aquacharly, today lang ako ulit nag update on this thread... ohmy your posts amused me as usual... sis, si derek ramsay pwede na rin sha instead of jay manalo... kasi i saw jay manalo lately hindi na sha yummy like before (you know during his "totoy mola" days, harhar!)...

this inheritance issue still has a loooonnnnggg way to go and i am continuously praying for you to be given the strength, patience and guidance to withstand everything and get out of this alive and happy - sayang naman ang pinagpaguran, effort and time kung walang kahit papano happiness na makuha. you are blessed to still have your sense of humor in the middle of all these...

please don't get tired of sharing bits and pieces of your life with us aquacharly. i am learning a lot from you and am very thankful.  :D

THANK YOU, SILVERONFIRE, for the prayers.

Where are we now?  Bogged down with the lawyers (medyo) and the BIR (mostly).

Actually, ayoko na talaga to be the one (by default, lahat naka tingin sa akin!  eh hindi pa naman ako nagpapa Botox nor facelift pa....  ako na naman!) to get everybody's act together vis-a-vis the BIR. 

I am beyond puking when it comes to BIR  greed and lack of ethics.  (Remember, I gotta deal with them now and then since hubby and I have businesses.  Teka, so what's new?  dapat ganoon attitude ko di ba? But hay naku, there is always something greedy-new  or kapal-muks-new with the BIR. )

Sinasabi ko na nga ba, pay to the last peso... do not be "creative" coz the way the BIR people are now, konti lang ang "savings" and there is that sword hanging over your head for the next 2 years, before your books are forever "closed" and safe from any "reviews".   

My stand vis-a-vis the BIR is to pay what is truthfully due 100%... . and not share anything with the BIR by "saving" as per their unsolicited proposals.

Our mother vehemently disagrees with me on this .. (we "talk" through our respective lawyers) ....
She prefers to  "play ball" with the BIR.    Now, the BIR has given her its own "unsolicited proposal" nga on how to "save"  hehe, kapal!   (teka, time out, will puke muna.  grrrr). 

Basta, if after she "plays ball" and there is a "recount" later on ... I told my lawyer, to make sure I am not going to shell out anything for any fiasco later on. 

Feel ko, SILVERONFIRE, I am on a war cruise.  hehe, hindi na banca ano? liner na  :)
Parang, from Afghanistan to Iraq (ngek!  landlocked nga pala isa doon. tama ba?)

After the extended tug-of-war with our mother... eh, eto naman ang BIR. 

The lesson is!-- ta-dah!  educate your kids, give them everything that is good for their character... then, give some to charity, and spend it all!

Kidding aside, we are still mired in talks with the BIR.  Ako give up na!  Sabi ko na so many times, to settle per what is talagang legal.  Pero the BIR!  walang ginawa kundi provide us with "unsolicited proposals".

I have told all siblings to get their own lawyers, or if using the same lawyer, kanya kanyang representation. 

Sure, we are all "eyes on the Inheritance" now. But we do not agree about the details.
Some of them want to deal with the BIR for a lesser tax.  Sabi ko naku, naku,naku before the prescription period for "reviews" plays out... for sure, kasi traditional racket na ng BIR yan eh.. we will all receive a notice for payment of proper tax and penalties tapos eto na naman another round of
"unsolicited proposals".

I have told my lawyer, to put in legalese my stand that I am for paying my share of the legal computation.. and if later on may penalties... wala na akong share doon.

In the meantime, there have been certain funds maturing and released... sinabi ko unahin those who want cash now.   Partial pa naman settlement.  Actually, sinabi ko unahin those who need it more.  With the understanding that those who delay getting cash or do not get their complete share of the cash later on ... will collect on the property.  Sinabi ko din that I may not go after any cash, but consolidate my share in certain properties.. Parang wala na akong ka share doon.  Magulo kung may kausap pang iba eh, kahit na butiki lang.

In the meantime,  LOL -- Mother and lawyers have been sending documents at baka makalusot mabawas sa Inheritance computations or tally.  Mga wise na siblings..they sign like heck.. trusting na pagdating sa akin... ako laging last sa ikot ng docs eh... hindi ako  sign if not okay.  LOL, works for them nga.  Wala pang nakakalusot sa akin so far.
Imagine, si Mother up to now! 

Oh this is weird.
Hindi ba Mother did not want to put the urn with the ashes in a columbary.   She got a yaya in a white pantsuit to carry this designer white bag containing the urn of my dad... bitbit when she goes to our family parties, bitbit when she goes up and down Luzon.   Feel ko hilong hilong hilong hilo na my Popz.

She refused to listen to Fr Orbos, to our Santuario San Jose parish priest that the dead must be separated from the living.  Basta daw!  hindi! 

Pwes, siguro she wants to travel now.
We used to warn her.. if you bring him on the plane wthout proper documentation... the urn will be seized.  Sige! 
I think she wants to go to the US for the Thanksgiving Sales.  hehe

Pwes.,  last week a brother calls... Mom had a mausoleum built for 16 (no daughter was speaking to her, and the brothers as usual dense ... so voila! may mausoleum for 16 ... sabi ko Atchi, raffle mo sino kasama sa 16 as supporting cast. Hndi ako sali dyan kasi Starring Role ako sa mauso namin later on.  Tse! she said)
So...all of a sudden, we will have another funeral rite to transfer my hilong hilong hilong Dad to that mausoleum.  Tanong ko... may aircon ba?  May CR?  Actually, I was just trying to control my gigil.

Hello!  I think my Popz has had his share of funeral rites.. another one?  Okay lang kung kami kami but per our brother, she said daw on this date at this time... basta she imposed... with a "small group of close friends and relatives lang"....

Yan!  Alam ko na pag ganyan small group, she means ang hindi lang niya invite eh yung MMDA sa kanto.
Ah ewan!   Ka gigil ha.

So it is the BIR, and then we will all be watching closely.  I think we will end up in court, based on the little I have seen and heard since we daughters stopped talking to her.   Our Mother is so secure in her delusion that everything belongs to her, and we are the ones out of line.

What if she does not settle on time?
Na float na rin yan.
Kasi she appears to be making parallel moves with the BIR... she is dealing on her own.

Sabi ko, 1 month after the deadline... pag wala akong narining or nakita na payment... I will write the BIR myself.  That is to force the issue of inheritance distribution, after payment of course.

Grabe sya ha... I have frozen accounts in certain banks na... deadma pa rin sya after the initial round of croc tears and dramas.   Kung hindi ako kilala ng cuentohan nya na relative.... or baka nga convinced all... I look like one of those mean weird urban art vinyl toys.  Yung Japanese releases.  LOL

Now I know her strategy... sit until I lose interest.  Kasi ganoon ako eh.... I move, act and decide fast then I let go and move on.
Hindi puede eh.  The siblings who got partial cash shares... their lives have become more secure, colorful, etc....  it makes my contravida role all worth it talaga.   Human nature... they have experienced how it is now to have no worries for basic needs... you think papayag mga yan na kalimutan na lang the rest?   LOL

The law firms in makati and ortigas must love, love your family. LOL.  The longer you drag your feet, the fatter their piggy banks get.  What other options have your lawyer given you ba?  Why not take everyone to court?  Siguro magkaka-high blood lahat including the kabits. LOL.

MOONIE,  after the initial Obstacle of arriving at a list of what constitutes the Inheritance up for grabs...  we have fallen back on family and close-friend lawyers.  So if any lawyers are being paid well, it should be our Mother's lawyer.  LOL

The 6-month period for the deadline on Death Taxes is not yet up. 
So, we have to wait for that. 
We expect ourselves to arrive at an Extrajudicial Settlement before the 6-month deadline.  And it is clear, that we are asking for what is just prescribed by law -- so it is a very simple case actually.

IF we do not agree on an Extrajudicial Settlement, then there is no choice but to bring our disagreement to the courts, and to "impair" all TCTs and other assets' marketability &/or trade-ability.  As it is,  financial and other liquid asset accounts are already frozen.  These are released only after we all sign that the division of proceeds thereof is as legally prescribed.

So MOONIE, it is just a little passage of time we have to yield to our Mother. 

In the meantime, we have some diversions nga.  1 is that forthcoming mausoleum event.  LOL  Mother's "guest list" not counting us yet is up to 250 na.  (As I predicted, she will talk to someone on our side kasi may "palabas" nga)

She had a meeting with Atchi  (LOL, she is the only 1 Mother wanted to meet with... ah!  marunong na sya choose her battles!  LOL) -- and the major points taken up...

    The 1st 6 pews are reserved for family

    Who is going, who will boycott?
   
Atchi said, I may not be around, coz husband and I are scheduled to be in HK around that time.
(Siguro inisip ni Mother:  how I wish!   LOL -- isip ko, ano ka sineswerte?)

But Atchi said, we sisters -- we will never be rude.
BUT some of us (inisip ni Mother sigurado ako yon, as usual si Espiritu de Contradiccion) -- we cannot be Tupperwares or LocK&Lock.  Whuzdat? Mom asked.  Atchi said:  Plastic!

Basta ako, I do not know if I can get myself to kiss her -- at baka ako matuka.   

What am I trying to say AKTHUNG?
I love her inspite of everything kasi Mother ko.
Pending the arrival of Pepeng, I had my secretary call her up to ask if she needed anything.  Wala daw, but thank you very much for asking.
 
But I do not like her... because of her gender bias all these years and to-date. 
And kasi ang dami dami na nyang sinabi sabi just to have her way.  She has maligned us, and given us no respect and totally disregarded that we are responsible adults who have made something of our lives. 
I will not even go there -- whether she has love for her daughters or just tolerance and exploitation.

I read somewhere that the biggest problem in life is:  Empty Pockets.  I disagree.  Easier the solution/s to Empty Pockets, relative to other problems like having a disabled child, a morally-disabled husband, mga ganoong problems. 
It is achievable to plan ahead to not experience having  Empty Pockets.

For me, the reverse:  Too Full Pockets -- is the biggest problem.  It leads to jockeying and conniving among family members,  to attracting unfavorable attention & interest from the BIR, kabits, and their ilk; and sure puts your faith in family on the line.  Too Full Pockets has the greater potential, vs Empty Pockets, to develop  the negatives in people.

So there --   :D  Educate our kids to the max, donate to charities .. then spend it all!

gaaaad sis aquacharly..napakagruelling naman ng inheritance issue na 'to..honestly i read the first 2 pages of this thread then skipped to the last page,hiningal nako sa excitement eh. i feel that somewhere in between the skipped pages nagkaron na rin (in a way) ng share sa inheritance ang BIR at lawyers nyo.

Money, in most cases, is a problem for lack of it; but when there's more than enough, and it still causes problems it's just sad. .money changes people, which is also sad and true..

I hope your stressful fight is over soon. And when you get what's due you, get your mom something..something sentimental - like a cake or hopia  ;) LOL

My first thought was that impossible for a mother to behave like this, and do such things to her OWN children... but with money, it seems nothing is impossible... like you said, truth (or your mother) nga is stranger than fiction... mukhang kelangan ng malaking dose ng "suspension of disbelief" in your case...

I currently live in Taiwan and I hear cases of sons being favored over daughters everyday. But in their culture makikita mo talaga that when a daughter gets married, she belongs to her husband and family. That's why parents do not want to invest more than what is required by law on the daughters. Even my good girl friends here serve their in laws but not their parents (but you can't say they are bad people di ba?)... Oh by the way, only the eldest son gets the money. So mas unfair pa the culture to the other sons kasi they need to work their butts off for a secure future (the daughters can rely on their husbands... so they tend to choose rich husbands!)

But I don't know why they practice this in the Philippines where daughters (mana or none) are expected by society to serve the parents when they get older (otherwise, 'wala kang utang na loob')?! The sons are excused because they are the breadwinners in the family! Really... it's not fair to the daughters~

(Sorry for the long introduction... at sana wag rin akong batuhin ng mga FilChi's in the forum.)

So yes, I really get where you are coming from... and I get why you want to pursue this fight.

I think your kalokers mother doesn't realize that the 'kankungan' may not come in the form of poverty... it could come in many forms... like say, a sickness. At sinong mag-aalaga sa kanya? As the ad goes, 'hindi biro ang magkasakit'. Can she rely on the favored ones? If yes, lucky her... if not, still lucky her that she has you! (Win-win situation rin si mother mo if you think about it... kaya siguro matapang?)

But as you pointed out, she is still your mother and you love her. Whatever she's doing now has been 'Hitler-ed' on her, too, for all we know... so congratulations on making this also a fight against a tradition that is already impractical (it works in other cultures, but not in the Philippines).

I will join the others in praying for you and wish you and your siblings all the luck. I also hope your mother will be enlightened before it's too late (like the unfavored apos thinking ill of her)! This thread has been a good read and I'll follow your story na rin  :)

p.s. Are your dwendes doing anything about this?

BRINI07 -- Thanks for the goodwill sent our way, that all is settled sooner than later.  But regrettably, IMO -- we will get drawin into a long court case. 

Our Mother is quick on the legal distribution of cash, as this becomes freed or available.  When Achi inquired about the progress on the TCTs of properties... she dangled that there will be another distribution of cash due to the near-sale of certain properties. 
BUT goes deadma with regards to certain big properties, more valuable properties, and ancestral properties.   So there...

With the dispute within our family -- it is like the floodgates to a forbidden topic have been opened, and opened wide.  Now, everybody in the families and close friends of our parents' families (huge too), and our respective spouses -- are talking about their inheritance issues.

It appears that here in the Phils. daughters do get less than sons.  (Our case was  a "bit" different coz  it started with daughters getting "zero".)
Yes, even in matriarchal families -- the sons get more, and get the best of any lot up for distribution.

Kinda disturbing... daughters settle for less than their legal share... as long as they receive something.  And usually, it is a house & lot, a lot only, OR a financial contibution to the acquisiton to a home.  OR is the operative word.
(Of course, there are the peripherals like heirlooms -- but the better ones still go to the sons)

Another interesting fact within our circles --  when it is a son in financial trouble, the parents rush to bail or help out.  But if it is a daughter... the parents pass the buck to the SIL's parents.
The mother tends to see her sons' households as extensions of her own... so there is the easy transfer of goodies from her home/kitchen to theirs.   LOL

Sa cuentos cuentos about what is going on in the other families... the generation of our parents just sat back and suffered it all ... tanggapin ika nga.  But our generation naman -- will not just sit back and take it... but the majority will not go to the extent of settling via a court case (even if the time and expense are gonna be worth it).

Now, the generation after ours.... hay naku!
This atrevida favorite niece of mine (daughter of a brother, yes 1 of the favored ones)  stated:   It is not right to reward Rotten Apples just because they have the favored surname.

May I ask what has been happening lately?

Is there any other way you can pressure your Mother Dearest? Not just legally, but other ways?

Yung isang friend ko, one sibling filed a request with the NBI to investigate the sibling holding the purse strings re tax evasion, with threat of opening and freezing accounts here and abroad, in order to get share of inheritance. Na-subpoena yung sib who has the money, accountants in the office, etc...ultimately though, the situation was mediated by a neutral party close to the family and sibling got portion of inheritance.

I hope your mother eventually realizes that life is short and there is nothing to be gained by being so swapang. And believe me, I know the ones who are the wealthiest can really be the most swapang. Good luck, God bless and stay very strong.

Well, I had the final approval on the Extrajudicial docu.  Hay buhay, sa akin na naman tumingin lahat.  Nakakapagod din eh.  Sometimes I said, i just wanna ride along too.  (Sabi nang Atchi ko, watch out what you wish for -- baka magka totoo eh you wake up 1 day g@ga ka na nga, pero knowing you -- you will remain tone deaf.  Ay hindi puede maging Lady G@ga.  Ngek)

Anyway, como talaga feel namin lahat -- na hindi pa full disclosure si Mother, and that kabit is hiding something pa; and the brothers have not fully come forward with their disclosures --  plus, there are certain properties or stocks run by other people we have to find the time to sort through and sit down on ... and some properties, well -- na Ondoy... pwes, basta pinalagay ko sa Extrajudicial docu to the effect that... our legal sharing will also cover other properties not yet included/declared in the Extrajudicial docu.

LOL -- sabi nang BIR -- knee jerk... what are you hiding?  in all innocence sinabi ko -- eh wala, but if we discover say 10 years from now ... later on that so and so has utang at mapwersa magbayad -- of course, we want our share di ba?  Kahit na P10thou lang IOU yan, eh pang bili din nang hopia, este french fries.  Nakalusot naman ako sa greedy BIR.

Now, the BIR has given us a certain period to complete all documents... coz sabi namin, este Mr Bwaya, este BIR --  our father kasi hid some of the the docus (TCTs, tax receipts) --  (kuno but this is not true anymore)  --  tinago ng kabit.  Eh the  kabit is shaking us down.

LOL, as usual, tinapon ko sa corrupt --  este Mr Bwaya, este BIR pala --  baka  you can help us -- can you scare the kabit na she will be the one to pay for the taxes como the docs are with her?
LOL -- ah hindi daw puede pakialaman mga ganoon kasi baka ireklamo sila for harassment, etc etc BS.  LOL -- inisip ko, hindi ba BS itong inaayos natin?  Aw shucks!  LOL   
So there, we have gained time kasi well, it is tedious, it is nakaka irritate and things get in the way such as ... good grief!  gusto ilipat ni Mother the ashes of Pops to the US.  And of course, there was Nov.1

The thing is, our accomplishment to-date == we have put in the Extrajudicial that we share accdg to legal distribution.  Big deal na yan for all of us.... I said, give it a little more time and spadework, we daughters will get what we deserve.

The brothers and the kabit and bulbol gang were the last to surrender, si Mother surrendered ahead kasi nagmatigasan kami we will not make moro moro sa 6th month padasal, sa birthday ni Pop, sa pasko, etc etc etc....  Pano daw share  nila?  Ha?  OMGrief!  Sabi ko eh ang share ni Mother -- everything naman goes to you brothers.  akala nyo ba nag ilusyon pa kami or umasa kaming mga daughters that Mother will not learn  from this forced legal distribution?  Naku for sure, she will transfer en punto her properties and holdings to her sons.  Hindi na yan mag aantay nang last will and testament time.

Sabi, all good things come to those who wait.
Sabi -- but I am not holding my breathe on this.

With regards to the BIR proposals ... nagmatigasan ako, pay what is legal.  Sabi ko, you cannot hide forever.   
There are ways to not declare properties... but I cannot put it here.

Anyway, basta we had a side agreement.
In case there are other properties later on that are not declared now (kasi meron ayaw talaga declare ni Mother) -- basta liability nilang ayaw mag declare.  Basta we still get out legal share -- but we do not share in penalties, just regular taxes as if paid for on time.

Noong una, my mother was angling for the assignment of certain desirable properties to the brothers.  i said then, no .. magulo yan.  But some of the sisters were amenable para lang daw matapos na and claro we have control over some properties. 

O ano ngayon?  Pano kung natapat na share or settlement mo eh yung na Ondoy?  Sinabi ko na nga ba eh... across the board ang sharing, tapos saka na pay offs if somebody want to buy out anybody's share.

Oh MIDNIGHT, walang katapusan ang running comedia namin.

O di sige, na install na sa mauso si Popz.  Before and after the installation, Mother kept on saying dadalhin na lang daw nya sa US -- we just ignored it all, coz as I said... if she wants to do it, what can we do di ba?  Or, she is just looking for a topic we will not ignore and we will make batbatan about.

Eto na kamo, so umabot kami all on good behavior. 100% attendance for that mauso nga. 
Then, we had the Nov. 1 shortly thereafter.
Oh my -- parang picnic na hindi ko maintindihan.
We had to appear at a certain time, and told by our old yaya to bring food. 
Oh my pagdating namin doon... LOL, may beach chairs... yung semplang ka pag upo mo at ayaw mo na tumayo.  May tents... kasi the smokers may not do it in the mauso.

My kiddie made a usual loud observation -- hindi ba mga kiddies eh kung ano makita basta binubulaslas?  Oh Lola -- why are you wearing your red Chinese slippers here?  Is this your house also?  LOL -- at home na at home si Mother.
She had some carpet rug there... hindi ko mapigilan, I said: baka sa Dec eh fully carpeted na itong mauso.  Why don't you lubus lubus na rin your effort at pagawa ka nang 2nd floor na may aircon, may day beds, may CR at small kitchen?    My husband motioned to keep my mouth shut na.  hay buhay.

But I feel sad coz she goes every afternoon for at least 3 hours, to this very day.   I told my Atchi, baka abnormal na yan... and ewan ko ba... sabi ko baka when we go in Dec eh daig pa ang Luneta .. she keeps on having it landscaped and re-landscaped... pati  yung neglected mauso sa kabila eh pina landscape.  OMGoodness!  But I really feel sad seeing her occupied by such.   

It struck me that for all her kalokers sa amin, she is consistent in being there for her husband.  Eh props nga lang kami in the family di ba... si yaya ang consistent factor in our lives, at least for us daughters.  So the attention of our mom was always on her husband and her sons.   Parang happy sya attending to that mauso and going there everyday.  Parang she took pride when nagulat kami na  boink!  may mauso na we all did not know about till a week before the transfer.  Well, of course she did it so fast kasi walang comite de festejos -- nobody was consulted eh. 
She had a happy satisfied look when the general consensus was:  maganda, elegante.
   
So there, it kinda breaks my heart that her happiness is still caring for a husband na well, wala na talaga di ba?  I do not think he has the capacity pa to appreciate everything she is doing for him.  Bilib ako sa capacity nya to love him, and to attend to him and what she perceives as what he needs... beyond life ha. 

Eto pa... my sisters go there.  There is one who is feeling kinda guilty coz feel nya she did not serve my father well enough... that he would have not have died if she had taken over his medical emergency...   She goes 2x a week ata at least.  And LOL -- brings him cigarettes and his favorite Almond Roca chocs.   And of course, she sees my mom. 

Eto kamo, sabi na nga ba AKTHUNG puede gawing series of scripts eh... 1 day she arrived and saw a tall Madre de Guadalupe candle...  still burning (the candles are lit and left.. kung minsan, inaabutan pa daw ni Mother the next day).   Naku pinatawag si old yaya.. sino daw sa amin naglagay noon?  Kasi by now, she has memorized what candles we each prefer to bring....   Eh wala naman sa aming may ganyang gimmick na candle.
Kakukulit, basta hindi ako nagsabi!:  ah baka dumalaw ang ex-kabit ni Popz.  LOL   I have a feeling she may soon lock up that mauso.   Kelan kaya katapusan nang triangle cuento nila ano?  It is her who has not forgiven the kabit... kahit na nung talagang the relationship had ended na.

The BIR is still pending.  We have submitted the Extrajudicial etc etc plus whatever tax decs, etc etc etc.... Sila ngayon naghahanap how to decrease the tax liability.  Kasi di ba, naku let us not pretend anymore ... ang BIR eh gets their tong as a percentage of the "savings".   

So that is where we are.   
Initially Mother said, she will spend her Xmas and NYear in the probinsya... coz anyway, her sisters are coming for a visit from the US.  Tapos, a sister commented... doblehin mo security mo while you are there.  Do not tell us you will stay in the same house as the bulbol gang?   So she will spend it na lang daw sa mauso.  I cannot say if she is serious about it.

I want to go abroad, told hubby, to avoid any more emotional complications.  How 1 death changed our family ano.  Who would have thought ganito ka tindi the falling-out?
But Atchi does not want anyone, as in anyone to fly beyond a 3hr flight kasi nga naka 2 deaths in a year na kami.  Hwag na daw namin tempt a 3rd one.   

But if we should find enough goodwill to get together... well, the best table centerpiece as usual is a couple of lechon de leches.  Madami nga kami eh.   

So there, we are still pending with the BIR. But the delay is on their part.  I just really want to get it over with.

hi aquacharly, i'm thinking, it's because you can take it kaya ka me problem kang ganito... as cheesy as it may sound, i don't think you won't be given this if you can't handle it.

my prayers for you and your family, that your mom may see beyond the PHPs and the $$$s hounding your family.  i feel for your mom too, as it seems she doesn't have a life beyond your dad and your brothers.  but i feel more for you and your sisters, as it seems you didn't have a mom.  buti na lang you didn't come out as patapon, or worse, someone just like your mom.
