Car agent forcing me to take the brand new car

So long story short, I was about to get a car loan from toyota car dealer and almost to make a downpayment. When suddenly a family member's life is in danger, thus I cannot pursue the loan. I decided just the day before when I told the agent I will pay the down already. The agent is telling me that they punt a tint into the car (which he didn't consult with me) and made an internal invoice (which he didn't tell me as well). He said he would need to pay 40k for penalty because I backed out and he won't have a salary for six months. I am noob at this, and I feel bad for the guy. To those who are car agents mga sis, or may kakilalang agents, totoo po ba ito? Although buo na ang desisyon ko na hindi kukuha, is there such thing na kapag nag backout last min eh may penalty sila? I did a reservation by the way (5k), which I don't think I can get it back.

Sis as far as i know, yung tint, they won't put it unless for release na ang car. Eh lalo pa ngayon na may LTO memo to not release new units without OR/CR so talagang tatambay muna yung sasakyan sa warehouse na pwede umabot ng 1 month bago marelease sa buyer. Yung tint ang alam ko kasabay ng final detailing ng car bago i-award sa buyer. Also, did he ask you even kung anong tint ang ilalagay? Diba may gradations yun so dapat approved mo muna yun bago nila ilagay. I'm not sure about internal invoice ha, pero I remember yung sa amin (Toyota din), yung vehicle sales proposal was only made after we paid the downpayment in full. I'm not sure what internal invoice is, di ko maalala if may ganyan kami, maybe you can ask your agent for a copy. Lahat naman dapat ng files nila eh may copy ka. Regarding the penalty, I'm not sure if may ganun nga silang policy, pero feeling ko sobra naman yung 6 mos without salary. Eh paano kung makabenta naman sya sa mga susunod na buwan. I mean, yours is just an unfortunate circumstance.

Ang reservation, wala na kung mag back out ka. Tanong mo pano process kung 3 buwan mo pa kunin. Sa office o manager ka tanong. Hindi sa agent.

Yung sa amin, down-payment muna bago tint. Hindi sila gagawa ng kahit ano sa stocks nila hanggang di pa benta.

basta wala ka pang pinipirmahan na kahit na anong paper, they cant force you to buy something kung nagback out ka na. they cant sue you either kasi wala naman kayong contract. yung mga accessories, tint etc, nilalagay lang once confirmed na din yung downpayment. I got mine after 1 week pa when i deposited my downpayment so its impossible na iprocess nila yung "unpaid" car then force you to buy it. technically, di mo pa sya binibili, ni-reserve mo palang so wala ka obligation to buy it. mukhang frustrated lang yang agent mo kasi di matutuloy yung benta nya. hayaan mo lang sya. takutin mo din, sabihin mo magpakita ng document na mapprove na may obligation ka to buy that car, na naprocess na yung pagbili mo ng kotse even without the downpayment. na reservation fee lang, pag wala siya maproduce, sabihin mo kakasuhan mo sya. hahaha! downside lang siguro is bad record ka na sa dealer na yun, pero madami naman ibang dealer dyan na pag aagawan ka pag sure buyer ka na. baka naexcite si agent na sya na nauna ipurchase yung car, pero not your fault. kasalanan nya yun kasi wala ka pa naman go signal, prinocess na nya. kung wala nga talagang DP.

TS sayang Reservation Fee mo, refundable yun, samin na refund e kahit 1000 lang, ngpalit kami ng dealer. may mas magandang offer yung isang agent from another dealer. So nirefund namin, pumayag naman.

Yes sis, what I know is prinocess nya na kahit wala akong down, I didn't know what kind of processing it is since first time ko to, sana sinabi muna nya na hindi na pwdeng mag backout kasi mapipenalize sya. Ang usapan kasi namen mag dodown ako ng before march para hindi abutan ng price increase. Sabi ko sige mag dodown ako Feb 27, kaso Feb 26 I told him hindi tuloy. I'm not sure bakit he processed everything before ako mag down. Hindi nya naman ako pinipilit until now, it bugs me lang na magbabayad sya ng 40k dahil sa nag assure ako. Yung tint, hindi ko talaga magets, eh ang plano ko front and back walang tint dapat, ngayon may tint lahat. He told me na refundable ang reservation, pero ngayon hesistant nkong kunin dahil nga pati sya magbabayad.

^ di mo na problem yun kung pati sya magbabayad. sya ang nagprocess without your knowledge. so problem nya yun. why would he process the sale kung wala naman DP at reservation lang binayad mo. and pwede mo din sabihin na bakit pina-tint nya lahat  e ang sinabi mo front & back wala. madali lang naman magtanggal ng tint. and yung kotse, im sure mabebenta pa nila sa iba yan. mukhang atribida si agent mo para iprocess yung car mo ng walang DP. sya pala may gusto, edi sya bumili. just say na wala ka namang binigay na DP so bahala na sya dyan. Ilaban mo yan kasi monthly ka magbabayad dyan for the next x years. sa lahat naman, bayad muna bago benta so wag na nya ipush pa. goodluck!

I dont think its true na prinocess na niya, kahit wala ka pang pinirmahan or downpayment. I think he is lying.
In case he isnt lying, kasalanan niya yun. People change their minds all the time, and we have the right to change our minds. Besides, pwede naman niya ibenta sa next customer yun. Kadaming customer, impossible hindi niya maipasa sa iba...

Ako rin curious ako kung ano ba yan, because it just doesn't sound right. Obviously any big business such as a car dealership would know better than to go with a verbal agreement only. Feeling ko rin baka the agent is just trying to manipulate you. I've met mababait-looking din na agents before, but be careful, kailangan naman kasi nila talaga to act nice to get clients, di ba.

Oo nga mga sis eh. Eto pa, to think na ang gagawin ko is partial down(50%) muna this end of Feb para di ako abutan ng price increase sa march, tapos march 9 pko mag fufull downpayment at dun ko palang aasikasuhin yung loan papers, saka palang ilalabas yung sasakyan, which is aware sya na march ko pa kukunin yung sasakyan kasi hindi naman pwdeng ilabas ng hindi full yung down.So hindi ko magets bat nya pinatint at pina invoice eh wala pa ngang pera. Then sabi nya kasi nag cocooperate daw kasi ako kaya ginawa nya lahat na maprocess ng mabilis.

agent talaga ang may sagot nyan kasi wala pa naman receipt ng downpayment, may invoice pa. management na ang kausapin mo kasi wala ka pa namang 'deal' na nagaganap so ibig sabihin di nag push through yung transaction. tint, pwede alisin, wag mo problemahin un. sila na bahala dun. kahit pa singilin sayo yun, basta di pa final yung transaction niyo, wala lang yan. baka nga sagutin yan ng agent mo pero problema nya yun kasi prinocess nya ng walang money down.

naghahabol ng quota si agent kasi nearly end of the month na. pwedeng sinasabi nya na lang yan or masyado syang assuming na sure na sure na kukunin mo na unit kaya pina tint nya na agad. fault nya yan at malamang nga magaabono sya.

Liar, liar, pants on fire. The car dealership won't allow him to make any changes on the car unless a receipt for the downpayment has been confirmed and released. No such thing as internal invoice din, baka kamo in-internalize na nya commission nya sayo supposedly. He's using guilt trip to force you into buying, don't fall into the trap. Kahit totoo man na magka penalty sya, which is SO not true, kasalanan nya yon for processing without full authorization at wala syang right na ipitin ka.

As long as you have not signed on the dotted line, you have no obligation to buy. No one can force you to do something you don't want to unless you are legally obliged to do so.

i agree that he is only lying kasi you cannot make an invoice kung wala pa sa kamay mo ang downpayment and also for the car tint that is impossible too. no intelligent person would do anything to a car unless they have at least the dp in their hand. masyado naman siyang excited if ever ginawa niya yun without consulting you.

Talaga mga sis, thanks for the information talaga. I will try to get my reservation sa office since hindi naman talaga natuloy. Yung nga ang sabi ko eh, bakit may invoice eh wala pang pera. I will give you an update kapag nakuha ko yung reservation at ready na ako kumuha ng sasakyan. I'll try na hindi sya yung agent. Iisa lang kasi ang branch sa probinsya namen, mag kakakitaan kami dun.

TS, ako naman sis, I paid for the dp nung time na irerelease na yung car namen though there was a 5k reservation fee. may tint na rin when the car was released, accdg sa pinag usapan namen so I'm not sure if iba iba ang policy per dealer. BTW, we got one from Toyota too last Sept.

Pinagmumulta sya plus no salary for 6 months? If true, dapat nagresign na sya. Bakit agent pa rin sya hanggang ngayon? Namimilit lang yan...

@ayi0119, sis yung 40k na multa ibabawas sa sahod nya. By the way, I talked to him again ang asked for the copy of "internal invoice", sabi nya naka encode daw sa system so hindi pwdeng makita. Then pinaasikaso ko sa sister ko yung reservation namen, kukunin nya sa office using my authorization letter. Sana makuha pa nya ulit.
