Obligations after annulment

Mga sis can you give me some inputs about annulment? yung brother ko gusto na nya i-annul ang marriage nila, they have one kid which is 2yrs old pero 2yrs. na rin silang hiwalay and may sarili na silang partner. how much pinakamurang annulment? How much lahat magagastos? As far as i know sa batas required ang father magbigay ng child support eh ayaw ng brother ko.. Ano kayang magandang reason para hindi si brother irequired ng child support since yung x wife nya may asawa na. Ano kaya magandang ground para ma- annul sila? Yung iba daw kasi na annulment once na aaproved na di na pwede mag church wedding gusto ng brother ko yung pwede pa siya magpa church wedding. Ano kaya magiging obligation ng brother ko pag naannul na sila? gusto ko kasi masagot lahat ng tanong ng brother ko since magulo isip nya. Thanks mga sis! :)

Ok, what I say here under is as far  as I know --  hindi ako nag pa annul but 2 brothers have, 3 friends have, and 1 employee...

It is now very hard to get an annulment coz dati na abuse. Kaya we need a Divorce Law, really.

Usual reason: psychological incapacity of 1 or both spouses.  Usually, kung sino mas hot magpa annul says:  sige, ako yung kalokerz.
Minimum cost: 450thou. Ang mahal? To some, it is cheaper than a funeral/dying - so, puede na rin.

Yes, with or without an annulment, a father SHOULD give his biological child support que with or without another partner/FUBU/BF/whatever his ex wife/partner/lavandera or 1-fck-standng-room-only pokpok biological mom has living with her now. 
Please get it into your brother's cocote that responsible adults take care of their  offspring/s even if the relationship that spawned such went kaput.
Please do not kunsinti him to be madamot --  hindi kasalanan ng bata the failure of its parents'relationship.  Plus, the kid has basic rights (may batas to cover that, paki research:  right to shelter, , food, education, etc etc etc)
So anong good reason to not give child support?  He is incapable of working & has no inheritance/trust fund to draw funds from; he is in prison for years....

The Church has its own tribunal or legal court.  If your bro gets his marriage annulled there - he can get married in church again.  The people I mentioned I know with annulled marriages. -- not all remarried.  Those who did, did it civilly & had no/a Christian/Buddhist marriage ceremony.  (Hindi na carry ng pagka tsismosa ko to inquire about their cases pending with the tribunal, if they did file.  Sorry)

Ano kaya magiging obligation ng brother ko pag naannul na sila?

CHILD SUPPORT is one --  unless his ex-wife says no need, in court. 
Plus whatever else the court will decide is his obligation.
Such as,  Kasi usually hati sa properties -- so obligated your bother to liquidate/turnover

why does your brother not want to pay child support? dahil may bago ng partner yung ex-wife? so balak nya na umasa sa new partner ni wife na buhayin yung anak nya? darling, regardless if they are annulled or not, he has a responsibility to the child. hindi coterminus sa marriage ang pagiging tatay. so he needs to man up and shoulder the responsibility. unless he is incapacitated or dead, which we assume he isnt since gusto nya pa magpa-church wedding ulit. he doesnt have to pay spousal support or alimony naman.

yes, for an annullment, you need to pay up. if both of them want the annullment, pagusapan na lang nila kung sino ang magfi-file at paghatian ang gastos. it's quite expensive. baka you pay a bit more than 450k pa if you want to expedite the process. but as far as i know, as long as they're annulled, they can remarry sa church kasi an annullment basically means the marriage never existed.

From what I know, separate ang pag pa annull sa state at sa church. Bale 2 contract kasi yung napipirmahan natin pag nagpapa church wedding. Nag fi-file tayo ng marriage license sa munisipyo then sa church naman may application din na separate with various requirements and pinapasign tayo during the ceremony, so dalawang contract talaga yung dapat ipawalang bisa. Mas mahirap pa yata magpa-annull sa church. 

As for the child support, if the child is not his then mayron syang reason not to give support. Pero kung anak naman nya eh wag nya takasan ang obligation nya. Wala ngang kasalanan yung bata.

Thanks mga sis for enlighten me. Si brother ayaw nya magbigay ng support kasi di daw nya talaga anak yun since nahuli nya si ex wife na may isa pang bf that time. Meaning tinu-time siya kaya bitter si brother. After nilang maghiwalay napregnant si ex wife kaya di malinaw sa kanya.. pero I already told him suportahan parin nya pero hindi kasi naging maganda naging hiwalayan nila..

so your brother is willing to pay high for this annulment pero konti pera para sa dugo't laman nya ayaw nya? annul o hindi, your brother has to face his responsibilities. i think kapag ngpa-annul sya, mas lalong maoobliga sya to pay for the child. why? because the court is more inclined to protect the welfare of the kid. pwede tingnan sources of income nya and the court can decide just how much he needs to give. if the wife is wise, she can ask for 50 percent of your brother's salary. fair enough.

anyway, he can't marry sa church kahit mgpaannul pa sya. complicated ang process ng church annulment from what i know.

if he wants to really call it quit, support the kid first. malay mo maawa pa yung wife sa kanya at makipagcooperate na sa process of annulment.

katawa naman si brother mo, gusto takasan ang child support, from what i know, kahit pa ideclare nya na no income sya at inutil to work, pati sa ninuno ni brother mo pwede mag seek ng child  support. meaning una, kung may source of income o ariarian ang lolo at lola ng bata (your parents) or great grandparents.

kaya kung duda talaga bro mo na hindi nya anak yun, he must prove it din. kasi hindi lang yun sa child support, pati pag nagkaroon sya ng future family, kahati ng mga anak nya yung kid nya from previous marriage. saka ang pagkatanda ko, may time limit yun, parang 5 years lang yata from the time of discovery.

pero kung anak naman nya yun talaga, aba e mahalin naman nya no.

as for the church wedding after annulment. hindi ko sure kasi i have heard a couple(guy annulled 1st marriage) nagpakasal sila sa protestant church na lang. hindi ko masyado magets kasi hindi ako katoliko e.

naku sis. thanks! bitter kasi talaga si brother pero pinipilit na ng buong family namin na suportahan ang bata. Ayaw namin idaan pa sa DNA nakakaawa naman yung bata. Since ang gusto kasi ng brother ko ipa DNA.

If he wants DNA test then go for it. Additional gastos nga lang plus it takes weeks I think to get the results.

kung yun ikakapanatag ng loob niya then go for a DNA. mas kawawa naman yung bata sis kung habang buhay eh hindi siya kikilalanin ng tatay niya dahil sa hinala niya na hindi sakanya yung bata. and if ever tama man yung hinala ni brother mo na hindi siya yung ama, ayun pwede niya ipakita yung DNA sa court as proof. tapos problema niya sa child support.

Do the DNA!.  Ano naman nakakaawa  sa bata don?  Buti nga with finality malaman ninyong lahat  kung my obligation brother mo or wala.
Sooner or later magsasawa din kayo ka support sa bata & ex-wife.  So better settle now the issue of paternity parang ang question mark nyo lahat later on nalang is how to provide adequate support for the kid.  Wala ng haka haka isip isip duda duda pa.   Do the DNA!

go for the DNA, mas malaks na ebidensya yan for annulment...pwede nyang idahilan na napilitan lang syang ikasal dahil sabi buntis or what...malay mo umepek hehe

if he plan to have future kids din he must make sure na anak nga nya yun. hindi na rin ganun kamahal dna, ang alam ko meron na dito sa pinas. yung high school classmate ko kasi yun nag pa annul at nag disown ng kid. forgot ano legal term dun. i didnt get the direct info kasi na chismis lang sakin. hehe.

kasi nga diba legally anak nya yun, annulment will not change the legitimacy of the kid. and entitled yung kid for child support and future inheritance. kahit pa ipa dna nyo at maging negative ang results tapos hindi nyo aayusin sa korte yung pag disown sa bata, legally anak parin nya yun, walang mag babago sa rights nya. tapos yun mga may time limit from discovery.

maganda nyan habang bata pa yung kid. para kung papalitan man yung apelyido nya and all.

madaming gastusan pag dadaanan ni bro mo.

if mapatunayan na anak nya yun naman, obligations after annulment e di syempre child support and somehow maging ok sila ng mom nung bata, kasi connected parin sila.

i recently filed an annulment and i paid 120K (friend kasi siya ng friend ko) it will take NOT more than a year daw.

i also filed Child Support so before/within/after annulment he has the responsibility to support my kids. Maganda na ang law natin nowadays sa Child Support, it is a criminal case so kapag hindi siya nagbigay he can be jailed.

If I were you/family of your brother, go with the DNA kahit ayaw ni Brother. maawa naman kayo sa bata kung sakaling anak talaga siya.

Honest question here, please clarify: won't an annulment actually change a child's legitimacy? Since an annulment voids a marriage, i.e. a marriage did not take place at all, then the child becomes an illegitimate child?

I am not clear on the law regarding this so I'd appreciate it a lot if someone shed some light on this. This is one of the reasons why many people are pro-divorce.

ah ok i stand corrected. kasi ang tinatanong ko pala dati is ang ground psychologically incapacitated. family code art. 54. hindi mapapalitan legitimate status ng mga bata.

as for other grounds, sa hatian ng properties meron na yata sila advance legitime, but still they have the right for child support and future inheritance.

do the dna. hindi nakakaawa yung bata pag nag-test. it's not his fault. ang pinagdududahan eh yung nanay. the process doesnt have to be long drawn out and dramatic. just do the test and that's that. mas masaklap kung maririnig pa ng bata na ayaw talaga syang i-acknowlege dahil baka iba ang tatay. then get the annullment.

I agree! Go for the DNA.. hindi nakakaawa ang bata if ipapaDNA, habang bata pa sana. Mas nakakaawa ang bata if forever syang idedeny ng father nya at forever tatakasan ang obligations sa kanya.

yummy05, i'm confused as to who's looking out for who.  you said your brother wants DNA testing to be done while the rest of your family don't.  why can't your brother insist on the DNA test?  i would've thought that if anybody should be resisting, it shouldn't be the rest of his family (you guys) but his ex-wife.

i say shell out the PHP 15,000, get the DNA testing done, and have closure for everyone.
