^Will try to answer, though my experience pertains more to condos than townhouses.

1. Yes, there is a contract that covers the length of the rental, condition of the place, and payment.

2. Post-dated checks for the whole period of the lease.

3. Two months' worth of deposit is the norm. At the end of the lease, the landlord has 30 days to return the deposit, minus any expenses in case the house gets damaged by the tenant. Not sure about pre-termination, though.

4. No, not listed, in my experience.

@ayrise, regarding sa list of things, hindi naman to the level na mga faucets and bulbs, pero siguro yung sa appliances (if furnished mo ipapa-rent). kasi i'm a renter and kasama sa pinirmahan ko is yung inventory nung valuable items lang like gas range, aircon, shower heater, sofa bed. pero minor things like bulbs and stuff, hindi na. :)

@meimei - okay got it, that makes more sense kasi bulbs is parang perishable din so it doesn't necessarily need to be on the list. Thanks for the information sis! :)

Ay naku yung nakatira sa taas namin kasumpa sumpa talaga.mukhang once a week ako kung mag curse sa kanila.ayoko na pahabain pero maingay sila.yung bata don na malaki na,kala mo may paa ng kabayo lagi sa lakas ng takbo.pati hila gamit ang bigat..twice na nangyari akala ko may naglalagari yon pala nagkakayod ng niyog ha,yung mano-mano na nakaupo sa kahoy na upuan..pinasilip ko kasi helper ko sabi ko kunwari palakad lakad ka nagtext.ayon nagkakayod daw ng niyog.sobrang ingay imagine sa kitchen yon ginagawa pero dinig hanggang bedroom maingay pa yung aircon nun..nung isang araw pagtingin ko sa phone ko quarter to 6 ng umaga ganon na naman may nagkakayod na naman.nakakapikon.isusumpa mo talaga sila..isang isa na lang mag report na ako sa office..ayoko lang baka next time sadyain na nila na mag ingay..kaka asar talaga lagi na lang kami nagtiis sa ingay ng mga yun lagi may kinukumpuni dapat bago ka mag move in sa bahay ayusin mo na kasi condo living onti gawa mo madidinig kaso wala sila pakialam o baka walang common sense

Hello mga sis :)  Would like to ask questions sana regarding sa Security Deposit. Dun kasi sa inupahan namin binigyan kami ng 2 year contract. Then recently, nagdecide na kami umalis. In short, hindi namin nakumpleto yung 2 years. Then the landlord said that hindi na daw namin marerefund yung 2 months security deposit na binigay namin before kasi hindi daw namin natapos yung 2 year contract. May mga nakaexperience na po ba sa inyo ng ganitong scenario? And hindi na po ba talaga nababalik yung Security deposit kapag pre-terminated yung contract?

^yes, you can't get your security deposit because you pre-terminated your contract. yun yung security ng lessor para sa mga ganyan. kasi otherwise, the lessees would just pre-terminate na lang with no consequences.

Question. if nakatira ka sa condo and naka rent-to-own ka paano kapag ayaw mo ng ituloy kasi lilipat ka na pero under same developer pa din. Pwede pa ba yun o magaapply ka na ng bago?

^you will only get it when you move out. A deposit is the lessor's guarantee kung sakaling takbuhan siya ng lessee na may unpaid rent or damages sa unit.

Hi mga sis - finally may interested mag rent ng House ko. i prepared the contract using the link given and may clause dun

" 10. EXPIRATION/CANCELLATION OF LEASE: Any of the Parties may pre-terminate this Agreement without cause on a thirty (30) day written notice. At the expiration of the term of this lease or cancellation thereof, as herein provided, the LESSEE will promptly deliver to the LESSOR the leased premises with all corresponding keys and in as good and tenable condition as the same is now, ordinary wear and tear expected devoid of all occupants, movable furniture, articles and effects of any kind. Non-compliance with the terms of this clause by the LESSEE will give the LESSOR the right, at the latter's option, to refuse to accept the delivery of the premises and compel the LESSEE to pay rent there from at the same rate plus Twenty Five (25) % thereof as penalty until the LESSEE shall have complied with the terms hereof. The same penalty shall be imposed in case the LESSEE fails to leave the premises after the expiration of this Contract of Lease or termination for any reason whatsoever"

yung Possible Tenant - pinapatanggal yung penalty part na One Month Payment plus 25%. Sabi ko naman kasi in the case lang na expired na yung contract (not renewed) or cancelled tapos duon pa rin sila nakatira at hindi pa umaalis. Protection lang naman po yun sa Owner na dapat magbayad sila kung sakali magextend sila hindi po ba?

Any advice if i should give in? or huwag ko na lang sila kunin?

If it were me, 'di ko na lang kukunin. I don't like tenants kasi na di pa nakakamove in, exit strategy na iniisip and I especially don't like tenants na spoiled.

Where did you get that one month's rent + 25% though? I'm just curious. :)

sis mooncake and leaves : foreigner kasi yung magrerent and maximum 2 years ang stay and medyo indefinite kaya ayaw patali tapos hindi din ata nakakaintindi ng english masyado :P .. inexplain na nung agent na pwede namang irenew.. ang pagkakaintindi kasi nila is after magexpire yung contract kung magextend sila may 25% penalty. sabi ko naman applicable lang yan kung nagexpire na yung contract tapos ayaw pa rin umalis dun sa bahay, kasi minsan may matitigas ang ulo hindi ba.. eh siguro since takot din dahil foreigner kaya ayaw pumayag. medyo hassle nga eh. ang hirap pala magpa-rent. at may point ka sa sinabi mo medyo nainis din ako .. hay ..

Tama ba na yearly mag increase itong Landlady namin? Nag increase ng 1 thou para sa bagong contract. Sabi niya last year plan na yun kung di lang naistorbo kami don sa problema nila. Condo kasi ito, alam naman natin mahal dues ng ganito kaso bakit ganon kaka increase lang ng 2k nung 2013, nag increase na naman 1 thou ngayon.

^^ i would check the laws on rentals in The Phils. and what other property owners/landlords with similar apartments/units/amenities charge. how many units are you renting out? kasi if you only have one, you don't need to be too strict because you don't have to worry that someone will complain that you're not fair, etc. what we normally do is if a tenant goes over their contract, we prorate the rent at 1/30. but that is because dapat mabait kami ;D

my advice is just research nga if that amount is fair, only to cover your bases. maybe you can also review your contract and draft your own because maybe there are things you need to include there that you
didn't get to and vice versa. not just for this particular prospect but also for future applicants. but i will try to find other tenants din. with this foreigner, mahirap na bawiin what you said because it will make you look like you're easily pushed around.

Hi all, I am planning to rent out my brand new condo unit and was wondering what sort of requirements do you ask possible tenants? Do you ask for IDs, polcie check, payslips, work references before you approve the lease? TIA
