What surname to use on birth certificate of illegitimate child

I am still married to my previous partner. But we've parted ways since 2007 and we already have our own partners.

I am about to give birth anytime soon  (live-in partner) and I just found out that I can't use my maiden name on my child's birth certificate because the civil registrar might sue me for perjury.

Should I declare my married name on the birth certificate? But that would give my child my previous husband's surname, correct??

I agree. Given that the child was conceived DURING your marriage to your legal partner, obviously, he/she will carry your husband's last name. You can have it fixed once you settle the issue with your marriage. Ganyan ang nagiging problema pag legally married, naghiwalay as in de facto lang tas nagkaanak sa iba.

when you fill out the form for birth certificate, it asks for your maiden name. put your maiden name. have the father acknowledge the child if you want the kid to use your his last name. problema lang is when challenged  by law, the kid is your husband's kid.  The kid will be entitled to your husband's estate.
To challenge this, your husband should file a petition to impugn the legitimacy of the child.  Pero sa totoo lang, hindi na ginagawa eto ng karamihan unless siguro may malaking estate na involve.

Question lang sisses, paano kung hindi totoong anak ng guy ang baby pero pinalabas nung babae na kanya yung bata? Pinapirma agad si guy sa birth certificate nung bata tapos after few months, nalaman ni guy na married pala si girl at possible na may nangyayari pa rin sa kanila. Ano pwedeng gawin? Pwede ba paalis ng guy yung surname nya?

Hi! ang alam ko, kapag ang bata pinanganak within a marriage, automatic by law na anak siya ng husband. Pwede nya siguro i-apela na hindi niya alam na married na si girl kaya niya tinanggap yung baby. or pwede naman ipa-paternal test. Im not sure how to revoke it though.

^yes sis pwede sya kasuhan pero alam ko based sa batas, ang dapat magsampa ng kaso is yung asawa lang nya. dito sa point na to, damay yung kabit nya na pinsan ko. kaso di alam ng pinsan kong married si babae, may kaso rin kayang pwedeng isampa sa kanya? thanks sa link sis!

currently im in this same situation. my daughter's father is not my husband. foreigner ang tatay ng baby ko. hinihingan kami ng embassy ng court order na hindi anak ng asawa ko ang anak ko, para mabigyan ng citizenship ang anak ko pareho ng tatay nia. my ex is very cooperative naman, nag file kami ng petition to impugn the legitimacy. pending pa ang case. although sa birth cert na anak ko, apelyido na ng tatay niya ang nakalagay.

So what's gonna happen to the husband? Nagkaanak sya nang hindi nya alam, o hindi sa kanya.

Pano ba mangyayari sa pagpasa ng birth certificate ng bata, ipapasa din ng wife ang marriage certificate nila? What if tinago ni wife na kasal sya? Maiden name nya ginamit sa birth certificate ng baby, with the current partner's signature as the father. Makikita agad ng civil registrar yun?

Pwede bang hindi muna nila ipa register ang baby? Let's say, may ongoing the annulment. Tapos papa register na lang pag tapos na yung annulment. Possible?

On that note, mas madali pala pag si husband ang nagka anak sa ibang girl as long as single si girl. Pwede nilang ilagay lang si husband as father then wala ng problema sa status ni girl. Tama?

Puede din gamitin ng baby ang surname ng Father kahit pa married sa iba. But the child remains to be illegitimate Kung walang maipakitang marriage certificate once born.

^^^ in the eyes of the law, yung bata ang tatay niya yung legal husband kahit hindi man lang sila nagsex ng wife niya. Until and unless na maputol ang tie between the huaband and wife ganun ang scenario.

Kung hindi idedeny ng father ang filiation niya with the child, ganun mangyayari kaai hindi pwede ang mother ang magsabi na iba ang tatay ng bata, hkndi pwede yung mother ang magdeny.

yes, legitimate child ng existing marriage. the law always favors the legitimacy until proven na hindi through a court decision.

what if di dinisclose ni wife na kasal sya? ilalagay nya na unmarried tapos pipirma ang father sa back page? what will happen to the wife? and what will happen to the husband? I think ganun ginawa ng SIL ko, she was married, wala silang anak ng mister nya, then naghiwalay, nagkaron ng bago, nagka anak, di dinisclose na married, yung bf nya yung nilagay na father. and mukhang wala pa naman silang naging problema til now. magkakaron ba ng prob yun if ever? Ongoing na din annulment nya with the husband.

I have friends and cousin na ganito ang situation. Issue siya talaga pag mag a-abroad kung kukuha ng passport at visa. Pero kung andito ka lang naman sa pilipinas hindi naman unless your husband wants to file legal case against you. Kaya may friend ako na nagtatagao wala siyang fb ayaw niya kasi malaman ng ex husband niya na may mga kids na siya now. But their annulment is ongoing na.
