1. Get married.

2. Obtain NSO-authenticated marriage certificate.

3. Prepare an Affidavit to use the surname of the father (AUSF). >>> nagkamali lang. This must be a Joint affidavit of legitimation.

3. Submit NSO certfcate  together with the AUSF to the local civil registrar.

4. I think there are corresponding fees for these documents to be attached to your baby's birth certificate, but i do not know how much.

5. Have the baby's baptismal records corrected by submitting copies of the abovementioned documents and the newly-corrected NSO birth cert.

6. Use father's surname as baby's surname in all of his/her existing and future records.

alright! sis ayan na ang procedure so go ka na huh'?? medyo madame lang talaga dapat gawin kasi total change of documents ang gagawin nyo. and prepare for the fees na din for sure may bayad lahat yan. well God Bless You!

^ naku ang problema nito kung magkano kaya magagstos namin..at ilang months or years kaya 2 bago ma okay ang lahat

sis! di naman yan aabutin ng taon, for sure matagal na ang 1mos. well sa fees di kita masasagot jan kasi hindi ko na tinatanong ang parents how much they paid.. hindi naman siguro aabot ng 3k yan. well better you prepare na din. God Bless..

I don't think this will make the kid legitimate. Sa kahaba haba ng proseso, you only changed the child's name. Mahaba ang process, and if I am not mistaken, it will take around 100k at least. Kasi may friend ako, gusto naman nya ichange yung sirname ng anak nya from the father's sirname to hers, iyan ang fee sa pag inquire nya.

Kaya uso dati kapag nabuntis ang babae, the couples immediately get married, para pag naipanganak yung baby, legit na sya agad at hindi sya ma consider na illegitimate.

Pero TS, is there a difference between legitimate and illegitimate these days?  Kasi naglipana naman rin ang mga illegitimate kids, parang wala din namang difference, unless you are thinking long term about having your kid getting more share of his properties kesa sa first anak nya from his previous relationship.

^the procedure i wrote will not make the child legitimate. But after the procedure, he/she will be legitimated by the subsequent marriage of his parents. Medyo magkaiba yun pero di na siya illegitimate. The kid will have the same rights as a legitimate child and the kid will have the same share in the properties of his/her parents in the future. As for the girltalker who is saying this procedure will not work. Well, i only want to help. If you do not want to believe me, then go ahead  pay a 100k to the lawyer who was asking for it. I, on the other hand, do not expect to get anything tangible from this. I answered her question just because i wanted to help.

Iba po yung process ng change of name sa legitimation. Iba iba rin po ang procedure depende sa situation ng tao. Legitimation of a kid does not require court action.

i am not saying as well na magiging legitimate ang bata thru that process pero i am pretty sure na when may acknowledgement napg father yung bata pwede na nya gamitin ang surname ng father nya. that's what we apply sa records namen sa school yun din naman kasi ang advice sa amen from the higher ups as well as NSO yun kasi agreement nila between DEPED/CHED with regards sa ganyan cases ng mga bata.. but in terms of legitimacy that's i'm not sure na.. better ask for lawyers opinion na..

Yun sa situation ng friend mo, kelangan talaga magfile ng case sa court at magastos nga. Bale icocontest niya yung tinatawag na paternity. Yun in effect ang gagawin para maalis yung surname ng biological father at palitan ng surname ng father.

Kung sinulat naman nila sa birth cert ng bata na ikinasal sila on a certain date prior to the birth of the kid, change of name lang ang petition.  At i aattest din ni mommy na wala talagang kasalang naganap at kukuha sila ng Cert of no marriage sa NSO to prove that.

So you see, iba iba ang situation depending on the facts given.

^ms fionnah325, search "joint affidavit of legitimation" sa google para makakakita ka ng sample form. and kung may kakilala kang lawyer, pagawa ka.

^ms beautyqueen, hindi po ikaw ang kinorek ko. Si girltalker2 kasi siya yung nagpost na 100k ang fee ng lawyer na kinonsultahan ng friend nya
 Mahirap kasi baka akala ni Fionah325 ganun din ang gagawin nya.sinabi ko lang na lawyer ako, para ma emphasize ang point ko kasi ang advice mo sa kanya magtanong sa lawyer.

^ sis, sa kabilang thread yung issue ng friend ko, baka masagot mo rin regarding traveling ng bata at nanay.

buti naman if the process 1-6 stated above will only take weeks/ few months.  Problem kasi I've lost confidence na in the justice system kaya para sakin, anything that would have to go through them would need a lot of resources from you - be it money, patience or pagod.

^ yes sis. magkaiba na surname namin ni baby. pareho pa din surname niya (sa dad nya) pero we are planning (me and the new husband) to adopt my son or wait na lang ng 7 more years (para 18 years old) so he can travel with us.

Why can't you travel with your son now? Hindi ba sa birth certificate nya naka indicate naman maiden name mo?

hi sis fionnah325, same situation tayo. 8years yung anak namin na last name ko ang gamit kasi yun din ang nasa birth certificate nya and yes, NA din ang nakalagay sa father name nya :D (parang iisa eksena natin huh) hehe

Last year, lang kami kinasal, January 2014. Ngayon ok na birth certificate ng anak namin. Tama si sis fionaapple, legitimated by the subsequent marriage yung makikita mo na naka"stamp" sa gilid ng birth certificate with his/her new name and last name.

Hindi naman kami gumastos ng malaki :) Usually may mga lawyer malapit sa municipality nyo. Legal din naman sila, like sa amin binayad lang namin is 2500.

Sobrang thankful ako sa sis ko na nag-ayos ng paper namin,OFW kasi kami pareho ni hub, siya ang nagpabalikbalik sa NSO Manila, sa Manila City Hall, sa amin sa probinsya.  Medyo natagalan lang kasi yung unang set ng docs na pinadala sa amin dito from sa municipality registrar namin sa probinsiya is kulang kulang. Tapos yung embassy dito parang ngayon lang makakapagprocess ng ganun (not sure ha) kasi dapat alam din nila na kulang ang document bago nila i-attest :)

This must be a Joint affidavit of legitimation. >>> Please make sure complete ito,dito nagpabalik balik sa manila city hall and NSO sis ko, meron nakakalitong docs dito, like Affidavit of Legitimation by Subsequent Marriage, Affidavit/ Acknowledgement of Paternity, Affidavit to use Surname of Father

3. Submit NSO certfcate  together with the AUSF to the local civil registrar. >>>sila ang magfoforward nito sa Manila NSO, pero pede din naman na ikaw na magpost nito, para mas mabilis. Like sa amin iniipon muna nila lahat tapos once a month lang yata sila nagpapadala sa NSO



Hindi ko alam kung nakatulong ako or nakalito...pero yan yung experience namin. Pag kasubmit mo ng docs, hindi mo agad malalaman kung may kulang or kung may mali, follow up mo sila. Bibigyan ka naman nila ng days kung kelan mo pede balikan eh or i-follow up eh :)

sis fionnah325, less than 3mos makukuha nyo yung sa inyo kung walang problema (yung sa min, twice nagsend ng requirements sa amin dito kasi kulang and may mali. Kelangan kasi namin i-sign yun plus ipa-attest sa Philippine embassy dito kaya inabot ng mga 6-7mos plus yung mga buwan na hindi namin na-follow up.)

Hindi naman sis, pareho kami working abroad ni hubby, sis ko lang talaga nagprocess nung birth cert ng baby namin sa pinas. Naalala ko lang pag ang mga docs requirement is issued sa labas ng Pinas, may ipaprocess ka sa Manila City hall. Manila ka ba sis or outside manila?

Authorization letter lang binigay ko sa sis ko.

*sis, konting tiyaga lang sa pag-follow up sa NSO... :)

^ manila kasi ako sis..nong pinuntahan ng dad ko binigyan siya ng requirements, isa na yong sa paternity yata yong sa sss daw dapat kailangan isama muna si baby sa sss ng dad niya,second dapat daw may makita silang prove na nsurname na niya yong sa baptismal niya lastly yong iinterviwhin daw yong parents para daw malamn niola na agree at okay ba sa akin na ipa apelyido ko si baby sa kanya...kailan mo yon girl yong sayo kailan mo ginawa i mean kailan inaasikaso ng kapatid mo?kailan ka ulit nangank sis?

sis fionnah325, parang dapat mas mabilis na diyan kasi direct na.

Yung sa min kasi Province - Abroad - Province - NSO Manila - Manila City Hall - Province - NSO Manila, yan yung parang route ng processing :)

Walang nabangit sa akin ang sis ko na kelangan ng interview, or kung may interview ba na naganap between her and registrar. Kasi meron naman Affidavit to use Surname of Father & Affidavit of Legitimation by Subsequent Marriage signed ng Mother and Father kaya wala ng dapat itanong pa sila kung okay lang ba sa atin(mother). Tapos Affidavit/ Acknowledgement of Paternity na si father lang mag-sign

Kinasal kami last year lang,January 2014, released ng NSO ang Marriage certificate namin ng April 2014, mga June last year din na namin nasimulan and by January or Feb ata ok na yung birth certificate nya,

2006 ang birth year ng daughter namin.
