Hello dear. Not an expert pero sa pre-law namin ito yung naalala ko (correct me na lang if I?m wrong). Divorce ends a valid and recognized marriage. And hindi masyadong complicated ang proseso. Walang mga limiting clauses (or grounds) para maapprove ito. Like for example, nagsawa kayong mag-asawa, pwedeng icite niyo lang irreconcilable differences. Pwede din infidelity.

As for annullment- the marriage was valid however there are grounds to nullify it. Meron din tinatawag na Null and Void na kasal (falls pa din sa annullment) which means in the first place, fake or invalid yung marriage because of incest, minor yung isa sa parties nng kinasal yada yada. Unlike sa divorce which technically almost anything could be used as a reason to end the marriage, sa annullment hindi pwede. May mga grounds para lang maconsider na hindi valid yung kasal. Example: Fraud, Marriage was forced (shotgun wedding), impotence, STD, lack of parental consent if 18 years old yung kinasal, insanity or yung tinatawag na psychological incapacity (usually ito yung pudpod na ginagamit na rason ng gustong mag-annull ng marriage).

I think what you were saying is kung magnegotiate ang mag-asawa between the 2 of them lang and they have to do it secretly. Tulad ng ginagawa ng iba na hindi aattend or magcontest ang isang party kasi yun na usapan nila or hati sila sa bayad pero secret lang na ganun setup. May dati akong officemate na ganyan ang ginawa. She allowed her husband na palabasin na siya ang psychologically incapacitated pero si husband ang gagastos sa lahat. Inabot din ng almost 3yrs bago nafinalized.

Ang alam ko lack of authority of solemnizing officer tapos di pa sila member ng sekta na yun. Saka alam ko dinagdag pa yung psychological incapacity (di ko lang alam kung sino ang pinalabas na incapacitated or baka pareho sila).

Legal separation means your marriage is still valid and you are not allowed to marry. Whereas both divorce and annullment, you can. For the children of an anulled marriage- meron lang specific grounds on which they will subsequently become illegitimate after the annulment- one of which is if the children were from a bigamous marriage (5 grounds yata yun I forget the others). Basta tama yung isang sis natin dito, any annullment resulting from psychological incapacity may not affect the status of the children- they will still be considered legitimate.

Oo nga, OT na tayo. Pero para di tayo maOT, yung case yata ni Bimby. Sabi ng isang GT natin dito (mentioned above) is the lack of authority of a solemnizing officer ang isang grounds for the Kris Aquino annullment. I think isa din ito sa mga clauses (not sure though) on which a child will be deemed as an illegitimate. I read somewhere that Bimby uses the Aquino surname (?). So maybe that?s the reason why he doesn?t carry the Yap?s name. Paclarify na lang kung tama ba yung reason ko.
