Yung bahay na tinitirhan naming ng asawa't anak ko ngayon is under the name of my parents. Gusto na ipalipat ng parents ko ang property na ito under sa name namin ng asawa ko.

Saan kami mas makakamura, pag Deed of Sale ang gagawin , or Deed of Donation?

my mom said better if deed of donation kasi less taxes, less hassle...that's the advise that she got from my uncle who's a lawyer & another uncle who handles PAG-IBIG transactions...

Sisses, may idea kayo how much aabutin if DOD and DOAS? Sample computation? I know it depends on the value of the property pero at least mga what percentage?

I've been googling pero parang ang laki masyado nung nasa BIR website.

Alam ko there are possible deductions pa. Kasi kung doon ko sa BIR website ibe-base, parang ang laki ng babayaran ko.

tinaas na din kasi nila taxes sa dod kaya halos pareho na lang gastos. if dod, then i donate sa yo (lang) ng parents mo after you got married, that will be your sole property and di conjugal.

TSP (Total Selling Price)
- can be derived from these 2:  seller's price or zonal value whichever is LOWER

City Treasurer's Office (City Hall)
1. Transfer Fee
- 0.75% of TSP

BIR
1. Capital Gains Tax
-6% of TSP in the Deed of Sale or BIR zonal valuation whichever is higher

2. Documentary Stamps Tax
- P15.00 per P1,000.00 or 1.5%

3. BIR-Clearance Fee w/ stamp
- minimal lang ito, mga around P200-P500


Registry of Deeds (City Hall)
Registration Fee
- .25% of TSP


Legal Fees
Deed of Absolute Sale  1% of TSP
- but usually yung notarial expenses lang ito kung walang problemang nakikita pa sa title

Service Fee and doc stamps
- Tax Dec; Tax Clearance; Cert of No Improvement

Miscellaneous and Processing Fees
- fees vary, if you decide to get somebody to do these for you like a licensed broker

depende rin yung expenses for taxes sa value ng property. donor's tax rates may range from zero to 15% depending on the value of the property; while the capital gains tax is straight na 6%.  kung di naman kalakihan ang value ng property, baka mas maliit ang tax kung by donation ang transfer.

Hi, anybody here have an experienced procesing a real property donation transfer? if the property is to be subdivided into siblings, the partition, the taxes to be paid in BIR? Is there anyone can recommend a lawyer who can handle my problems with my siblings regarding the donated property to us and also a  broker who will process the transfer later on? Thanks

Na try ko na ito with the lawyer. Nag submit both for donation and deed of sale. Parehas lang ang amount though mas mababa ng konti yung donation but it all depends on the computation of taxes. Dun nagkakatalo. Dapat siguro may kilala ka sa cityhall or yung mag cocompute para mababaan yung taxes. Ending hindi ko na  push through but paid the lawyer. :/

Question: San ba dapat ito nilalapit? Sa lawyer or direct na sa cityhall? I have contracts na both for donation and sale.

You cannot go lower than the zonal value.

^^ With the lawyer, you need to go to a notary public for the deed of sale or deed of donation.  Then bring the notarized document to the the Registry of Deed.  They will tell you what to do, the steps.  You need not a lawyer on this.

1. san po mag pa assess ng Total Selling Price/ zonal value?
Total selling price - if you intend to sell your property, of course you will have a selling price for it.  Ang basis ng bir is selling price, fair market value or zonal value whichever is higher.  The bir zonal values can be found here http://www.bir.gov.ph/zonalvalues/zonalvalues.htm
2. Pag na notarized na ang Deed  of Donation [textspeak!] ang next step? punta ng city hall or BIR?
If deed of donation ang papers mo, before going to the bir, you should have with you the title, tax declaration, proof of relationship of the donor-donee (kailangang blood relationship within the fourth civil degree), notarized deed of donation (within 30 days from the date of deed of donation, kelangang mabayaran mo na ang donor's tax)
3. need po ba talaga mag personal appearance in signing the Deed of Donation? is it possible na ipadala ko na [textspeak!] yung Deed of Donation form thru courier service if nasa abroad yung may ari? what if di pwdeng makauwi [textspeak!] donor from abroad [textspeak!] po alternative na pwedeng gawin?
If nasa abroad, panotaryo siya sa philippine consulate.  if makakauwi siya, haharap sila sa notary public

Yes, sis the same steps, although make sure na hahabol sa 30 days.

2. pwede ko naman tong gawin mag isa without the help of a lawyer or need ko pa mag hanap? if so, meron po ba kau marerecommend?

Some people ask for a lawyer's assistance, although if like mo makatipid, panotaryo ka lang and then ikaw na maglakad.  some people i know are nagpapaestimate muna sa bir before having the documents notarized para ready ka na at hindi mabibigla sa babayaran.

@venessapaula, ako rin problema ko yan deed of donation namin dated from 2005 pa. Kung papa estimate ba sa BIR, alam mo kung ano pa need ipresent aside from the deed of the donation? May idea ka ba kung pwedeng yun sa akin share lang muna pagawaan ko ng title, kasi yun 2 siblings ko walang pera igagastos. kung ipa sukat ko yun lote, then yun part ko lang lakarin ko na magawaan na ng title in my name, then yun natirang lote, bahala na sila maglakad ng hatian nila in the future kung kailan sila may pera

Hi Sisses,

Our house is under my grandmother's name. Since my mother passed away 6 years ago she wanted to transfer it to us. But the problem is, the said property is "nakasanla" to a distant relative who owns a bank. Is that possible to transfer the title either thru DOAS or Deed of Donation.

Hope someone can help me on this.
