Mga sissy^ :) @sis snappy gal..naku mga 6 months pa daw pero depende sa judge daw(ulit?lol) bago lumabas yung decision ng papel ko ugh at tama ka sobra nakakastress maghintay :'( @ sis psyche29 tama ka sis hindi lang medyo matagal forever na yata ako maghintay  :'( thanks sa mga payo mo malaki tulong talaga.

@sis snappy gal imagine 6 months waiting decision pa lang?lol pero bumawi naman atty ko sabi nia finality 1 month lang (daw?)ang waiting naku hindi na ako maniwala sa sinasabi niya dumadami lang puti buhok ko sa kahihintay ng papel ko grrr lol..gudluck sa iyo sis snappy baka iba ang case mo mas mabilis  8)

sis mooi69, you're welcome. for me, kaya naman yun 1 month. pero alam mo naman dito sa atin, kailangan ng padulas ever step of the way. specially "uso" na ang annulment. parang naging bigasan na rin. dont worry masyado sis. malapit ka na sa last step. i suggest na if may plans ka like pag papakasal ulit, focus ka muna dun and make sure na lang na mag set ka siguro every week or 2 ng follow up. para hindi ka isip ng isip. its all worth it sabi ng hubby ko.

Dito ko pala dapat nipost yung problem ng friend ko. Sana may makasagot. Gulong gulo na kasi yung friend ko. Hindi ko naman alam kung ano ang maipapayo ko sa kanya dahil sa gulo ng sitwasyon nya.

Nakakuha ng proof ang friend ko na nagloko ang asawa nya years ago. Ang proof nya is hindi sila match ng dna nung anak nila. Pero sa birth certificate nung bata sya ang ipinalagay na ama. Sya din ang palaging sinisingil sa school tuition.

Kung gusto nya magsampa ng kaso, ang sabi sa batas kailangan yung babae at yung kalaguyo ang sampahan ng kaso. Kaya lang hindi nya naman alam kung sino ang ama nung bata. Enough na ba yun dna as proof? At masasampahan ba nya ng kaso yung asawa nya?

Nagfile rin ng annulment yung babae. On grounds of psychological incapacity. Once ma-approve yun ay hindi nya na rin maisasampa ang adultery case ayon sa mga nabasa ko. Maybe the reason why nagmamadali yung asawa nya na maannull sila.

Kung ipafile nya man ang adultery case ay gusto nya rin na magpaannull para maka move on na din sya. Hindi ba marerevoke yung annullment na sinampa nung babae dahil baka makontra ng adultery case na isasampa nya? Or will the annullment proceed on grounds of adultery?

Is it possible na makulong yung babae?

^^adultery is not a ground for annulment.

If ever na magfile ng adultery, i dont know if may impact sa annulment. Siguro gugulo lang. And pag na deny yun annulment, Baka mahirapan i-appeal.

I suggest to just file a case disputing yung responsibility sa bata kasi hindi sakanya.

Nakakaawa si friend. He is hoping he could get custody sana but it is already hard for a real father to get custody. How much more for him di ba?

The child is kawawa also. The reason he wants to get custody of the child is because of his exwife who seems to be lukaret, doesnt really care about the child and it appears that she's just trying to use the child to get back on him. She knows that he cares so much for the child.

Another choice is for him to just keep everything a secret so he can still see the child. But then maybe this is a way to really cut the ties na from his exwife. Start fresh and have a family of his own na tahimik.

He has not decided on what to do yet. Thank you sa mga reply. If you can add more suggestions that would be most appreciated.

hi po! ask ko lang kase yung asawa ko wanted to file for a legal separation I wonder why kung pwede namang annulment nalang? ano naman gagawin ko since siya naman daw magffile?


Based on your facts, collusion exists. That's one of the grounds for the dismissal of your legal separation case. Once the decree is granted, you two are still married. Legal separation simply means "separation from bed", and the parties remain married. It does not put an end to marriage. Even if it's granted already, condonation can revive you relationship as husband and wife.

It depends. There are so many grounds for the dismissal of your annulment case. 

These are the grounds for annulment and the defenses (grounds for dismissal)

1. Lack of parental consent. You were 18yo but below 21yo at the time of marriage, but there was no parental consent, your marriage may be annulled on that ground. However, if upon reaching the age of 21, you freely cohabited with your husband and both lived together as husband and wife, the case will be dismissed.

2. Insanity. I at the time of marriage, either party was of unsound mind (insane), the marriage may be annulled. But if the defense was able to prove that such insane party after coming to reason, freely cohabited with the other as husband and wife, the annulment case will be dismissed.

3. Fraud. The consent of either party in the marriage was obtained by fraud. What is FRAUD?
It includes:
a.) non-disclosure of a previous conviction by final judgment of the other party of a crime involving moral turpitude;
(b.) concealment by the wife of the fact that at the time of the marriage, she was pregnant by a man other than her husband;
(c.) concealment of sexually transmissible disease or STD, regardless of its nature, existing at the time of the marriage; or
(d.) concealment of drug addiction, habitual alcoholism or homosexuality or lesbianism existing at the time of the marriage.

However, no other misrepresentation or deceit as to character, health, rank, fortune or chastity shall constitute such fraud as will give grounds for action for the annulment of marriage.

This is now the ground for DISMISSAL of your annulment case ---> If such party (ikaw na naloko), with full knowledge of the facts constituting the fraud, freely cohabited with the other as husband and wife.

4. Force, intimidation or undue influence. If the consent of either party in the marriage was obtained by any of these means (i.e., pinikot, pinwersa, tinakot, etc. para pakasalan sya), the marriage may be annuled.

Ground for dismissal? In cases where the force, intimidation or undue influence having disappeared or ceased, the complaining party thereafter freely cohabited with the other as husband and wife.

5. Impotence. At the time of marriage, either party was physically incapable of consummating the marriage with the other, and such incapacity continues and appears to be incurable.  It must appear to be INCURABLE, otherwise, the annulment case will be dismissed.
Take note, impotence is different from being infertile.

6. STD. If, at the time of marriage, either party was afflicted with a sexually-transmissible disease found to be serious and appears to be incurable. Take note, it must be SERIOUS and appears to be INCURABLE, otherwise, the case will be dismissed.

What if you are married already and you were afflicted with STD by your husband like "tulo" only, and it's curable? It is NOT a ground for annulment. The law says it must appear to be incurable.

If the STD is not serious or is curable, it may still constitute fraud. See no. 3 above. (Your consent was obtained by fraud).

mga sis,

it's been 2 years since I filed my petition pero na-stop daw 'yung proceedings dahil ngkasakit ang judge and he's in a critical condition..nasa part kami where the psychologist has to give her testimony daw..i have already fully paid the annulment package na 180k and also gave extra 70k to the judge para non-appearance(dahil wala ako sa pinas ngayon)..but now, my atty cannot tell for sure if makakabalik pa daw yun to work..

ano kaya possible options ko? if i re-file the case, gagastos po ba ako ulit ng another 200k+? if i continue waiting, matatagalan pa ba before mgkakaroon ng bagong judge, if talagang sick ang naunang judge? pasensya na if andami kong tanong..this is really just stressing me out na.. :'(

Hi all!

Share ko lang my ex was the one who filed it. 50k lang daw. Im not sure if it's true. Sa Laguna na file yung annulment and it was filed January 2011. May decision na January 2013. I spent around 10,000 para makakuha ng annotated Marriage Certificate. :)

^ sis, how did you process the annotation kung may decision and finality na?  kasi in my case lahat lawyer ko nag asikaso. sa friend ko, she is being asked another fee to process it, puede ba sya nalang daw magprocess?

^^ sis blue_sky, why are you stressed out?  Isn't it expected to take forever? Ako kasi when I filed the annulment, I expected it to be 10 years or so. So nung lumabas yung decision, parang masaya pako hehe

I don't think any atty can tell for sure kung lalabas agad maliban nalang kung sya yung in control sa buong court.  Obviously, hindi sya, so have to wait parin sa judge.  I think nangyari ito sakin before, nagpalit ng judge, kaya natagalan, back to square one. But my lawyer did not ask me for another payment, same payment parin naman, nadagdagan lang ata ng konti, cannot remember na.

^ Sis, nung nakuha ko na yung decision, nagpunta ako ng Laguna tapos parang sinabi doon na kailangan matatakan yun ng ibat ibang offices doon (decision and finality) tapos it is going to cost me around P100+ for the tatak pero kasi syempre we need a lot of copies. They usually give 10 copies of each (decision and finality). Eh malayo - Laguna pa eh taga QC ako nun so the clerk offered na siya na bahala mag pa xerox, sign and notarized then ipapadala niya sa akin. It cost me around 3-4k yata. Nagpadala na lang ako ng pera via LBC and pinadala din niya sa akin via LBC. When I received the documents, I went to San Juan City Hall of Justice and nagbayad na naman ako doon ng around 3,000 to process. Then pinapunta na ako ng NSO.

I see. Sis, I guess sa San Juan kayo kinasal? Siguro nga depende nalang san city kayo kinasal for you to get the annotation.

So parang lumabas ikaw pa ang nagpunta sa NSO, at hindi yung San Juan na ang bahala mag inform sa NSO.

sis^ yes sa sj kami kinasal. pero nagpnta na lang ako sa nso to pick it up. nagulat nga ako akala ko mahirap pa. SAn juan na nagsabi sa nso and pagpnta ko sa nso okay na ang lahat. :)

Hi mga sis,

May alam ba kayo who can help me na makuha ko yung certificate of finality ko?  Lumabas na yung decision and approved yung annulment case ko.  Nung June 2014 pa yun and until now di ko pa nakukuha ang certificate para ma-update din ang NSO records ko. 

Tinatawagan and text ko yung lawyer ko since December 2014 and hindi nagrereply.  Frustrating talaga.  :(  I'm willing to pay kung may kilala kayo.  I hope someone can help me.  Wala kasi ako sa Phils kaya hirap din ako magfollow up. Thanks
