Nacurious ako sa Chiong sisters case Dahil sa kakabasa ko dito di ko n nga maalala ang case na to sa sobrang tagal so chineck ko sa youtube Nakita ko yun ke Tulfo then I watched the documentary. Grabe half way pa Lang ako sa pinapanood ko nabwebwesit na ako ibang klase talaga ang politika sa Pinas at ang kabobohan ng mga tao. PEOPLE WILL LIE BUT THE EVIDENCE NEVEr SA ATTENDANCE PALANG NA NASA SCHOOL pero ibang klase mag manipulate ang batas. sana magbayad lahat ng me kasalanan at mapalaya ang inosente. Regarding the movie, sobrang pangit ng reviews. I think mataas expectations cus daughter ni Carlo J Caparas and he was known for these kinds of movies in the 90s.

My earlier post was based on the SC ruling itself. Yung sa nagsuicide yung judge kasi dahil dyan sa dna issue na yan, that is just a mere speculation. Malay nyo ba naman kung malungkot lang talaga sya no.

Di na need ng DNA kasi nga, nagmatch na yung fingerprint and naidentify na rin yung body ng victim. It really helps to read the SC ruling mga sis sa totoo lang kasi yung mga issue na niraise sa docu, andun lang lahat. Masasagot yan dun. And no, DNA is not the strongest evidence there is, physical evidence po yun. Sa case nung chiong sisters, physical evidence plus corroborated with testimonial evidence kaya convicted sila paco.

The body was identified using fingerprints. But yes they should have done dna testing if Marijoy was indeed raped. What I find fishy here is that Paco is a rich kid. How come they didn't hire the top defense lawyers? Bakit mga walang kwentang lawyers lang mga kinuha nila?

^Eh di sana na-ID din nila kung kanino bang semen through DNA test. Kasi kung ipabibitay mo yung tao, dapat sure na sure ka na sya nga yung gumawa. I mean, exhaust all possible means to make sure you have the right person. But they didn't do it. Kung tutuusin lahat sila dapat nag-pursue to have DNA testing. For the mom, so that she is very certain that it's her daughter. For Paco, to prove that I didn't do it.

^The appellants only claimed that the body was not that of Marijoy since no dna testing was done. Hindi nila niraise na issue na i-dna nyo yung body para malaman kung narape or kung sinong nangrape. Kung anong defense nila, yung ang niresolved ng court. DNA testing was not done because the issue was whether or not the cadaver found was that of marijoy chiong. The court ruled in affirmative, na oo si marijoy nga yun. Mga sis, hindi automatic yang dna testing na yan. Discretion ng court yan. Hindi porket walang dna testing eh hindi na nila nagawa ang lahat, na unfair na yung nangyari, na biased na yung ruling. It doesnt work that way. Sa criminal case, proof beyond reasonable doubt ang required dyan to convict. Sa case na to, nameet nila yung requirement na yan. Again, kung nabasa nyo ng buo yung case which i did, mareresolve yang mga questions and doubts nyo.

^Exactly sis. Dapat "Guilty Beyond Reasonable Doubt". Dun sa Give Up Tomorrow, si Judge Ocampo yung nag-block sa DNA testing kasi di na daw need nun because the family gave a positive identification. Was there a rape kit even performed?

So if I'm understanding it right, 3 ba yung cases na sinampa kay Paco? In the original decision, Judge Ocampo gave him two life sentences for the two guilty verdicts and hindi death sentence because di naman na-prove yung rape? Tama ba?

Kidnapping - guilty?
Rape - not guilty?
Murder - guilty?

Sana i-adapt na din sa Pinas ang jury system. But then again, that would be more expensive and mas magiging matagal ang proseso. Jury selection pa lang, baka hindi na makausad dahil mahirap makahanap ng hindi bias.

Pa-comment ako. Not directly sa chiong case at sa issue kung guilty o hindi si Paco.

I want to comment sa papalit-palit niya ng lawyers at sa paano nila nipresent ang defense ni paco.

As a lawyer, pet peeve ko talaga ang mga clients na sinungaling. Kung client kita, paano kita madedepensahan ng maayos kung sa akin mismo sinungaling ka? Ganyan din pananaw ng mga kapwa ko abogado.

Saka ayaw din namin sa client na kung umasta siya ang abogado at ako secretary niya lang. Ang papel namin is tulungan ang client sa paarang gusto namin at hindi sa paarang gusto nya. Syempre mas alam naming mga abogado ang mga tactics paano manalo sa kaso.

Sa case ni Paco, ang hinala ko baka may attitude siya at iyong family nya na contradicting na sa principles ng mga abogado niya kaya binitawan ang case nya. Baka nagsinungaling pala sa kanila o nagfeeling abogado. Hinala ko lang naman.

So ano ang naging result? Naging palpak ang defense niya.

Ang disadvantage din kasi pag papalit-palit ka ng lawyers, may chance na magkaroon ng inconsistency. Iyong next lawyer ang magreremedyo sa kapalpakan nung unang lawyer. Hirap iyon.

Kapag I interview ang mga pulis sa TV madalas nilang sinasabe eh crime of passion o onsehan sa droga without studying the evidence or usually may eyewitness sa crime para Lang mapadali ang caso.

You have this so called eyewitness of the crime sa Chiong sisters but the defense has his 30 classmates or so and school to testify that he was in the school. Would students lie to protect a fellow classmate or would a school compromise its integrity or the teacher. Just the fact na magtratravel ka para magkapunta sa court laking hassle na at student ka your time is very valuable.

Why would the judge jail defense lawyers just because they they were asking for DNA testing tapos yun judge bibigyan ng local attorneys bilang kapalit. Walang kaalam alam yun kapalit sa case. Why would a judge comment suicide afterwards?

Kapag sensational crime talaga yun public outcry ang nagiging way for politicians to work their magic. O biglang me eye witness pero ni hindi tinignan ang DNA.

Oh well at the end of it all ang karma ang maniningil sa lahat maybe it takes years decades pero it will kill your conscience.

kung magaling lang ang lawyers ni Paco that time, they had a LOT of remedies they could have availed of if may questionable orders si Judge Ocampo. medyo kaduda-duda lang na wala akong narinig na umakyat sila sa appellate courts (Court of Appeals and Supreme Court). like if the judge really refused to have the other witnesses testify, they can question that.

re the acts of mrs. chiong to rustia, was it raised before the court? kasi if sa media lang yan, walang pake ang court dyan unless you raise it.

i honestly don't know kung kanino ako magside kasi malabo talaga ang facts eh. both sides may inconsistencies.
