pretinnes: It was actually a straight denial, sis.  According to the lawyer, it was due to an administrative error.  Apparently, the system sensed a discrepancy/issue with the petition -- but instead of issuing a query, or seeking additional information (or an audit), it automatically released a denial.  The best route, per the lawyer, was to appeal under the government error queue... pero parang wrong strategy naman, in my opinion, because it's been a year and we haven't received any response yet from DOL.  Oh well...

In your case mabilis lang, 'no? You're blessed.  So are you looking for a job now? In what field?

Matagal talaga ang processing daw ng H ngayon. Be it extension, filing or transfer. Kami kasi ni-transfer muna yung H1B tas after filing the transfer, saka ni-apply yung I-140 and I-485 namin. Concurrent application din.  Ngayon lang na-approve yung H1B transfer, it's been almost 6 months after application. Yun din sabi ng lawyer when we asked before.

hi thelady, nasa manila pa yung best friend ko. naghahanap pa rin ng work. he's a computer engineer pero puro clerical work lang nakuha nya dun. naisip ko na rin na i-petition sya hehe kaya lang ayoko namang mag-asawa. sabi ko tulungan ko na lang sya maghanap ng work para matulungan nya mom nya magpagamot kasi only child sya, single parent pa yung mom nya. sana may ma-recommend kayong company, leads or tips, kahit ano. thanks a lot.

Hindi ko din alam sis. Nagulat nga kami nung sinabi ng lawyer na 4-6 months daw ang approval ng H ngayon. I think ni-scrutinized na nila yung mga applications ng mga contract company dahil sa Neufeld Memo.

Isa kasi sa hiningi ng husband ko na conditions yung immediately filing ng I-140 and I-485 upon contract signing. Sinabi talaga namin na EB2. Kasi dun sa previous company nya, ang sabi i-ffile daw kami, eh 2 years na, wala pa din nasisimulan.  Kaya naghanap na sya ng bagong employer, tas ayun nga, sinabi nya agad na yun ang condition nya. Ang alam nga namin, lilipat sya after approval pa ng EAD at the very least, pero they also filed for his H1B transfer para makastart na agad. Diba with the H1B transfer, as soon as ma-file at ma-receive ng USCIS, you can start na. Kahit di pa approve. Swerte lang siguro kasi indemand talaga ng PT nowadays.

Eto yung timeline namin sis:
06/26/2010 - H1B Transfer received by USCIS
09/03/2010 - Medical and GC forms sent to lawyer
09/07/2010 - Medical and GC forms received by lawyer
09/27/2010 - I-140 and I-485, I-765 and I-131 received by USCIS
11/15/2010 - EAD received
11/17/2010 - Biometrics schedule received
12/03/2010 - H1B Transfer approved
12/7&10/2010 - Biometrics schedule

Bale wala pang approval yung I-140 and I-485, i think kelangan muna ma-receive yung biometrics para umandar yung application, next week pa schedule namin.

Yung PERM automatically approved na since kasama ang mga PT sa Schedule A, di na kelangan dumaan sa Labor Dept, deretso na agad sa USCIS office.

Alam mo, we've been talking to immigration lawyers and some Pinoys (who already got their GC) but none of them ever discussed the possibility of getting an EAD in the absence of I-140 approval.  All the while, we were under the impression na dapat approved na ang I-140 para ma-release ang EAD.  Nakakatuwa naman yung case nyo.  Imagine, nauna pa ang EAD than the H1B transfer

Exactly sis! Kaya nakafile na kami ng EAD (I-765) pati ng Advance Parole (I-131) kasi pwede sila i-file with the I-1485. Mabilis lang yung 2 na yun, sabi ng lawyers, mga 3-6 months. True enough, nakuha nga namin in 3 months time yung EAD (which is the most important for us na H4)

Pwede lang naman magconcurrent filing kung Current ang priority date, pero in both your cases ni thelady, both kayong EB2 right? So dapat pwede din kayo nung steps namin. If I'm not mistaken, ganito din ang ginawa nila sis pretiness kaya may EAD and AP na din sila.

ah iyon lang ang problem, sila pa din pala may call. suwerte niyo din sa part na iyan kasi sila gumastos. umabot kasi kami ng 6k sa processing kasi may processing fee pa sila on top of the processing fee ng USCIS mismo.

anyway, di ko sure about sa i-485 if nakapag file na ng i-140.may friend kami na ganyan eh. inantay nalang talaga niya ma approved ang i-140.

suwerte niyo din sis gnela, sagot lahat ng company. sa amin hindi.  mabilis lang iyong perm namin sis. less than a month lang. di ko alam bakit sa kanila sis thelady at sis inggay matagal. baka naman nandiyan na mga sis, sinabi lang nila na wala pa.

I didn't know na ganun pala katagal ang processing ng H1b extension/transfer ngayon.  We are currently in the process of extending ours, 3 months na wala pa rin. It's a bit of a problem coz I have to renew my driver's license twice na, first they gave me a 60-day extension, and now I have a temporary permit lang kasi pending pa rin H1B ko.

yung sa amin naman sis kahit sa akin sinagot nila yung gastos. at kung may dependent man kami sasagutin rin nila. actually pag dating sa gastusan maaasahan naman sila pero yun din ang trap sa amin unfortunately.

hi sis mom_wanwan! Onga sis, we got the EAD na! I've been looking for jobs even before we got the got card itself, been to interviews, kaso til now, wala pa din. Iniiisip ko baka kasi holiday month. Anyway, I've been putting myself out there kasi madaming job openings naman akong nakikita. Wish me luck!

Oo nga eh, hindi din namin alam na ganun katagal yung H processing nowadays. When we asked the lawyer, sabi nga nya 4-6 months daw. Naku problem nga yan, lalo na dependent nga pala ang DL sa visa. Pano yun, nihahatid ka ni O? Or both kayong temp permit?
