 tanong ko lang sa mga nag invest sa condo na pre selling.... may kinuha kasi kami di pa sya na handover... mga close to 2yrs na ang binabayaran namin kaso plan namin i giveup na.. change of plans baka mag settle na lang kami sa landed. downpayment pa lang hinuhugan namin ngayon... if ever igiveup namin mababalik pa kaya sa nahulog namin? developer megaworld....

^sis ganyan din ang tanong ko. ang problem naman namin ngayon is mamove ng 2018 ang turnover ng unit kaya nakakawalang gana. ayaw na rin namin ituloy. approved palang loan namin sa bank pero hindi pa kami nagstart sa monthly amortization. ano nakalagay sa contract to sell nyo sis about cancellation of purchase? nandun dapat yun. alam ko pwede pa makuha yung nahulog pero may bawas, may certain percentage na ikakaltas. tawag ka rin sa head office ng developer kung wala ka na contact sa agent mo. yung amin naman ayala ang developer, naku ang sakit sa ulo.

yung sa amin din 2018 pa ang handover nakausap ko ang agent namin kaso umalis na sya sa megaworld e. baka wala na daw kami makuha may makukuha daw if nasa 50% na naibayad namin kaso wala pa. ang advise  sya humanap kami ng bibili tapos mag tutuloy sa installment namin ang transfer fee daw 200k .
ang value daw ng condo namin ngayon is nasa 5M na. 4.2M ang contract value namin nung nakuha namin.
i think nasa 400k pa lang nababayad namin. minsan gusto ko na lang talikuran ang 400k ko haha para lang wag na kami magbayad.. kaso majority dun kay hubs na pera hehe...

Nasa reservation agreement yung mga ganyan kung ibabalik pa nila lalo nasa downpayment pa lang. Madalas hindi binabalik eh yun yung nakita ko sa iba.

^^Grabe ganun kamahal ang transfer fee. Sayang naman yung 400k sis, pwede na uli pang down yun kung sakali ng next property na bibilhin nyo. Tawag ka sa head office sis, malay mo may makuha pa kayo. Minsan mas maayos kausap mga taga head office kesa sa mga nasa branch lang. Sa amaia HO tumawag ako kanina, nagbago na isip ko, tuloy nalang namin kasi pwede raw iextend yung payment ng DP eh. Hindi kasi kami papayag kung walang kapalit yung delay ng turnover haha, ano sila hilo. malamang kung hindi kami nagtanong dedma lang sila.

my prof in property law repeatedly tells us before that the society encourages absolute or sole ownership lalo na dito sa Pinas. iba kasi ang set of rules pagdating sa co-ownership than ordinary ownership of properties. mahirap, madaming loopholes. most of the time, let's admit it and dahil na din sa patong-patong na kaso in our courts regarding this, co-ownerships result in inequitable situations such as when the parties decide to divide the portions, or sell his portion, or who gets to maintain or improve the property, or even in the succession of heirs in case may mangyari sa isang co-owner. unlike pag absolute ownership, all things revert back to the sole owner lang.

but then re your question, simply put, sa co-ownership, equal ang rights and liabilities - ordinarily ng bawat co-owner. equal gains din. kung ano ang kargo ng isa, yun din ang kargo ng iba, in equal shares. so kung isang co-owner may nangyari (you mean death, insolvency, bankruptcy etc.), in purchasing properties kasi lalo na sa mga condos here, the laws of guaranty and suretyship apply sa co-owners, meaning, one co-owner is solidarily liable din sa mga bayarin or debts nung isang co-owner, because in the eyes of the law, they are one and the same. unlike sa absolute owner, syempre kung may mangyari man sa kanya sya lang ang liable. but sa question mo na ano ang mangyayari if something unexpected happens and you incur debts during downpayment period, it all depends sa contract mo with the developer of course. but most of the time, wala talaga nakukuhang bawi or refund if nasa DP period ka pa lang and you became delinquent. that's what's stated in my contract with DMCI too.

In general, it's hard to say which developer ang highly recommend especially pag pre selling.  The one we bought sa century properties, more than 1 year ng delayed.  The agreed liquidated damages sa contract looks hindi masusunod.  We have another property, low rise condominium naman yun, the penthouse unit was not properly turned over to us kasi there were damages or there were things sa unit that we were not satisfied about so 1 year yun na supposedly turned over na so gusto kami singilin ng dues etc.  Pinagusapan nalang so we get charged a smaller amount so we can move forward. Papaupahan na ng family eh.  Yun lang, don't expect too much pag pre selling.  Madami na rin investments family namin na delayed.  Lagi when you read the contract, it will be in favor sa developer.  Pag may delays or hindi ka satisfied sa construction, hindi mo agad magagawan ng action because you are dealing with bigger companies.

mine naman just received an update na 5 months earlier than expected ROF ma turnover na yung unit. i need to make arrangements pa with them kasi i'm thinking whether they adjust my monthly fees beginning next month, (i have less than a year nalang na DP period, from 30 months nung una naging 25 then now 20 months nalang. pangalawang adjustment na.) which is kinda mabigat kasi madodoble halos my installments or isabay na sa closing fees para isang bagsakan sa last month. hindi ko tuloy alam kung matutuwa ako kasi napaaga turnover or maiinis kasi big adjustment sa expected ko na budget for the next few months. anyone here who experienced the same na earlier than expected ang nangyaring turnover?

Kung ano yung expected turnover, yun pa din sinunod namin dahil ayaw namin ng madagadagan bayad at di pa namin kailangan yung unit. Yun naman din nasa contract.

^yup decided na din not to make any adjustments good thing no coercion naman on dmci's part. my agent kasi aligaga told me to prepare for payment adjustments agad pati tuloy ako na aligaga. lol. anyway, just like you not in a hurry naman to get the unit by next year. 2018 pa talaga sya naka set sa mind ko.

Ganyan yung sa office nung developer pero agent namin di naman. Siguro kasi mas maaga nila makuha pera hehe kaya subukan talaga nila suggest early turnover.

Parang kahit high-end condo developers naman may issues padin.
I was honestly surprised we had a little issue with One Shang since aircon installed wasn't working but since their service is superb naayos naman agad and they replaced it. Relatively mabilis and maayos kausap. I was expecting perfect unit pero realistically with so many units and floors there's bound to be some misses. Ganun talaga.

Sa ngayon, habang nagbabayad ako ng downpayment, naghahanap ako ng MRI (Mortgage Redemption Insurance).
Meron po ba kayong mai-sa-suggest na MRI?

In my honest opinion, DMCI properties ang the best for me. Feeling mayaman pero affordable naman! haha

We're also planning sa Mirea. Under DMCI ata sya? So far mukhang okay naman ang gawa ng DMCI wala lang ako idea if natatapos nga nila on time yung unit according sa napagusapan.

For now, since out na sa listahan ng ate ko ang lahat ng SMDC condos, we are choosing between avida vita and infina by DMCI, kaya lang ang infina napakatagal pa ng completion date. Kung ako lang ang magdedecide, gusto ko sana yung mga condos sa cubao like manhattan garden, pero empire east ang developer nun if I'm not mistaken, same as california garden which my mom really didn't like.
