I'm not sure how he got married pero baka nag file po sya ng divorce bago kinasal or nagpakasal na lang sya ayoko naman tanungin baka sabihin nanggugulo ako eh ayoko po sanang ng ganun.


If nag file po ba sya ng divorce can I ask a copy of it and yung po ang fifile ko for Recognition of Foreign Divorce ?

kung hinde naman po sya nag file pwede ko po ba sya sabihan na magfile sya and send me a copy po at yun ang i fifile ko?

if yes how much po a lawyer fee / filling fee po for Recognition of Foreign Divorce?

kung hinde naman po pwede ito na option can you please kindly advice me my best option?

Hi jojo2978, thanks for your pm.. sorry I can't reply to your pm.  Can I have your email id if you don't mind. Coz I am currently searching for a good lawyer. Meron kasi nagsasabi na depende daw sa diskarte ng lawyer and city of filing of petition. My friend referred to me one lawyer her cost is P150k including the Psychological exam but I don't have background whether she's experienced lawyer on family law. So I  made my research and had found another lawyer whose forte is family law their cost is P200k + the psych exam and have 100% success rate. Now I'm confused which lawyer shall I take.

Sis, the usual documentary evidence presented for declaration of nullity on the ground of bigamy are: 1. The 2 marriage certs; 2. Cert of non-death ng first spouse; and 3. Advisory on marriages ng spouse na 2x married. All the docs are from the nso. The nso rep may be subpoenaed to produce and testify on the docs.

I have an ongoing annulment and hopefully will get the decree this year(crossing the finger).

Share ko lang yun step by step na experience ko from the beginning.. filing an annulment is no fun and need lots of patience and understanding otherwise you get crazy on thinkin when it will be over and move on..and no annulment is fly by night it all depends in court that handle your case..what you need here is patience..patience..patience grrrrr

I get the 220k package deal..120 for downpayment(psychiatrist,filing etc etc)
3 sessions with psychiatrist (me and 3 witnesses)
after almost 3 months got the psychiatric evaluation(ugh)
dec.2012 filing in court
may2013 pre-trial (sabi ni fiscal dapat daw tayo na nagfile ng annulment magbilang sa first hearing hindi yun sa filing pra daw di tayo mainip..)
july 2013 trial (2nd payment 50k)
i myself testify in court and 2 witnesses and 2 hearing resets(judge not available and need to wait for my psychiatrist availability ugh)
hearing set every 3-4 months but it case to case basis some takes longer.( mine 4 court hearings)
june 3,2014 last witness my psychiatrist (done trial in court.. exhausted waiting taught she couldnt make it to testify)
I see to it na maka attend ako sa court hearing kahit hindi kailangan ng presence ko.
Sept.16,2014 sa korte ako ulit sabi atty khit di na ako pumunta but will go pra alam ko development ng kaso ko..

Possible ba na magkaiba ang sinasabi ng RTC at attorney? In my case, sabi ng attorney ko may court decision na yung case ko pero nung tinawagan namin ang rtc sabi ay waiting for decision pa daw?

Also, pano po ba namin malalaman kung na pinadalan na ng copy yung ex ko at solgen dahil need pa daw mag wait ng 15 days for this bago magka entry of judgment. Please enlighten me.. TIA

^sis, ask mo copy ng decision from the court as proof na may decision na. I have a copy ng decision ng case ko.

Yung sinasabi nyang 15 days, yun yung waiting time para ma-receive ng SolGen, lcr and ex mo yung decision ng court. After ma-receive, dun lang pwede mabigay yung certificate of finality. Yan ang pagkakaalam ko.

bubbles_sandy hi sis! dont hesitate or matakot na magfile ng annulment basta alam mo tama ang ginagawa mo go for it.sa case ko pinagbasihan lang yung psychiatric evaluation ko about sa pagsasama namin from the start kung naging maayos ba or hindi.about sa evidence yung sinulat ng 2 anak ko na kuwento ng naging buhay nila sa piling ng ama na ginawa ebidensya sa korte at yung pagtaguyod ko sa mga anak ko na solo financially sa simula pa lang.at hindi tanggap sa korte na rason na kasi babaero asawa mo likewise na lalakero yung babae kasi tao lang tayo nagkakasala.

Thank you sis snow25 karereceive lang namin ng copy ng court decision pero from atty and not from the court, yung copy ba na to talagang walang seal or kahit anong tatak? Kasi pirma lang ng judge at every page yung nakita namin, ganito din ba sa inyo?

@prettyJD, there's no such thing as expert in annulment cases. They probably specialize in annulment cases (meaning family court) but no such thing as expert. Para na ding sinabi na lahat ng cases nila, naipanalo nila.

Your case will be denied if you and your lawyer do not do your homework. Meaning, sloppy yung documentations nyo at hindi ninyo sinusunod yung mga kailangan. My lawyer always tells me na maging masinop when preparing documents because dun pa din magbbase ng decision. No decent judge would grant an annulment kung problematic yung documentation/petition nyo dahil sya din ang babalikan ng solicitor general.

@nodame, consult a lawyer. Please don't rely on our opinions here because hindi naman kami lawyers. Or kung may lawyers man dito, it's hard to make a conclusion based on just a single post. You can also do your own research. Read legal websites on annulments.

Sis snappy gal^ So tapos ka na sa trials mo?Yung sa akin si fiscal (prosecutor) na ang mag stand sa court pero what i have heard kay judge after ng psychiatrist ko magtestify for memoranda distribution na    will see kung ano mangyari sa 16 september.Serious i have no idea talaga at kung ano talaga ang sunod na step if hindi mo napagdaanan at mahirap magbigay ng comment or advice kung hindi mo na experienced lahat.Ang dami ko check na websites at articles about sa annulment grabe nakaka stress talaga kung ano ang susunod na step tiyaga lang talaga at maraming pasensya na maghintay.

Yes, sis  mooi69, tapos na ako sa presentation ng mga witnesses ko wala na rin sagot si Fiscal. Formal offer of exhibit is the same thing with Memorandum ata. Sa mga naka experience na ng ganitong steps, gaano pa kaya katagal ito, and what to expect on Dec 12. Ang start ba ng 30-90+ days waiting period ng Desicion is on Dec 12 pa?

Sis snappy,nakakapagod talaga maghintay minsan iniisip ko bakit ba ako nasa ganito sitwasyon kaya lang kailangan.Ask ko lang kelan ka huli nag hearing?kasi sabi mo sa dec.12 korte ka ulit and after that decision na?sabi kasi atty ko sa akin sept.16 si fiscal at pagkatapos wait na ako ng decision kaya lang hindi masabi kung ilang buwan ang hintayin depende pa rin daw  sa korte lahat.Kaya nga kahit hindi ako need sa 16 punta talaga ako gusto ko ako mismo makarinig kung ano at kelan ang sunod na step.

@ Sis mooi69, August 22 yun last hearing ko. Talagang every 2-3 months hearing, kung minalas ka pa more than pa ang waiting period sa last hearing. Yun next hearing para hintayin yun kabilang side kung gusto pa humabol. Pero nun last hearing ko binigyan ng judge ng 15 days yun lawyer ko para mag-submit ng Memoranda. Siguro yun next hearing ko for closure na then start na waiting period ko sa decision. Sis, tama yun pumunta ka sa hearing kahit hindi ka kasali based sa experience ko. Para alam ng lawyer mo on top . Goodluck sa iyo sa 16!

I stand corrrected. So what did your friend's lawyer say? Alam ng lawyer what to do. For all she knows, baka nanghihingi lang ng lagay yung judge.

Yan nga sabi ng friend ko baka nanghihingi lang ng lagay yung Judge.. Pero I told him na i don't think so kasi former professor ko sya sa lawschool at hindi naman sya notorious for that, for sure lang na mahigpit sya kasi kahit sa class noon lagi nya sinasabi samin kung plano namin pa-annul at taga doon kami sa korte nya, magrent kami sa ibang lugar.. Kaya ang hinahanap ko sana dito ay at least same case na baka naresolve na, not the usual "comments"..  just to understand ang point ng aking beloved prof & to help my friend..

^Sorry na usual comment lang ang na-ooffer ko even though I was just trying to help. And since mukhang wala ding ibang may similar case, the best thing is still your friend's lawyer directly talking to the fiscal/prosecutor or talk to judge directly.

There's no sure way to know what goes on in the judge's mind than to talk to him directly. And the fact that yun na ang hinihingi nya, I don't think whatever rationalization or whatever similar cases your friend may know would matter kasi sinabi na ng judge na gusto niya ganun.

And besides, I think you already understand why he is who he is. Sabi mo nga, mahigpit sya sa class ninyo so it's safe to assume na mahigpit din sya sa cases nya.

^well, nagpost ako dito kasi right after ng hearing nila, so wala pa sila napagusapan ng lawyer nila noon.. definitely lawyer nya talaga may alam what tamang gagawin, kasi kung ako lawyer nya, ako rin may alam ng gagawin ko, pero baka lang kasi may masuggest ako bilang kakatapos lang din ng hearing dati..

Lawyers know best so it's important to find the right one. This is beneficial in having a deeper understanding of the case, knowing the ins and outs of the judiciary, and helps address a lot of concerns and questions.

hi mga sis, first time ko magpost kahit na isang taon na ako naglulurk. sharing my experience with hubby's annulment.

His lawyer was really good when process has started. all in all, entire process is 160k. lawyer said that he just bundled up my hubby's case with the other so that it will be cheaper. 30k dp to get the have the psych interview. psychological incapacity will be the ground. his ex was in another country at that time. she didnt want the annulment at first. the lawyer told my hubby that as long as the ex doesnt know that the annulment is on going, he can process it smoothly. but still advised that it would be better to settle their issue. annulment process took almost 2 years but its because of the lack of budget. but it can actually be as fast as 6 months if we only have the money. anyways, here are the stages:
after 30k dp, sent marital history. after 1 month, psych interview. received the copy of the formal filling documents.
next, 20k, court appearance. added 10k for close court. witnesses, return addresses has been changed and made to reflect that the ex abandoned them (they have a daughter).
30k to make sure that documents will be received by a party (supposed to be his ex) but will not reply.
20k to give to the judge prioritize the processing of his case.
remaining 50k was given in staggered amount. it should have been just 150k because we wanted to personally process the NSO on our own para makatipid. but lawyer advised against it. saying the last 10k will be for his men to process NSO.
he was asking for another 20k after he gave us the marriage cert with annulment annotation but we decided to not give in anymore as we already validated that it was already in NSO.
timeline: june 2011 - filing, november 2012 - decision , nso - june 2013
we got married august this year

Ingat lang sa mga annulment na less than 1 year, ah. Mainit ang mata ng OSG sa ganito especially if hindi technicality yung grounds.
