What is your Opinion about PRENUPTIAL AGREEMENT?

What is your opinion about pre nuptial agreement? My fiance ask me if it is ok with me, if we arrange a prenup agreement. Syempre isasagot ko ok lang...ayoko naman maging issue pa yun sa kanya. Pero deep inside masakit pala kapag sinabihan ka ng ganun. Naisip ko tuloy baka akala nya habol ko pera nya. I am financially stable na din naman. Anyways just want to hear your side/opinion. Thank you in advance.

^Hi thanks sis, yup open naman ako about it...it so happens lang na masakit pakingan in reality.
I forgot to mention me anak nga din pala sya...nasabi nya lang na to protect his son. Ako naman ok, pero for me naisip ko lang. Since ok naman sa akin ang prenup...il go on my own and di ako makiki alam sa business na kung ano meron sya ngayon., even he insisted me na tulungan sya sa business nya. Ipokrita ko naman kung sabihin ko sige tulungan kita sa business mo pero in my mind nasa isip ko wala ako proteksyon dun kasi kasama yun sa prenup, lahat ng meron sya. So better naisip ko, ituloy ko career ko at business ko and prenup din sa part ko kung ano meron ako at mamanahin ko.  Since yun naman gusto nya.

 And she told me i should get a prenup kasi need ko daw i-protect anak ko. Like mas madami ako inheritance kesa sa kanya.



maam di naman po masasama as conjugal property yung mga property na dadalhin mo after marriage kung meron kang anak, and yung mga mamanahin mo kahit ala pre nup.

tama si amethyst tanungin mo kung bakit kailangan, masakit talaga pag sinabihan ka ng prenup.

wala naman kaming si-nign na prenup agreement ng hubby ko before we married, pero i won't mind signing one BUT i will have my lawyer take a look at it and explain it to me in great detail bago ako mag-sign.

minsan kasi pag dumating sa oras na nag-aaway na ang couples at gusto na maghiwalay, nag-iiba ang ugali, parang ibang tao na. ok na ring may prenup para wala maraming usapan, all is written in black & white.

My take on this.. Its okay... Besides like what you said you are financially capable naman so just sign. I know nakakahurt ng ego yun but i wont let it affect my relationship just because i was asked to sign prenup. I should know.. :) i dont mind at all..

Hmmm.. YES!!! Ewan ko maybe because it's security. Ako nag ask din ng pre nup kahit na zero balance ako. (What I mean is he has more money than I have :D) One way of saying I respect what you have and respect what I have (and my FUTURE BANK Account $$$$$) LOL just kidding. But seriously it's a YES. Dont make it a big deal.. I also agree with Amethyst028. Ask him why.. Dont be scared to ask kase asawa mo na siya soon. 🙏🙏🙏

I agree these are logical & foster orderly financial arrangements... These are ok... BUT, I have certain "qualifiers".


1st, ok if it provides that assets brought into the marriage (earned & inherited) & to-be inherited assets REMAIN under the sole ownership and control of the spouse owner.   BUT -- the earnings from such assets DURING the marriage --  is conjugal/shared. 
When 1 spouse dies ahead, these assets should not be part of the conjugal estate -- so that the interests of other people are protected or not unfairly accommodated. 

Ex. If may mana akong building, it stays my property forever.  BUT, All rentals during the marriage -- is ours both/conjugal.
BUT, should ex. He drop dead -- that will not form  part of our conjugal estate subject to distribution.  kung may illegitimate sya --  oo, may share sa kanyang properties/fruits of his labor -- but hello! not a cent of what I inherited or acquired  before we married. 

Anything acquired/accumulated during the marriage, for personal/business --quesehoda which spouse made it happen or not -- all conjugal property.  IMO, IF the pre-nup says otherwise --  run away, run away.

(1) Property acquired during the marriage by gratuitous title (by donation and by testate/intestate succession) by either spouse, and the fruits as well as the income thereof, if any, unless it is expressly provided by the donor, testator or grantor that they shall form part of the community property;

That's what a pre-nup's for, right?   
You state therein that what assets you bring into the marriage remains yours -- of course, you gotta support these with the appropriate/logical/proper documentation, and the Pre-nup.  That was my example why pre-nups are ok.

For marriages done on or after Aug 3/1987 (Family Code)

INHERITANCE acquired DURING the marriage is exclusive property.
Inheritance acquired BEFORE the marriage goes into the conjugal pool BUT it CAN remain an exclusive property if you both   agree otherwise (that it remains exclusive to the 1 who inherited) &  put in IN THE PRE-NUP .

ANYTHING PUEDE as long as in the Pre-Nup.
IF no pre-nup -- everything is conjugal.  .

If he won't suggest it, I would since I'm all in for this. 
Since kami naman magdradraft ng pre-nup I think it will be fair and consented naman so why not?  At least mas clear yung financial terms ng marriage and after.
