Why can't you travel with your son now? Hindi ba sa birth certificate nya naka indicate naman maiden name mo?

Sis, kasi required ng Australian Embassy yung consent to travel ng dad niya.

Hi Sisses, I hope you can help me.
May passport application ang daughter ko next month sa DFA. I am working abroad, but her Dad (my husband) is with her sa Pinas kaya Daddy nlang sasama sa application sa DFA. then doon ko na encounter and legitimate at illegitimate child.
my daughter is 8yo now. she is born out of wedlock, but she used her dad's surname. birth certificate is with acknowledgement of paternity with dad's signature. BF and GF palang kmi ng dad nya noon, and this year, we finally got married. all this time, ang alam ko ay legitimate child sya basta pinagamit sa kanya ang surname ng dad with signature.
Now our problem is that illegitimate pala ang status nya ngayon. Ngayon ko nlang nalaman while reading about passport application here sa GT. to make her legitimate, we need to update with NSO. yes we do have our NSO marriage certificate na, but wala naman ako sa Pinas to sign the  Joint Affidavit of Legitimation. Will be back to Pinas on January 2016, but at the same time Out of country tour sana namin sa January with our kid.

-Is there any way na maprocess ang NSO legitimation ng daughter ko without the Joint Affidavit of Legitimation, using only her Dad's signature and our NSO marriage certificate?
-Another option is process the passport as a illegitimate child, but kailangan naman Mother ang kasama. But since I am working abroad and only her Dad can accompany her, then baka hindi talaga pwede to.

sis rikki21, ang alam ko kelangan mo talaga ng signature mo sa Joint Affidavit of Legitimation, natry mo na ba itanong sa PE nyo jan? pede naman from Pinas yung Joint affidavit of Legitimation, signed by your husband, tapos ipapadala sayo. after mo ma-sign, dadalhin mo sa PE for verification/authentication.

Share ko lang mga sis ang experience ko.
2006 ko pinanganak ang daughter ko at surname ko nilagay sa birth certificate nya. 2009 kami nagpakasal ni hubby.
Requirements na hiningi ng city hall, Affidavit of acknowledgement (signed by hubby) at Affidavit of legitimacy (signed by me and hubby). At siyempre yung marriage certificate. Binigay agad ang annotated birth certificate ni daughter. Humingi ka na rin ng endorsement/intention to apply for annotated birth certificate para sa NSO (endorsement letter, certificate of deed acknowledgement and legitimation, copy ng 2 affidavits, certified true copy ng annotated birth certificate at MC at Form 1A). Pinadala ko sa NSO main via LBC saka sinamahan ko na rin ng prepaid pouch at 280pesos for 2 copies ng birth certificate. 1 month ang process kasi check pa nila kung wala kayong previous valid marriage.
Total cost: less than 1,000
1 day ang processing sa city hall at 1 month sa NSO.

Nahilo ako sa pagbabasa. But just to clarify, I hope someone can answer me. Here's my situation:

We're not married..yet, but we're living together. My son was acknowledged by my partner sa birth certificate nya (may pirma and everything sa likod ng [textspeak!]-we went personally to the City Hall to process this) so surname nya ang gamit ng anak namin from the start.

When we get married, what we need to do, is submit the marriage certificate to the civil registrar para maging legitimate ang anak namin. Tama ba? Yun lang?


nope. ang alam ko kailangan syang i-adopt parin ng partner mo kahit nakasulat sa birth certificate na sya yung tatay. :)

^i-correct ko lang. QueenChokolah, hindi po ito yung situation na kakailanganin ang adoption. para maging LEGITIMATED ang anak nyo ito lang:

submit nso copy of your marriage certificate AND Joint Affidavit of Legitimation.

LEGITIMATED ang status niya. same rights as a legitimate child. pero siya: LEGITIMATED BY SUBSEQUENT MARRIAGE OF THE PARENTS.

ganito yung affidavit of legitimation, after preparing this and signing, pupunta kayong dalawa ng husband mo sa notary public para ipa-notarize. to be sure, prepare at least 5 copies.


                                            JOINT AFFIDAVIT OF LEGITIMATION


       WE, ______________ and ______________, both of legal age, Filipinos, husband and wife, respectively, and presently residing at _______________________ after having been duly sworn to in accordance with law, depose and state:

1. That we are the biological parents of _______________ who was born on ____________ in _____________ as evidenced by the attached copy of the child’s Birth Certificate, made an integral part hereof as Annex “A”;

2.  That at the time of his/her birth, we, the biological parents were not yet married, hence his/her status in the original birth certificate was entered as Illegitimate.

3. That at the time of the conception of our child, there was no legal impediment for us to contract marriage;

4. That we contracted marriage on _____________ in ______________ which marriage was solemnized by _________________________, as evidenced by the attached Marriage Contract, made an integral part hereof as Annex “B”;

5. That by virtue of our subsequent marriage, the said child is now legitimated by operation of law, particularly Article 177 of the Family Code of the Philippines;

6. Hence, we are executing this Affidavit to attest to the foregoing facts, for purposes of complying with the requirements in applying for the legitimation by subsequent marriage of our son/daughter, _____________________ and for the proper recording of such legitimation in his/her civil registry documents and Philippine passport, to enable him/her to bear the surname of his/her father and be entitled to all the rights of a legitimated child, and for all legal intents and purposes.

hi sis fionaapple ask ko lang sana sayo ang sitwasyon ng asawa ko,may anak kasi sya sa pagka binata,his daughter is already 16 years old,nung time na pinanganak ang anak nya that was 1999 hindi pa pwede daw dalhin ng bata ang apelyido ng ama pero ang sabi ng husband ko nakapirma daw sya sa likod ng birth certificate ng anak nya .. sa tingin mo ba sis pwedeng dalhin ng anak nya ang apelyido ng husband ko at anong mga papers ang kailangan namin para maayos ang apelyido ng bata.. thank you sana masagot mo sis.. godbless
