Mga sis na currently transferring ng titulo. Matagal po ba talaga ang release ng CAR sa BIR? mag-3 weeks na yung sa amin wala pa din. 1 week dun ang status for signature pa din. Hay, ganun kabagal? Sa mandaluyong kami.

same here akala ko kapag bayad na h&l mo no more problem. ang hirap pala kumuha ng original title. and mind if i ask sis aquacharly..kasi na fully paid na namin ang house and lot namin thru BPI. BPI gave us a duplicate copy only sabi kuhain ang orig title sa Munisipyo. i called up RD sabi just bring the cancellation of mortgage from the bank, 2 valid id's and pay a reg. fee of 10% ng loan amount ng house. shocks 1m un so 100k pa ilalabas namin. ganun ba talaga un sis aquacharly?

Haynaku oo.  The bank paid to have the mortgage annotated.
Now, you need to pay to have the annotation removed. 

Be sure you get the Release of  Mortgage  docs from the bank, plus a statement of your payments (do not lose your receipts!).   Go over your Contract with the bank. Check if naka include sa list of docs to be released to you by the bank upon full payment -- the TCT.  The bank should have in it's possession kasi the TCT,  with the mortgage annotation.  Ngayon lang ako naka hear na xerox bigay sa yo.  It is a bank requirement the Owner's  Duplicate is in their safekeeping.

Most banks, pag ask ka for  Release of Mortgage docs -- may 2-digit thousand fees yan. Susko, but that's how it is.

Mag research ka -- why 10percent?  Just inquire with the LRA in your locality -- do not show your TCT copy muna.  Just say you may buy a property -- nang makita mo may bank annotation.  Get the breakdown for the 10percent.  Ask:  OR for the entire amt paid? Hahaha baka  parang BIR na din ang LRA kung mag issue ng receipts.  Susko. 

Tell us here how much they charged you ha. 

Technically, you do not need to have the annotation removed. Basta may Release of Mortgage docs ka hawak. Puede mo pay or have your buyer pay for it later -- should you decide to sell later on.

^ sis aquacharly, it's not xerox  but it's owner's duplicate copy of the title pala. yes the bank gave us the cancellation of real estate mortgage. ok i will take note of all the things  you've said and will get back to this thread when we get hold of the original title. thanks!

RED RACK:  thought so!  The Owner's Duplicate IS your original TCT.  So, The bank did give it to you.

After you've completed the requirements for the cancellation of the mortgage annotation, & paid the fees; the LRA will type a paragraph on your Owner's Duplicate, as well as the TCT permanently stored in it's files (nowadays computerized) to state the mortgage is cancelled.  Your TCT is now "clear & clear" as the brokers label it.

average time talaga para sa release ng CAR is two months, me SOP na yun na minimum ha. Pag gusto mo marelease ng 2weeks to 1 month me extra SOP ka na kelangan ibigay, sa examiner pa lang meron na. This is an actual (repeated) experience.

hi mga sis! I need advice, may umutang kasi sa tita ko at yung lupa yung ginawang collateral. the original title is with my my tita and mukhang hindi na talaga mababayaran yung utang. alam nyo ba kung ano ang steps pano malilipat sa name ng tita ko yung title? plano kasi nyang ibenta na lang yung lupa at syempre, di nya mabebenta yun kung wala sa name nya. does she still need to pay capital gains tax, etc eh defaulted loan yun? thanks in advance.

I think you already sold some property. Who paid for the annotation removal?

taon ba talaga inaabot ang paglakad ng transfer of land title from seller to buyer kapag may problema ang part ng lupa?

consolidated kasi yung lupa (4 na hati) at yung gitna doon, hindi pala updated ang tax dec kaya pina auction daw ng city hall. may nag bid (modus daw ito sa city hall) at tinubos na namin sa bidder (kahit na dapat seller ang maglabas para dito).

next step is nagbayad na ako ng transfer tax nung december pa.

2 years na inaayos ng tiga lakad itong issue na ito. ganon katagal ba talaga??

sis ang binanggit mo is transfer tax or transfer fees. transfer fees ba sa tax declaration or transfer fees sa regiater of deeds?

kung transfer fees sa register of deeds last december dapat nakalabas na ang title mo this feb. yung tagal kasi nya magrarange ng 1day to 2 weeks.  specially now computerized na ang ttling sa mga register of deeds so hindi na sila mawawalan ng form (form ng titulo na kinukuha pa nila sa LRA sa east avenue, dati kasi ito reason pag natatagalan maissue ang title, kesyo wala form)

anyway, roughly ito ang steps:

(hala nakalimutan ko post mo, sa phone lang kasi ako reply)


1. deed of sale or
bilihan
2. payment of capital gain tax sa BIR
needed docs:
a) payment of property tax (amilyar)
b) original copy of title
c) deed of sale referred to above
d) TIN of sellers (and buyers na din)
e) SPA to process sa BIR (kung hindi seller ang magpipila which is usually hindi naman na talaga kasi bayad na sila wala sila care na
f) dito samin himihingi din ng acknowledgement receipt ng seller na natanggap niya ang pera, which i think is superfluous kasi nakalagay naman sa deed of sale diba
g) tax dec
---- dito ka siguro nagkaproblema right? kasi yung isang tax dec na auction tapos ni redeem mo pa. kelangan yung tax dec consolidated na din, siguro ito yung transfer fees na binayaran mo? para yung tax dec ma consolidate na din?

usual length of time para ma release ang CAR (certificate authorizing registration) sa BIR is 2 weeks to 3 months.

i can't remember kung me iba pa kelangan pero ito yung mga kelangan.

pag released na ang CAR, next step is:

3) go to register of deeds, present the Deed of Sale, CAR from BIR and te original
copy of title

pag na issue na ang title, optional na ang:

4) go to assessor's office presenting the deed of sale again and the original title, para mailipat naman ang tax dec sa pangalan ng buyer.

i say this is optional
kasi puwede naman pag ibebenta ninyo na (ang property) saka ninyo papaltan ang tax dec. ideally the new title should be presented within 30 days sa assessor's office pero since wala naman penalty fees sa late presentation at transfer of tax dec e bihira gumagawa nito.

Hi mga sis. Ask ko lang kasi bumili ng lupa tatay ko pero ipinangalan sa ate ko na may asawa na nakaabroad. Kasi sabi nila unti unti nila babayaran kaso di nila nababayaran til now. Ngayon ibebenta na sa iba ang lupa, may buyer na din. Pero sa title of land nakalagay na owner is 'MY SISTER',married to 'OFW HUSBAND'. Pero nung bilhin yun ng tatay ko ate ko lang ang pumirma. Ngayon bang ibebenta kelangan pa din ba ang pirma ng asawa nya kahit d naman sya pumirma nung bilhin?

I have  bought properties from banks and/or owners with bank annotations.
Flipping properties is how I feed my secret accounts.  Buying properties is a regular part of our personal/family & business investment strategies.
  I buy properties with TCTs with annotations. But I never hold onto properties nor turn-around properties with annotations on its TCTs.  Why??  To avoid any future complications -- see, it isn't only bank mortgages that appear as annotations. All kinds of liens appear as annotations.  Whatever the nature of the annotation, nothing beats a clean title if you own the property. 

Who pays for annotation cancellation? 
 Depende sa usapan. ako sa mga Deed of Sale, I specify the seller gives me the title clean and clear of all encumbrances. So forewarned sila. Bago ko pay -- Napa cancel  na nila annotation.
But usually, hindi nila magawa for lack of funds or time. So I parallel move - pa estimate ko and get a written note as to fees for the annotation cancellation.   Upon payment to seller at meron annotation pa -- deduct the estimated cost plus konti processing fee (my staff attending to it must be paid plus expenses).   TAKE NOTE:  better be sure if you are buying, that all docs required for annotation cancellation are complete and in order.   

Ang buying or selling of real property is a case to case basis, subject to negotiations.  What is impt at the start is that you are aware of all expenses to be encountered, the govt rqmnts and procedures ( and facilitation/under the table fees. Lol), and you are familiar with the documentary requirements.  It pays to pay for legal assistance.

Sure there are "generally accepted/done practices". But what it boils down to is: how desperate is 1 party to sell/buy?  That is where the variations come in. 
I have bought properties where I worked and paid for clearing the title of encumbrances, or even ejected illegal tenants thereon -- why go over and beyond industry practice? Eh kasi very desirable the property, or the price was low (as when the offer of cash at a lower price is what a seller grabs instead of the better price on installment or payment dependent on a loan release.  ).  I wasn't gonna quibble nor turn into a deal breaker a little thing like an annotation cancellation.  (Or illegal settlers.  Dati takot ako; nowadays, sanay na ko. It's just a matter of time & expenditures.).

So there, who should pay for the annotation cancellation?  Sino hindi makatiis to sell or buy? Sya Yun. :)

Ako sasagot sa yo puede? Based on my personal experience --

Yes. Kelangan her OFW husband signs. 
When I buy properties, I insist the spouse signs too on the Deed of Sale -- yun advice ng lawyer ko. Sino ba ko to know better?

Another signal that the husband must sign -- banks require that of borrowers. 

So, talagang nowadays, spouses must sign.

But well - may mga clueless buyers; or buyer na may confidence  sa integrity ng seller.  Kung your buyer does not demand it, eh di better for your sister.

How to go about it? Fed-ex Deed of Sale, all copies to the OFW husband to sign. 
Provide the Buyer with machine-copies of his passport and at least 1 more govt-issued ID with his photo and signature.

Hi mga sis, sana may makasagot. May house and lot kasi ako na ni-loan sa pag-ibig last 2011 pa na-approved,may mga late payments ako but now, up to date na ang bayad ko. Gusto ko po ipa-assume nalang sa brother ko yung bahay. Member po siya ng pag-ibig and eligible na din for a housing loan. My question is this: Kaya ko kasi ipapa assume ang house is because gusto ko mag purchase din ng bigger house and lot. Pwede na ba ako mag loan ulit sa pag-ibig once mapa assume ko na yung unang loan ko? If not, my plan B is this: hindi ko na ipapaassume sa brother ko yung house ko, instead siya ang mag loloan ng house na gusto ko. In the end, mageexchange kami ng property. Any advice on the matter? Thanks in advance.

mloveg regarding condo, i think we paid 30k for capital gain tax. yun lang pagkaka alala ko na binayaran namin. so ipapa assume balance mo ang condo tama ba?

^ yes, tama. Pwede ba manegotiate yung amount ng transfer fees? Kasi they're charging me 50k kasi technically di pako related sa family ni fiance ( nakapangalan kasi sa brother niya yung condo pero si fiance ang nagbabayad. Di rin pwede itransfer kay fiance kasi di siya qualified for a loan)

^ay hindi ko sure sis kung negotiable. pero iba iba yata ang rate base sa zonal value. and ang nagdidictate ng price is BIR (capital gain tapos may documentary stamp tax pa yan). then, need din mabayaran siya in 60 days. kasi may surge charge na yan pag na-late payment ka.
i hope someone from the real estate/BIR could give their inputs :)
