just have to deal with this waiting game going on with my attorney. Mahirap din kasi kapag wala sa bansa to make sure na they're doing their jobs. I hope hindi lang toh naghihintay ng under the table para kumilos.  :o

Anyway, I'm happy for you talaga sis. Sana update mo rin kami pag may timeline ka sa decision and updating the NSO stuff. I'll pm you kapag dumating na rin ako sa stage na yan in the future. Magiging in your favor yang decision, sis, i-claim na natin  yan :) God bless.

Mas matagal ang process ng church annulment (specifically for Catholic) pero mas mura sya kesa sa civil annulment. No, hindi kailangang pumunta ng Rome. Ang local diocese ang magpprocess ng annulment. Halos same process sa civil na may mga witnesses din.

No, you don't need a church annulment kung hindi ka naman kinasal sa church. But you need both civil and church annulment if kinasal ka sa church.

^Thank you sis :) Goodluck on your annulment. Kaya pala yung iba sa civil na lang nagre-remarry, matagal pala talaga yung church annulment. Matagal na nga yung civil annulment kamusta naman kung mas matagal pa yung church. Pero that's a good thing na kahit sa church ipapa-annul mo sis.

I would like to seek your opinions and suggestions regarding my case:

I got married in 2005 because of unplanned pregnancy. Nagpakasal kami ni boyfriend kahit break na kami during that time (I broke up with him kasi lagi kaming nag aaway dahil sa pagiging active nya sa frat, mahilig bumarkada, uminom, at masyadong maharot sa mga babae). Ayaw ko rin kasi na mapahiya family ko especially si Papa kasi ako ang eldest sa magkakapatid at unang apo sa father side. Isa pa, wala pang history sa pamilya na nabuntis ng hindi kasal or walang asawa. I know it's stupid but itinuloy ang wedding. Sinagot ng family nya lahat ng expenses and ikinasal kami ng isang minister from a catholic organization. Sa Gerry's Grill pa nga ang kasal at reception ginawa. Nagwowork na ako during the course of my pregnancy and palagi pa rin kami nag aaway. Pinasasama nya loob ko lagi. And one time pa nga na tinatamad ako maligo, sinira nya damit ko as in pinunit nya para lang maligo ako. After giving birth, hindi pa rin sya nagbabago. Seaman sya and nakatira kami sa bahay ng mga magulang nya kasi ayaw nya na bumukod kami. To make the story short, hiniwalayan ko sya kasi nasa kanya na lahat, babae, alak, barkada, at nananakit sya. Gusto ko ng magpa annul pero pinag iipunan ko pa. I need your advice mga Sisses....san kaya magandang mag pa annul na malaki ang chance na ma-approve, and pwede ba yung non-appearance? Thanks in advance sa mga sasagot...

^Sigurado kang minister from a Catholic organization ang nagkasal sa inyo? Minister, as in hindi pari? And when you say Catholic organization, do you mean as in the Catholic church?

Sis, contrary to what you may read about the annulment process, there's no such thing as places na madaling magpa-annul or non-appearance. Backread ka sa thread na ito and other threads on Annulment here. Madaming nalokong Gtalkers dahil sa idea na "madaling magpa-annul sa ganitong city or area" and they lost a lot of money dahil dito.

You have to do your homework para pulido ang petition mo. Hindi ka puwedeng umasa lang sa package kuno ng lawyers. Kailangan mo mag-effort.

I suggest you backread para alam mo yung process.

Yung tanong ko about a Catholic minister officiating your wedding, icheck mo muna kung minister nga or pari ba yung nagkasal sa inyo. Priest lang ang puwede magkasal sa Catholic faith. Baka dun pa lang sa technicality na yun, enough na na ma-annul ang marriage mo.

Since i can't pm you yet. I will share my story here. I married my bf 13 years ago after living together for some years. i do believe in the sanctity of marriage and did everything to make it work. Ex came from a family who had multiple partners and so infidelity run in his system. He needs me (dependent) but he didn't love me. He never seemed to care when i am sick.  I've been very forgiving & been crying for months to years. But it wasn't enough till he started to show disrespect & humiliate me in front of his friends and neighbors and tell lies to everyone. That's when i decided to leave. We've been separated for a 5 years now.
I wanted to move on and start a new life and end any connection from him.

If anyone who can recommend a good lawyer here in manila or cebu please PM me. I really need your help.
