We were hit by a taxi, towed by a Toyota Hilux. Our car was damaged (sa may drivers side, yupi yung paligid ng gulong, sa driver’s door, until sa headlight), but still operational. The person who operated the taxi didn't have a driver's license, while the driver of the Hilux did. Our car was just 6 months old.
The incident happened near a police station, but the officer who responded to the incident told us they don't issue a police report. We then agreed to proceed to Paranaque Traffic Bureau to file the police report and the Hilux driver told us he will follow since he still needs to return the taxi back – kung saan po sila galing. We agreed, in good faith, and with the assurance of the officer that he knows the owner of the taxi company and di raw nila kami tatakbuhan. When we reached the traffic bureau, the driver didn't show. Cannot be reached na rin yung cp nya. We were there patiently waiting and constantly contacting them pero cannot be reached na or mahina daw signal and di nila kami marinig. Eventually, we were able to reach their boss, which is currently at the province, and we were told that nilalagnat daw yung driver nya kaya di makakarating. Hahabol nalng daw sila ng statement.
With what happened, we weren’t able to proceed with the police report kase wala ang statement ng kabilang party. We were given the option to file it as hit & run, pero may bayad daw po yun. We didn’t have any cash at that time, so we said babalik nlng kami and we will try to reach the other party.
We had our car assessed and the damage estimate is huge, pero covered naman ng insurance namin. Insurance namin ang gagamitin at ang sabi ng may-ari magbabayad naman daw sila ng participation fee. BTW, wala daw po silang insurance. Naubos buong araw namin sa nangyari, kami pa ang binagga, kami pa ang mag.aasikaso ng lahat, apiktado pa deliveries ng business namin.
We had another meeting yesterday at the traffic bureau. When we came, andoon na yung driver nung Hilux, and on his statement, kami daw nakabangga sa taxi na tinotow nya. Binaliktad pa kami! Pero sa picutes na nakuha namin makikita talaga kung ano ang nangyari. We called the owner on the spot para may witness rin kami sa pag-uusap na pulis. Ayaw talagang magbayad ng damages na nagawa nila. Maayos kami nakikipag-usap sa kanila pero yung may-ari mismo di nagpakita samin hanggang ngayon at iniinsist nila na ganun daw patakaran nila. Pag nakadisgrasya, insurance ng nakabangga nila ang gagamitin at participation fee lang ang sasagutin nila. Is this right?
At this point, we were not able to acquire a police report since the person operating the towed taxi didn't show and never did.
Question, can we possibly file for civil damages caused by what happened? The effort and time we spent was really frustrating.
