Hi. I'm planning to enter law school by June. I already took the ALS entrance exam. I will also try DLSU's MBA-JD and JD alone, San Beda and UST. Marami ba talagang working kahit law student?

^ Marami-rami rin... Ideally, a law student must devote a major chunk of his time in reading and studying... Pero marami rin ang pinagsasabay ang law studies at work (like me) kahit mahirap, and for many reasons -- to sustain their law studies, to provide for their own families (lalo na ang mga married at may mga anak na), for tenure purposes (me iba kasing nag-aaral ng law para ma-promote, most of them, as I observe, mga government employees), at marami pang iba...

You can get a job which is not so stressful and which is not so demanding on your time.  Check jobs at your school, in Congress or Senate or be a law clerk/interpreter/legal researcher in any court.

I agree with sis marose17 -- hindi masyadong stressful ang trabaho sa government. I observed sa mga classmates ko sa school, most of the working students who excel in class are those who work for the government. Aside siguro sa hindi masyadong demanding sa oras ang government work, mas maraming batas na involved dito, so more often than not yung mga alam nilang batas surrounding their work eh naa-apply din nila sa law studies nila.

Totoo ba na pag kasal ka then nag hiwalay kayo tapos nagka anak ka sa ibang lalake hindi ka makakapag take ng bar exam? Masisilip ba iyon mga sis? Ilang percent ba yung chance na makakalusot iyon?

I'm not taking law po. Problem ng friend ko right now ito. True po ba iyon?

Possible.  One of the requirements to be a lawyer is good moral character.  You have to submit a Certification of Good Moral Character when you file your petition to take the Bar.  Cohabiting with and having a child by a man who is not your husband does not equate to good moral character.  In fact, puwedeng kasuhan ng adultery ang friend mo. Your friend's ex-husband may file a petition with the Bar Confidante alleging that she is not of good moral character and thus, may be prevented from taking the Bar.  Even if she is allowed to take it, baka hindi rin siya makapag-oath.

I know of cases na mga guys na nagkaanak sa labas before they got married.  Hindi nakapag-oath kasi nag-file sa Bar Confidante yung nanay ng kid na hindi siya nagbibigay ng support.  Iyan lang hindi pinayagan, how much more ang pagiging involved sa isang adulterous relationship.

^ Yung applicant ang magsu-submit ng Certification of Good Moral Character.  It is signed by an attorney or a member of the Philippine Bar.  As I recall, we submitted 3 certifications yata.  I asked my professors to sign.

Puwede siyang makalusot.  But then, may risk nga kasi puwedeng lumitaw si ex-husband or relative ni ex-husband any time before the Bar or before she takes an oath and petition the Supreme Court.  There are also cases of lawyers being disbarred after taking the oath due to violation of the good moral character norm. 

I see very slim chance na makalusot siya unless hindi naka-register sa birth certificate ng bata yung totoong daddy in which case, the legal presumption is that it is the husband who is the father.  But then again, there is DNA testing.

Walang lihim na hindi nabubunyag.  I have read lots of cases na regarding good moral character and always, ang mga tinatago, lumalabas.

^Pwede ring wala nang pakialam sa kanya ang asawa niya.  Malay mo, baka hinihintay lang ng asawa niya na maging abogado siya para siya na ang umasikaso ng annulment nila.

speaking of the bar exams, what are your thoughts of the past bar exam? marami ang nagsasabing ito na raw ang one of the hardest bar exams sa recent history.

my thoughts is that by last year's exams, nagamay na ng mga examiner ang sistema ng MCQ, which proves extremely difficult for most of the examinees na trained sa essay. 2011 bar was a trial pa lang for MCQ kaya siguro mas maraming nakapasa. kung yung mga batches na trained sa MCQ or those whose undergrad is a board-taking one, eg. Nursing, Education, Engineering, etc makakaya nila yan. and agree ako sinabi ng isa sa mga topnotchers sa interview sa kanya kanina (can't remember kung sino sa kanila) -- na ang law ay isang "profession of arguments, of backing up what you answer," unlike other board-taking professions na profession of memory. you can't argue when you have limited choices, unless you have the option to do so (which is inexistent sa present MCQ format ng bar).

Whether essay or MCQ format, kung maganda ang foundation mo, papasa ka.  Thus, from day one, you have to study, study, study.  No short cuts.  Do not be satisfied with reading digests.  You have to read the entire case in the original.  Do not be content with having just one reference book, yung prescribed ng professor.  Read what the other authors have written on the subject.  You start preparing for the Bar on your first day of law school, not on the first day of the Bar review.

General Rule = go for whatever your prof will recommend you... pero kung wala naman, here are a few...

Property = most profs I know recommend Paras, Tolentino, De Leon... some used Pineda and Rabuya... I personally used Paras...
Negotiable Instruments = I personally used De Leon (college version) because of its ease in comprehension...
Criminal Procedure = most profs recommend Agpalo and Reyes...
Corporation Law = can't recommend any since I haven't taken this up yet

Last but not the least, the codal provisions... These provisions are mandatory, reference books are but supplementary...

To add to Sis marose17, even if she passed the bar and signed the roll of attorneys, this is still a ground for suspension or disbarment in case mag file ng disbarment case yung husband against the wife for grossly immoral conduct. As a law student, dapat alam niya yan, kasi first year pa lang, dini-discuss yan sa legal ethics.
