Separated but husband won't file for annulment

It's nice to be back here.

After years and years of heartache, frustrations, pain, disappointments, my kid and I left our house without anybody knowing it (my husband then was working overseas) for the fear that my ex-husband's family will keep my daughter and I could not take her with me (due to the threat I got from him). We moved to another country and I found employment and since then have settled well.

I let my ex know where we are (but not the exact address) and in 2013, he tracked us where we are and actually came over to see his kid. Everything went well with him and our child but not with me.

Fast forward....2014, he visited again and we were able to talk - that we have to be civil for the sake of our child. He told me that he has a girlfriend since 2011 (months after we left). I asked him if we have to get an annulment, he said, no....marriage was just a paper, the most important thing was your relationship.

He doesn't want an annulment. He has a girlfriend and I am tied to the legality of our marriage.

HELP, please.

I was in a similar situation.  It took me 6 years before my ex husband finally agreed to divorce me.  And when I asked his friends kung anong nakain ni ex and pumayag na to get a divorce, his girlfriend during that time wanted to get married na.  So laking pasalamat ko sa girl na yun because finally I got the freedom I've always wanted :)

^^ sis if you are in a country na may divorce sa pagkakaalam ko may tinatawag na uncontested divorce. Ito yung ipa file mo lang then kailangan mo lang ng isang tao na magbibigayg letter sa ex mo personally tapos yung taong yun ang pipirma sa papers to prove na nakarating talaga yung letter sa ex. Tapos yun mapa process na ang divorce

About annulment naman, puede mo naman siyang i file kahit na ayaw ng ex mo yun nga lang hahaba ang proseso pero do you think may time ba sya to attend hearings? May property ba kayo na kailangan i settle? Or yung about sa anak nyo lang? Kung below 7 yyrs. Old naman ang bata at proven naman na maayos kang nanay siguradong sayo ibibigay ng court ang anak mo. Yung ibang below 7 na naalisan ng karapatan ang nanay eh yun lang mga pabaya na ang tingin ng court eh magiging maayos ang kalagayan ng bata sa ama.

Sis latte, thank you. Di ko lang kabisado dito sa bansang eto ang kanilang law about such thing. I might go to Phil. Embassy to ask for possible options.

Kinasal kami sa Pilipinas so annulment kami babagsak talaga. May mga properties pero not after them, just the financial support for my child. She is over 8 years old, and she is well provided in all aspects.

Would it be a strong ground against him not to have the custody - he started having the relationship with his girlfriend now even before we separate?

Sis ang pinaka common na ground for annulment is psychological incapacitated, bale puede sigurong isa yan yung may extra marital affair sya. About sa custody sa bata hindi ko alam eh.punta ka dun sa annulment thread sis marami ka matututunan doon. May mga sis din tayo doon na familiar sa ganyan. Pm kita nun lawyer na kakilala ko.

kailangan mo ba talaga ng annulment? para que? ::)

kung nasa ibang bansa ka, kung kailangan mong magpakasal, wala namang habol ang batas ng Pilipinas sa yo. kung tutuusin, sya nga ang dehado at ang kinakasama nya (kung nandito pareho sila sa Pinas), manatiling kabit ang GF nya. sakaling mapag-tripan nya mang magpakasal later on, may tulog sya, baka ma-bigamya lang sya. ;)

Matagal na pala itong thread na ito. Kumusta na si TS kaya?

TS, I think it is important to know the laws of the land where you are. Pero may rules iyan kung maging "resident" na ang status mo kung asan ka man, baka puede ka na magfile dyan ng divorce.  I think it is faster.

Another option nga, is file an annulment sa Pinas. Kung ayaw ng hubby mo, ok lang, ikaw naman ang mag f file, yun nga lang, ikaw din gagastos. And you might need to appear din sa court. But the most important thing dapat hindi na sya magcontest at maging silent lang sya para di tumagal yung kaso.

Regarding custody naman, same case. Kung matagal ka nang resident dyan sa kinatatayuan mo, you can also file for custody of your child.

If there's divorce in the country you are in and you became a citizen, you can divorce the husband even if the marriage took place in the Philippines.

^ The divorce would be honored anywhere except in the Phils. So pagdating sa Pinas, you still have to go to the courts to make Phils recognize that there is a divorce filed and therefore the court should grant the nullity of the marriage.

^There's a law in the Philippines that says something about spouses divorced by the non-Filipino citizens. If the TS is not a Filipino citizen anymore, the law in the Philippines doesn't apply to her. So, if she is living abroad where there's divorce and she is now a citizen of that country, she can divorce the husband who is in the Philippines.
