What are the mandatory work benefits?

I just wonder lang... hopefully those working in the legal department could answer this.

Are the following mandatory whether you are locally hired as a contractual or as a regular employee?

1) Philhealth
2) SSS
3) PAGIBIG
4) taxes
5) sick leaves
6) vacation leaves
7) paternity leaves
8) single parent leaves/benefits
9) maternity leave

Ano pa ba ang iba pang mandatory benefits that I've missed in the list?

Kasi I hear stories from friends who are getting hired (usually by small offices/businesses or companies) but are not given such benefits.

If these benefits are not given, then what action should the employee do? Sue the company? By himself or with a group of employees? Or just a simple reporting to the department of labor would be enough?

Mandatory deductions kasama dapat sss, taxes, philhealth and pag ibig. Pero usually inaapply ito sa regular employees pagcontractual some make arrangements na ideduct and iremit.

For the benefits naman required naman na ibigay yung maternity and paternity provided pasok sa conditions provided by law. Solo parent leave naman based sa mga sumubok mag apply na kilala ko dapat justified.

Service incentive leave based sa company policy kung sama recollection ko.

Kung sss yung di naeeremit mag inquire and reklamo sa sss. Same goes with other agencies.

Ah, so kung contractual pwedeng walang SSS, Philhealth, etc? Interestingly I was paying for those in a past job, when I was working at a government agency (GSIS, instead of SSS ang binabayaran ko).

I didn't get any service incentive leave from any three jobs I had when I was employed way back 2007 and before. Mandatory na yun ngayon?

Iba na kasi trend ngayon sis. In a way, nagkakaroon ng circumvention.  Like in "Contract of Service", pinapalabas na walang employer-employee relationship.  The employee receive the whole amount in the contract on the terms stipulated therein.  So kung walang instruction or request sa employee na bawasin nyo specific amount (I supposed ganito, opinion ko lang), ibibigay ng buo yun without any deductions.  Responsibility na ng employee to remit his or her contributions to the government agencies like SSS, Philhealth, BIR.  (Tingin ko pwede mo na pakiusapan HR or accounting section ng company to automatically deduct this and remit para di mo na trabaho yun, though yung iba ok lang di magdeduct kasi wala nga namang tax di na lang nila iremit, kung di masilip e di swerte, kung masilip ng BIR, tax evasion naman, problem..)

Di yata mandatory yung SIL, depende yata sa company policy na existing or kung nagbibigay sila noon, nabanggit ko lang kasi for tax purposes, minsan exempted to a certain extent.

Basic Benefits under the Labor Code
1. SSS - 70% shouldrered by the employer and 30% by the employee
2. PhilHealth - 50% shouldered by the employer and the remaining half by the employee
3. Pag-ibig -100 pesos/ month from the employer and the employee
4. 13th Month Pay - all Filipino employeees are entitled to this regardless of the nature of their employment
5. Service Incentive Leave - employee who has rendered at least one year of service is entitled to a yearly 5 days SIL with pay. this will not apply to thos enjoying vacation leave with pay of at least 5 days already. Labor code treats vacation leave and sick leave under the same category as SIL.
6. Meal and Rest Periods - 1 hour break and rest periods not more than 15 minutes on an 8-hour work day. Rest period of not less than 24 consecutive hours every 6 consecutive normal work days.

Other mandated benefits
1. Night Differential
2. Overtime Pay
3. Premium Pay
4. Maternity Leave
5. Paternity Leave
6. Parental Leave for Solo Parents
7. Special Leave Benefits for Women
8. Holiday Pay

Well siyempre may rules, restrictions and exemptions sa mga mandatded benefits especially if you are working for a BPO company

My husband went to Pag-Ibig this afternoon to get his list of contributions kasi kailangan sa new job niya. Only to find out na yung previous employer niya e 1 month lang nag remit sa Pag ibig. Malaking company ito and manager si hubby dun. I told him to call the Payroll department. Mukhang nagulat daw nung sinabi and pinapatawag siya ulit. We will also check sss, philhealth and bir kung may contributions siya. hassle siya kasi mag lo loan kami ngayon sa Pag ibig for housing. And plan namin na si hubby na kasi I'm planning to resign this year.

I consulted some legal advice and sabi mandated daw talaga yun. We will give them a week to resolve this issue or else, magpapadala kami ng letter of complaint sa may ari. For sure maeeskandalo ang company. Sana ma settle na to agad.

me too, sis yan din ang tanong ko.. kasi kami ng officemates ko eh wala ring benefits maliban sa 13th month pay (3 lang kami plus mag asawang boss namin)..

I attended a seminar by DOLE (Department of LAbor and Employment) last May 2013. Ito yun sinabi samin ng DOLE officials:

regardless kung contractual or regular ang employee, and regardless on what kind of business ka (corporation, construction, hardware, cafeteria sa tabi-tabi) mandatory ang SSS philhealth and pag-ibig. kung ayaw daw sundin ng employers, ok lang. pero kapag kinasuhan ng employee ang employer, laging talo (Based sa mga cases na nahandle nila) ang employer. if less than 5 employees kayo, pwede wala niyan BUT you have to register sa city hall niyo. i don't know ano tawag dun sa ireregister niyo, but kailangan nyo magregister para ma-qualify kayo dun sa bracket na no need to give those (sss philhealth pagibig, you dont even need to follow the minimum wage) to the employees. and depends din sa kind of business niyo. kasi kahit 2 employees lang kayo, pero ang business niyo is earning a certain amount of income per month (forgot how much) or your clients are not the end-user daw, you still have to provide those required sa mga employees niyo.

maternal required din. paternal din. tapos 1 hour lunch break. yan yun main na pinagusapan namin.

The government can sue that company so dapat talaga umikot ang pwet nila.

Mga sis, my suggestion is to ask your HR/ boss if you have any questions regarding your mandatory benefits. Wag masyadong matapang at report agad sa DOLE.  One of my colleagues' SSS maternity pay out or kung ano man tawag dun, got delayed sa SSS and ngayon lumabas na.  Don't sweat the small stuff, pero yung basic na SSS, Pagibig and Philhealth dapat nga meron nun.

Are seasonal workers entitled to holiday pay? We recently hired 3 persons. Our client contracted us to do the folding, arranging and sorting of their marketing materials, (flyers and giveaways etc.) thus we hired them. we just want to know if they should be paid on a regular holiday. Also, we give them lunch and merienda c/o us.
