Not really, not unless your application was under EB2. Kasi yung EB3, it's currently processing those with Priority Date na Feb 2005. So if mas later kayo than Feb 2005, kelangan pa magwait. We're lucky, yung husband ko kasi he was filed under EB2 and it's CURRENT. Meaning there are visas available. Last Sept lang kami ni-file and then after 3 months, nakuha na namin yung EAD.

Actually with the Premium Processing, this will only kick in once na yung Priority Date nyo is Current. So for example, your priority date is Feb 2005 (which is current right now), uunahin nila i-process yung application nyo as compared sa ibang applicants na Feb 2005 din ang PD. If hindi pa current yung PD nyo, hindi pa din magwwork yung Premium Processing. It's actually an additional $1000 on top of the fees that you paid for with the application. Hope this helps.

that's the same site we go to para magcheck ng status. actually over na sa timeline pero wala pa rin approval. my husband will check na lang if pupuwede pa mag premium processing kahit nafile na. pag tumagal pa ito ng 1 year lipat na lang kami sa timbuktu!

gnela_21: You're right about making sure that the priority date is current in order to enjoy premium processing.  But I think thelady's dilemma is more on the delays of the process -- if I'm not mistaken, her I-140 was filed in late 2007 and until now it's still pending.  Based on reseach (and friends' experiences, too) it shouldn't take that long.  The longest approval time I've heard of for an I-140 is 10months, that's why I mentioned premium processing... but I don't know if that will be possible now that her case has already been filed (baka kasi it should have been done upon filing).  Having said that, you're blessed that you now have an EAD!

that's the problem nga sis, we can't call uscis directly. everything we do, we course it through my hubby's company who filed the petition. wala pa kami sa ead application part kasi pending pa ang i-140. pag nadisapprove ang i-140 na ito talagang magwawala ako!!!

Hi sis pretinnes! Kasama ka na ba dun sa application ni hubby mo? Congrats pala sa hubby mo for the EAD and AP, i remember kasi issue nyo din yan before! (EB2, visa etc) May schedule na kami ng biometrics next week, pero wala pa yung AP namin. Hehe.

we can also file for an appeal pag nadeny ang i-140 pero that's a longer wait. might as well start with perm again. haaaay sakit talaga sa ulo if madeny man.

More patience pa sis. Chaka think positive, ay mahirap ang case kapag na-deny kaya, wag natin isipin yun. Anong field ka pala dito sis? How long have you been on H4? I had several interviews and funny lagi nila ni-aask agad baket daw may lapse dun sa resume ko. Hehe. Kasi nga last work ko 2008 pa eh 2010 na today. I had to explain about H4, EAD etc.

ayaw ko na nga isipin yung denial, kaso kailangan rin namin maging prepared for that kaya kahit wala pang result ay iniisip na namin kung ano ang gagawin if ever malasin. almost 4 years na ako on h4.

kamusta naman pag ineexplain mo yung h4? nagegets naman nila agad? tingin ko hindi na matatagalan at makakakuha ka na rin ng work. sa downtown ka ba humahanap?

Tagal mo na palang nasa H4. So naka-renew na kayo ng H1B ano? Kasi yung 1st term is 3 years diba? Hopefully before matapos yung renewal ng H1B nyo, ok na yung EB2 application nyo.

Funny lang kapag ni-eexplain ko, kasi minsan di talaga nila ma-gets pa. Not unless the employer are those who were familiar with the process of recruitment, usually kasi mga IT bosses na kausap ko, kaya wala silang idea. I actually had interview near our place (Oak Brook area) and medyo malapit sa airport.

possible reasons? ka engengan ng lawyer! rotflol. seriously, marami nadedeny because of documentation. kaya nakakainis diba kasi kung ikaw mismo ang gagawa for sure wala ka mamimiss sa requirements. yung ibang lawyers kasi considering routine na yun sa kanila e may kulang pa rin minsan. pag nag appeal minsan inaabot ng 2 years at yung new application, back to perm stage pero kung maaapprove agad in 2 years pwede mo na makuha ang ead.

bakit in 2 years sis? kahit under eb2 at naka premium? ang tagal naman.di ba kapag sa perm, mga 2 months after okay na iyan? then file na ng i-140 concurrent with i-485.teka, concurrent filing ba kayo?i push niyo na i concurrent filing kayo kung under eb2 naman kayo sis.para mabilis na.

It's still pending, but according to my husband's employer, such denials have become fairly frequent in recent months. We've been monitoring our case, and it looks like the lawyer's appeal under the government error queue has gone "regular".  They said that if we can't wait any longer, they're willing to file a brand new PERM.  What are the chances naman kaya na maa-approve agad yung bago, diba? As of now, we're undecided about the proposition... siguro antayin na muna namin what God will tell us to do before making any decision.

Fresh news pala from my attorney friend.  You can actually convert your ongoing case to premium processing -- that is kung papayag yung employer ni hubby mo (na mahirap kausap, hehe).

after niyan submit na ng papers for i-140 and i-485.and i don't think mas madali ma deny kapag concurrent.halos lahat ganyan na ginagawa especially sa eb2.niloloko talaga kayo ng employer.besides,dapat may choice ka kung magpa premium.kayo naman magbabayad eh.kayo ba?si hubby kasi nagbayad sa premium processing, additional 1k.
