Need help mga sissy: ( super nalilito ako

Mga sissy nalilito kase po ako. I'm married pero Hindi nag work any relationship naming so we ended up our relationship mga 5yrs ago na po...ngyon present na syempre my mga kanya kanya na kaming buhay ni ex ko,at ngyon makakababy na kame ng partner ko nalilito ako kase since ginagamit ko [textspeak!] surame ni ex ko never ko binago since kasal kame.paano po pala sa birth certificate ni baby ko?ano po susundin ko mga sis?tapos sa philhealth and sss ko di ba maapektuhan yun mga sis?di ko dn alam san ko ilalagay tong post ko e.my kapareha ba ako na sitwasyon dito..praying sana my sumagot po.

First Off..I am not a Lawyer
IMHO and legally speaking, you're still married. You can either be charge of Concubinage or Adultery. You could have simply live together with your present partner without having a baby until such time your marriage has been annuled. Your Baby will suffer when she/he grow up and maybe have the stigma of being an illegitimate child.  Try to consult a lawyer or you may visit in person or write to Manila Times Columnist Persida Acosta about your predicament. She can give you legal advise about your case of what you should do.

As far as I know last name ni hubby ang gagamitin ng kid. Yan actually ang reason kung bakit mas mabigat ang parusa sa adultery. Hindi niya biological child pero last name niya pa din ang susundin.

TS, you just need to consult with a lawyer. Ito nahanap ko sa internet: (copy/paste ko the statements ha)

1. the child is considered the legitimate child of the wife and her husband because of Article 164 of the Family Code (“children conceived or born during the marriage of the parents are legitimate”) and Article 167 (“the child shall be considered legitimate although the mother may have declared against its legitimacy or may have been sentenced as an adulteress”).

2. This creates a big legal mess for the physically separated wife and husband. The wife no longer wants to have anything to do with her husband but the child is presumed to be legitimate.

3. What surname will the child use in the birth certificate?
If she uses her husband’s surname for the child, her husband can file a case of damages against her.

If she uses the biological father’s surname, this can be used as evidence by her husband in filing a case of adultery against her and the biological father.

If she informs the Local Civil Registrar that she is physically separated from her husband, the LCR will not allow her to register the child under the biological father’s surname because of Articles 164 and 167 of the Family Code.

She can claim that she is single and then either leave the entry for the name of the father blank or use the biological father’s name; in this situation, she can potentially be charged with perjury.

Whatever the wife does with the child’s birth certificate, there are adverse legal and practical consequences.

4. For children who may have been born in this kind of situation, they will find themselves in a limbo: they are legitimate from the legal point of view but are illegitimate biologically.



Just a wild idea you may want to explore: what if ipa ampon mo ang bata sa live in partner mo? Or anyone you trust and who can trust you (your Mom?) sa papers lang naman, pero nasa poder mo parin ang bata. Not sure how the process will be, that's why you have to really look for a lawyer. Ask your lawyer what are your legal options.

TS pag ang gawin mo eh adoption dapat yung legal na dumaan talaga sa court.
Pero bukod na ang kassle ng proseso  parang ang gulo pa ng sitwasyon. Kase  once ma approved lalabas na legally hindi na ikaw ang nanay.
Marami naman may case na kagaya mo mga kakilala ko pa. Si friend  1 ipinangalan pa rin sa ex husband niya dahil ang katwiran pag namatay daw siya pantay ang maging karapatan ng lahat ng mga anak nya(sa isip  ko non  gosh!ang gulo!  But now nasa U..S na si friend 1 kasama  kids nya from ex hubby)
Friend 2 ..ang pinagamit na surname sa anak nya sa new partner ay yung pagka dalaga nya na apelyido.
Ang ex ko naman nagka anak sa married girl ay ipinangalan sa apelyido  ng ex ko.
Waaa ang gulo lol
IMO ang pinaka safe  ay wag muna ipa rehistro ang anak mo.
Ayusin ang annulment then once maayos na at saka na mag file ng late registration.
Mas mahirap kase mag ayos ng may existing  birth cert na .

Depende siguro sa ex-husband mo. Sa case ng sister ko, surname ng partner niya ang ginamit ng anak niya. Wala naman siya naging problema, even sa philhealth. Nung pina-update lang niya ang dependents niya, na-curious siguro sila kung bakit iba surname ng last child compared sa nauna (anak ni sister sa ex-husband niya). She just said, iba kasi ang father.

Hmm Married ba yung kapatid mo sa Una niya na asawa?

sis, kung ia acknowledge ng partner mo yung bata parang pwede nya gamitin yung surname ng tatay nya..

siguro sa una pwede pa gamitin ng anak mo yung current philhealth mo since ipapangnak palang sya hindi pa sya registered. kaya lang sa mga susunod na pag gagamitan ng philhealth baka hindi na pwede yung sayo. pero pwede yung sa tatay nya.

^pwedeng gamitin ng bata anytime yung philhealth ng nanay niya.

i have friends na same as TS case. what they did is use the surname of the biological father and middle name is the maiden name of the mother. then they filed for an annulment. child is illegitimate sa birth cert of course. i know this is not the legal way but what else can they really do? alangan naman use the surname of the legal husband diba?

i think you can get away with this kung hindi naman mag-a-apila ang husband. pero to legalize it file an annulment already for the sake of your child.
