Yes, sis  mooi69, tapos na ako sa presentation ng mga witnesses ko wala na rin sagot si Fiscal. Formal offer of exhibit is the same thing with Memorandum ata. Sa mga naka experience na ng ganitong steps, gaano pa kaya katagal ito, and what to expect on Dec 12. Ang start ba ng 30-90+ days waiting period ng Desicion is on Dec 12 pa?

Sana nga matapos na ang tagal ko na dito sa pilipinas kakahintay na maging single ulit lol! :(

Normally, psychological incapacity ang ground...kailangan ma proved mo na existing na yung ugali or may manifestations na before the marriage pa.

@sis mooi69, mali ako, I think mauuna ka sa akin, kasi Sept 16 start na ng waiting period mo for decision. Mine is on Dec 12 pa :(...gluck pa rin sa atin!

And sisses, like what sis rochelle1025 said, medyo mainit ang annulmet cases sa osg. Dyan kami pinaka kinabahan. Specially pag napagkasunduan nyo mag ex. Kaya God bless and pray po. Masarap ang feeling malagpasan ganitong klaseng problem. Specially with what existing process our country have.

The following the marriages which are void ab initio (void from the beginning) hence, kailangan ng petition for the declaration of nullity of marriage:
1. Absence of any of the essential or formal requisites of marriage;
2. Contracted by any party below 18 years of age even with the consent of parents or guardians;
3. Solemnized without License, except those marriages that are exempt from the license requirement;
4. Solemnized by any person not Authorized to perform marriages unless such marriages were contracted with either or both parties believing in good faith that the solemnizing officer had the legal authority to do so;
5. Contracted through Mistake of one of the contracting party as to the identity of the other;
6. Bigamous or polygamous marriages;
7. Subsequent marriages that are void under Art. 53 FC;
8. Marriages contracted by any party, who at the time of the celebration of the marriage, was Psychologically incapacitated;
9. Incentuous Marriages (Art. 37, FC)
10. Marriages declared void because they are contrary to P ublic policy (Art. 38, FC).

The following naman are voidable marriages (valid until annulled). Hence, a petition for annulment of marriage is needed:
1. Marriage of a party 18 years of age or over but below 21 solemnized without the consent of the parents, guardian or person having substitute parental authority over the party, in that order
2.Either party was of unsound mind
3.Consent of either party was obtained by fraud
4. Vices of consent such as force, intimidation or undue influence
5.Impotence and STD

Sis snappy^,galing ako sa court kahapon (sept.16)desisyon na lang wait ko but need pa magsend ng letter from court sa ex ko so wait pa ng 15 days nagsubmit ulit ako ng mga documents sa court before ng sept.16 for verification.and after ng 15 days magsubmit atty ko ng letter like summarize ng case ko from the beginning(filing,trials,psychiatrist etc etc)yun ang sabi ng atty ko and pag wala apela korte after niyan makuha ko na yung finality by december(sana lol)

Gudluck din sa iyo sis snappy ano ba ang 3 buwan ng paghihintay di ba lol ugh :( ;) ang lahat naman may katapusan..

Hi sis, malapit na. Yung pinapa-submit sa lawyer mo ang tawag dun Formal offer of exhibit. Yun lahat ng evidence na na-marked nun lahat ng trials mo, su-submit para maging official evidence.Pagka submit nya, sasagot naman ang fiscal kung okay na sa kanya or hindi, another 15 days yun. Then for decision ka na. Nasa same stage tayo, kasi yun sa akin pina submit na rin but yun sa akin nag additional setting para bigyan pagkakataon yun other party kung hahabol kaya humaba pa. Saan ba location mo, if you don't mind?  :)

hey sis,formal offer nga tapos resolution na lol :) serious ngayon naman na malapit na lumabas yung desisyon ko parang ayoko na umalis ng pinas ulit  :( malungkot na iiwan ko na naman mga anak ko but have to..hays magdrama daw ba dito :)

hi sis  mooi69, sa may Libis quezon city ako. Malapit ka na talaga kasi tumatakbo na yun waiting period mo for decision. Yun finality mo after pa yun ng decision and then wait ng 15 days sa Solgen kung approve nila then final na. Nakakaba talaga knowing ang dami na natin na invest na time at money  ::)

Process in Annotating a Decision of Nullity of Marriage    
Receiving a Decision stating that the marriage is null and void will not entitle the party to marry again right away. There are legal and administrative procedure to be undertaken  for one to remarry. Nowadays, it is required that a Certificate of No Marriage or CENOMAR from the National Statistics Office be presented to the local civil registrar before a marriage license can be issued.

 

Before one can get a CENOMAR, the decision of nullity of marriage has to be annotated in the National Statistics Office (NSO).

 

Once the Decision of nullity of marriage is received, the opponent/adverse counsel is given fifteen (15) days to file an appeal of the said Decision. If there is no adverse counsel or opponent, the fifteen (15) days to appeal is counted from the time the Decision is received by the Office of the Solicitor General.

 

The court will send a copy of the Decision to the Office of the Solicitor General with a return receipt. Once the copy of the Decision is received by the Office of the Solicitor General, it will sign the return receipt and it will be mailed back to the Court which rendered the Decision. The Clerk of Court will start counting the fifteen (15) days from the time the Office of the Solicitor General received the copy of the decision as shown in the Return Receipt. Because of this, it will take about three months before the Clerk of Court can issue a Certificate of Finality.

 

The Certificate of Finality together with the certified true copies of the Decision of Nullity shall be given to the Local Civil Registrar, which will take about 2-3 days for them to issue an Indorsement to the National Statistics Office. To facilitate the proceedings, our law office will usually do the mailing  of the documents with the money order (filing fees) through LBC or any one day commercial courier.

 

Based on our experience, the National Statistics Office will send us a copy of the annotated Marriage Certificate about one month to  two months after.

 

Summary:

 

1. Secure a Certificate of Finality of Decision – 15 days after receipt by the Office of the Solicitor General (but if no personal delivery and done through the post office, it would take about 3 months)

2. Getting the Indorsement from the Local Civil Registrar – 2-3 days after

3. Mailing to the National Statistics Office – one day

4. Getting the Annotated Marriage Certificate from the National Statistics Office – about one month to two months (if it is more than this, then there is a problem which you should call the National Statistics Office)

^sis, medyo matagal yan. based on our experience, yun sa hubby ko, dated ang decision ng November, March pa ni-release from solgen papuntang NSO. nakuha namin Marriage Cert nya w/ annotation na NSO certified July. Dont know kung may mas mabilis na way.

pa note, CENOMAR will indicate na previously married but with annotation na annulled. when we filed for marriage license, we were requested copy ng marriage cert nya with annulment annotation together with the finality papers.

The two psychologists which we refer to our clients were charging 20k. 10k initial, 10k pagkuha ng report.  There is another one who is charging 30k naman.

@pancake4s7 , sorry I can't reply sa private message mo. I think it has somnething to do sa pareho tayong newbie :). Anyways, regarding lawyer. I have to be honest sa iyo, at some point pinasakit ng lawyer ko ang ulo ko, nasobrahan ako stress kasi it seems hindi nya inaasikaso talaga ang case ko. Tiis na lang ako kasi patapos na. Better, kung may makukuha ka lawyer na kilala talaga ng pamilya mo. Yung mahihiya sya kung mag pro procastinate siya sa responsibility nya sa case mo. Mag-ingat ka rin madami lawyers sa simula ang ganda makipag usap, tapos pag gitna na at ipit ka na, saka lalabas katamaran nila.
