Legal Property Stuff

Question fellow GT peeps..

Si brother ang nagloan ng house and lot, pero ako ang nagbabayad monthly. Meaning ako yung may intention to purchase the house.

Clear naman sa brother and SIL ko yung verbal agreement. Kaya lang brother is married and now about to legally separate.

What actions should I take para hindi masama yung house sa division of property?

sis, I presume sa brother at SIL mo nakapangalan ang house and lot though ikaw ang nagbabayad. Tama ba? Pagdating sa properties at nagkaproblema, verbal agreements are not honored.

Gawa na kayo ng deed of sale para mapapirmahan mo na sa kanila sis at kung may pera ka, kasi magbabayad ka ng taxes sa pagpapalipat, ipalipat mo na sa name mo.

Yes, the title is named sa brother and SIL ko kasi requirement yun sa loan niya.

I've been handling the transfer payments, taxes, etc. Medyo lost ako sa deed of sale. Kasi technically wala ako babayaran na ulit para iexecute yung deed of sale. Or mali ba yung understanding ko?

^Sis, kung gagawa ka ng deed of sale para mailipat sa name mo yung title ng property, kelangan mo parin magbayad. Parang bumili ka ulit ng lupa but probably without the actual payment of sale kasi ikaw naman na nagbabayad ng loan. You also have to coordiante with the bank para malipat yung mortgage sa name mo.
