legality of retaining the use of maiden name after marriage

^hindi naman sis parang nayayamot lang yung mga nagiinput ng data. Pumili sila, magsinungaling ako sa civil status ko or yung gusto kong pangalan ang ilagay nila.

hi sisses, i would like to ask lang kasi i'm already married. Way back 2005, sa pinasukan ko as secretary, ang nilagay nila is yung married name ko eventhough hindi pa ako nag-change ng status. And then, sa previous work ko for years, ang lahat ng records ko naman is under my maiden name. Recently, na-discover ko na yung philhealth ko pala is under my married name na pala.

Question, magkakaproblema ba ako when it comes to contributions since ang name ko dito sa company na pinapasukan ko ngayon is my maiden name pa din, hindi ba magkakaconflict yun? Can I still retain the usage of my maiden name or do I have to change all my records and status as well? mejo hassle kasi to kasi ang daming prosesong gagawin to change everything. Hiwalay na din kasi kami ng hubby ko which is why i opt not to change my status. Pasensya na kung medyo mahaba hehe thanks in advance sa sasagot.

@mysticross: Hi sis. Regarding sa concern mo about sa contributions, dapat punta ka sa Philhealth para ma-assistehan ka nila sa pag-merge ng records mo (the ones under your married name tapos yung nasa maiden name mo). Just be ready with your documents (marriage cert/papers indicating kung legally separated and mas maganda kung sa mga previous companies mo makahingi ka ng copy of proof of contributions mo--meron sila dapat niyan) and then explain sa Philhealth yung nangyari. Usually sa government papers ang alam ko kapag na-register na under married name, pahirapan ibalik sa maiden name unless may papers indicating annulment o kung widowed na.

^^ hi sis thanks po sa pag-answer. one more question though, kahit ba hindi ako mag-change ok lang? kasi all my records except that of philhealth is in my maiden name pa. medyo ayoko kasi mag-change ng status kasi yun nga hassle lahat babaguhin ko pa hehe tia

so glad i found this thread.  am planning kasi not to change my name.  i haven't discussed it yet with h2b, but good to know that, legally, i have this option.

Last time I went to NBI, they told me the computer will automatically change your name to bear your husband's surname if you are married. I insisted that I cannot accept it so I was asked to go to head office. For GTers that applied for NBI clearance with your maiden name, what was your experience? Did they allow you to retain your maiden name on the NBI clearance?

u can retain your maiden name, that's a given. the problem is when your transacting with government agencies, automatically iniinput nila if your married is your husband's surname. so ako para wala gulo at sakit ulo i used my husband's surname.

you just have to present the decree of annulment in the sss, philhealth and other government agencies. the decree is not the same as the decision.

Limitation yata yan ng computer program nila for encoding.  You can and should insist that your clearance reflect the maiden surname but I don't know how they can remedy that with the restrictions on their encoding program.  What happened in your case pala?  Did you go to the head office?  Nabigyan ka ba ng clearance with your maiden name?

Nako balak ko pa naman mag renew ng nbi ko. I am married now and i am hyphenating. Sana naman hindi problem sa pag encode ng nbi ang hyphenated last name. Ayaw ko kasi ka to fully adapt my husbands last name. Magiging same na kai ng mom in law ko. Ayaw ko!
