BETTY...whatever properties a couple have..,, what they clearly own, in all forms and manner... que business, real estate, stocks,deposits...
 
 When 1 spouse dies...  the surviving spouse gets automatically 50% of everything...
        PLUS   eto medyo overlooked by most..
        the share of 1 legitimate child in the balance of the 50%  or
        1 share of 1 legitimate child after the balance of the 50% after the probated portion..

So whatever the share of 1 legitimate child is... in whatever form  (cash deposits, bonds, stocks, real estate or percentage ownership in an ongoing business) -- kanya yon. kahit na ba hindi sya working for the business.  It is the adult child's inheritance (which is not the salary if working for the company)

Ang gulo or guerra patani lies in the valuation or distribution.  how can you divide a going concern?  what happens is that generally, the majority or a collective majority among the heirs buy out the others who want to divest.  But the one with majority interest (surviving spouse) will have the greater say as to management, divestment, etc. 
    (He with the bigger interest or claim   hehe    has the louder voice)

what a story, so many things i;ve learned from reading this thread.

i hope everything gets better soon... inheritance-wise and relationship-wise sana everybody concerned will be happy na. :)

I have just read this thread, and I feel for the threadstarter and others who had predicaments with inheritance, hers is a complicated case.
Agree with aquacharly about getting a lawyer(hopefully hindi busy with corporate accounts)
***Legitimate kami lahat,no problem with parents, the only problem we have right now is ONE sibling, Taking advantage of our parents by constantly issuing postdated checks to make cash,.
 kahit sibling is sufficient alread(verified) but puts drama stories( for parents). Hidden agenda to get advances already.

DESIGN21,  we have not achieved full settlement.

What happened is that all surviving siblings are ranged vs our mom and the family of the dead brother.  For now ganyan ang kampihan.  But we are all on speaking terms, and we have resumed our get-togethers na sobrang gulo na comedia.  But our mom and the kabit plus her kids know we are very watchful. 

Our mom is bent on liquidating everything, kung makakalusot of course! dayain nya distrbution - old habits/DNA die hard ika nga.  The bratty kids still at it - gastos to death -- I have stopped asking why our mom tolerates it and continues to  cash out for it.  So our mom is bent on liquidating to keep her share totally under her control, even beond her death - lol.   A sister is the 1 keeping track of all liquidations/sale... She said  she does not believe our mom will equally bequeath her estate to us, as
She  claims -- kaya she is liquidating all and squirreling her funds away.  Kaya per this sister - hindi sya papayag sa statement ng mom namin na hwag na breakdown/distribute proceeds of sales/liquidations
kasi mapupunta naman sa amin equally her estate later on.

Family is family nga, kahit  Grrrrrrr!   A  divorced sister is re-marrying in a few months in the US, so we are all gearing  up for a vacation as an entire  family.  San Francisco  will see a barangay of noisy fun-lovers arriving then.  sa dami namin,  we require a big bus. 

This has been an emotional learning experience for all.  My husband and I are now more conscious of treating our kids equally.  I hope we do not change as they  grow, and lol, gain their respective "marketing/persuasion  skills".      I still say, educate them as far as their brains can go, then spend it all parang lol .. When you die, ikaw ang kaaway nila for spending it all, and maganda samahan nilang magkakapatid.

i always enjoy reading your posts aquacharly. i do hope that your family will be able to resolve this issue sooner rather than later, habang malakas pa si mother :D

i can just imagine your vacation in SF, am sure riot yan!

In the FICF,  from the day you manifest you can understand there are 24 hours in a day --  you will also learn that it is only the sons that will inherit. 
It is only the sons that will get the good breaks as in -- educational support beyond college. 
It is only the sons who get "perks" -- cars, good allowances,  good clothes, etc. 

    Ewan ko if she was born with it in her DNA -- but my mom is makwenta... her language for understanding the world, for expressing love, for enjoying whatever --- is money.  As in cash expressed in so many zeroes in different accounts.    Ako may advocacy for women self-empowerment expressed in secret accounts.  Maniwala kayo,  sa galing galing ko sa ganyan -- wala akong binatbat sa nanay ko.   

    Siguro kasi ang hinaharap naming mga daughters eh hopia lang --- we each had our ways and means to bring ourselves up into this world.  Okay naman kami.  Walang sister na "hirap" now.   But we got from Hopia Point  to the  Comfortable Point where we are now kasi nagsumikap kami, real hard work, a lot of self-denials/sacrifices  (saka na lang that Chanel bag!)

(meron pa nahulog sa bus kasi biglang umandar ang bus .. eh lumaki kaming hatid sunod ng driver at car to school, etc. so you can imagine ang tawa namin at galit nya when we pictured her falling off a bus).     

Mga brothers -- kasi nga mga heredero -- hay naku,  kahit na ba naka position behind them the funds and assets of our parents ... ayon .. name it, it is there:    loss of a lot of funds (puede nang inheritance ha!)  by each due to sugal, lasingan, chicks.   All brothers have broken marriages -- annulment, abandonment by an exasperated wife, etc.   There are illegitimate children,  recognized and otherwise.  The children na nakapuesto sa mga bahay nila -- lasenggo, sugarol, low performers in school (if performing at all), steal from my mom (jewelry and cash) when they stay with her ..  and a couple minumura sya behind her back, even when other people can hear them:  Bw1sit na matanda!  PI!   

So ganoon ang 2 camps in the FICF.
Mga sariling sikap with orderly famlies and good children. 
At mga heredero who cannot manage their money, waste a lot of money,  mga kapalmuks, mga walang modo.... the only thing going for the apos on that side is that anak sila ng son ng parents ko.

But we love each other.  Funny ano.
When anybody needs help... hindi namin iniisip na teka -- ilang milyon nga ba meron ka nagets as Xmas gift? tapos ako nagets ko cake?  (oh that is true, believe me).


This sounds too familiar... exactly how my mom's family is (my grandparents, aunts & uncles -- 4 of each).  Well, my mom's family is also pure chinese so maybe kasama sa culture? LOL.

In the end, now they're all in their 50's-60's and gwama is on her 90's, she's now dependent on her daughters for money.  Then the sons still get money from her.  So if the son spent so much in gambling and asks money again from her, grandma would do all drama to get money from the daughters then secretly give it to the sons or their children.
