Let's say she's been with you since 2009 - that means from 2009 till present kelangan mo bayaran yung contributions PLUS 3% penalty.. YIKES!! Ang bigat nito ha..

i think this is very unfair.

Retroactive ba tong bill na to for the benefits like pag ibig, sss and philhealth? Meaning once we register the kasambahay... We have to pay for benefits for all the months they were employed under us or magsisimula lang computation ng babayaran na benefits since the law was signed nung feb 2013?

Yes. When I applied for my Employer Number ang nilagay ko na start date ng Manang ko is June 1, 2013 maski matagal na sya sa akin. According to the SSS personnel kung yung totoong start date nya nilagay ko mapepenalise ako and have to pay her SSS retro-actively. Lalabas na doble ang babayaran ko since I have been paying her SSS since she started with me. Yun nga lang under voluntary member option since wala naman yang Kasambahay Bill na yan before.

naiinis at natatakot din ako at the same time dito sa bill na ito!

naiinis kasi saksakan at uuuuuuubbbbboooooooddddd ng batugan tong yaya ko na mandaraya pa sa trabaho
kesyo nag walis na raw pero pag pinaulit mo sandamakmak ang alikabok at dumi ng sahig!! tapos bibigyan ko pa ng
benepisyo. anak ng weteng talaga o! di ko na lang masyado iniintindi kasi ang hirap humanap ng yaya, magalang din naman samin
kahit paano, ramdam mong may takot at respeto sa aming mag asawa. matanda na, 55yrs old kaya nilalawakan ko na
lang ang pasensya. pero naman, kahon lang ang bahay ko , wala pang appliances dahil na ondoy, ni di pa magawang
linisin ng husay! hay

natatakot kasi napalaking responsibilidad nito batas na to. irerehistro mo pa sa baranggay, e kung ako nga
hindi rehistrado kasi di pa ako nakakaboto my whole 35years hehe. tapos sept last year pa sya samin,
so ibig sabihin mula dun babayaran ko ang katamaran, este, benepisyo nya?

hindi naman lahat ng nagkakatulong mayaman. yung iba, na tulad ko, walang choice dahil working parents
at walang magbabantay sa anak pagdating school.

i think this is very unfair.

In all honesty - I think its UNFAIR kapag hindi mo alam BUT if you know na meron na nung 1993 pa YET you didn't do anything about it - hindi na unfair yon.  Ang tawag don, to be honest - avoiding responsibility. 

Kami kasi when we learned of the law, we immediately did the necessary.  Just to avoid the problem come 20 years later.  To eliminate all the sakit ng ulo in the future - hence, this problem.

question pala, tama ba pagkakaintindi ko. si maid din ba may separate form from sss na i-file nya? isasabay na lang sa pag file ng sss ng employer?

@tinapay - yes iba ang form ng maid na magmemeber at iba ang form ng amo na kukuha ng employer number/..

I read from a blog na meron din daw babayaran na back pay sa sss ang mga kasambahay na walang hulog before. Kasi before this bill, required sila na maghulog din together with their employer. So parehas ang amo and maid na utang sa sss kung nagkataon.

Does this retroactive thing apply to pag ibig and philhealth contributions too?

May mga nakapagparegister na ba ng kasambahay sa barangay? Ano ba dapat unang gawin? Iregister sa barangay O sa SSS, Philhealth at Pagibig?

Saka naguguluhan kami kasi di ba sakop ng KB ang laundry person or any person na nagwowork on a regular basis. Gaya sa mommy ko, may pinapapunta sya na tagaplantsa every other week so lumalabas na sakop sya ng KB. Tapos the same tagaplantsa, twice a week naman sa friend nya. Sino ngayon sa kanila ang magbabayad ng SSS, Philhealth at Pagibig nun? Parang wala naman ako nabasa sa IRR na specific ruling sa ganun. Tapos sabi daw sa SSS pag mga labandera, plantsadora eh ireregister as voluntary, no need na magregister ng employer-employee.

For Pag-ibig puwede magpa-register online both employer and kasambahay. just make sure your kasambahay have all data (like beneficiaries birthdates, mother's maiden name) para tuloy tuloy pag-input. My maid had to make several calls cause she doesnt know her mother's maiden name and her father's year of birth.

i don't like this bill. grabe as if naman lahat kasi mayaman, wala namang salary increase eh bakit bigla biglang may ganito. kaya nga both parents are working para naman makasustento ng mabuti sa pamilya. eh dahil sa padami ng padami binabayaran parang mabuti pa isa nalang mag work dahil halos wala na rin matira to those ordinary income earners. wala lang ranting.

^sis di ka nag-iisa hehe. kami nga sweldo ng maid noon was 3000, umalis sa amin after a few months kasi she found out na buntis pala sya (may asawa at mga anak sya sa province). after a yr, gusto bumalik kapalit ng present maid namin na ayaw naman ng pabalikin dito sa maynila na ina pero sana daw taasan ang sweldo. sabi namin sige kahit 3500. aba tumawad pa baka daw pwede gawin 4k. since kailangang kailangan namin, saka inisip namin tutal eh subok na namin na ok naman sya magwork at masipag naman, di na kailangan utusan eh pumayag na din kami. so ngayon namomroblema kami kasi with this bill, sa computation ko eh more than 600 ang gagastusin namin para maibayad sya ng sss, philhealth at pagibig. so on top of her 1k increase, another 600-700 pa, that's 1600 a month. napakabigat ng masyado. buti nga sana kung hindi sya nagrequest ng 1k increase keri pa. ang nakakainis pa eh oo nga 2500 lang minimum salary ng hh sabi sa bill. kung masusunod talaga yung 2500 na sweldo, ok lang ibayad sila ng sss, philhealth, pagibig. kaso naman hello! may makukuha pa ba tayong maid na papayag sa 2500 na sweldo di ba? bihira na makahanap ng ganun. ito ngang maid ko 3k na sweldo noon nagpadagdag pa ng 1k. tapos ang dami pang maid ang tatamad, puro celfone inaatupag na tipong mabubwisit ka kasi kailangan mo sila ibayad ng sss, etc kahit batugan sila. kaya kami we dont know what to do now kasi di namin talaga kakayanin pa.

Let's not say that the law is garbage.  Let's just say that the law is FLAWED.

I'm all for giving our Kasambahays rights BUT sana naman, napag-isipan ng mabuti.  Na-consult both the kasambahay and the amo.

These helpers of ours - HELP us.  And I think it is only but right for us, to also help them out.  Sasabihin natin na mabigat on our part but its the law and it will benefit them in the long run.  Its not that they don't deserve it or not, its more of - KAILANGAN natin itong gawin para sa kanila.

If you complain endlessly that your maid is lazy and etc - then let me ask you - WHY PUT UP WITH THEM?  Sinasayang mo lang bayad mo sa kaka-complain and sa kaka-tiis!  I'm sure you will find other househelp that deserves your concern diba?  Dito na nga ma-we-weed out yung mga bad employers sa good eh.  The bad ones - if you're not satisfied with them - then let them go after a month.  Its a valid excuse to terminate because hindi satisfatory yung service nila diba? 

Ako kasi, we've been giving our helpers SSS since 1993 and we've had our share of bad and good helpers.  Wala naman tayong magagawa doon eh.  The important thing is that you abide by the law and give them what is due them.  Huwag na tayo maging madamot sa benefits nila.  As long as they give the 'help' that we need - then go lang diba?  I think that should be our attitude towards this Kasambahay Bill.

My only concern with this law is how hard it is the filing. I'm a stay at home mom and it took me more than a day sorting this out. Bawat isang agency ang haba haba ng pila. I can just imagine how harder it is for those who work full time. Sana Lang they have come up with a unified system of filing and paying at the onset of the implementation.

hindi naman pinagdadamot ang benefits na yan sa kanila, tulad mo I've been giving this same benefit to my HHs before pa na-Conceptualize yang law na yan.

the law should benefit everybody, not just for some, that's my point.... hindi yung advantage sa iba, at perwisyo naman sa iba.

Trust me, i help my katulong as much as I can pero kasi wala namang increase sa pay. Unlike other employees, ang mga katulong subsidized lahat, they get free toiletries, food, electricity, sometimes clothes. Ako as a normal employee, i dont get that for free. Ang sweldo ng yaya ko 4000. magkano lang sweldo naming mag asawa, mag tuituition fee pa. hindi naman ako madamot, all im saying is bakit lahat puro dun sa kasambahay. Kung ganyan lang din naman pala parang mabuti pang di nalang magtrabaho eh, parang hirap na nga pagkasyahin yung sweldo dahil sa lahat ng kaltas sa yaya pa mapupunta lahat.

How i wish may same benefits din sa normal employees na middle class like me. wala naman silang tax yet they get all the benefits. hahaha. sorry ranting! :)

I have to agree with you on the hassles of filing.  Totoo naman na PESTE ang pag-pipila.  Kaya nga FLAWED yung law kasi naman the agencies involved were also NAGULAT sa mga pangyayari.  Hindi sila fully prepared.  Half-baked lahat - ika nga, birthing pains.  Ako mismo, napipikon ako sa mga SSS people kasi they don't seem to know things!  Mamaya ito ang sasabihin, mamaya iyan naman.  Alam mo yun, nakaka-asar kasi paiba iba yung mga sinasabi.  Hassle lalo kasi they don't get the point na since nandun ka na, sana magawa mo na lahat.  mahilig sila magsabi ng 'Bumalik nalang kayo'

Its still NOT garbage, FLAWED parin.  This law was created to entice voters.  When you say its garbage it means that itapon mo nalang.  Walang kwenta.  Its not walang kwenta, may kwenta siya - yun lang, naging mas malaki ang benefit ng isang side kesa dun sa isa.  Pero since I respect your view and walang basagan ng trip , then sige - for you its garbage.

I just have a question, don't get mad ha - if you've been giving all these benefits since before it became a law - ano yung garbage for you doon sa law?  What points don't you agree on?

Lahat tayo struggling to make ends meet.  The 700+ contribution a month that I give my helpers - its not easy to magic out of my wallet.  Malaking budget session yan sa akin.  Imagine that P700.00 instead of paying sa mga monthly contributions - pwede pa yang mapunta sa ibang bagay na mas importante diba?  But kasi naman, imagine this - if you say nga na wala namang salary increase ang daming kaltas sa sweldo.  Ilagay mo sarili mo sa situation ng mga helpers.  Wala rin silang salary increase diba and wala rin silang benefits YET they work for you.  Parang normal employee lang din yan eh.  May kaparehas ka ng sweldo YET mas tamad sayo and etc.  nakaka-asar diba?  but may mga ganun eh. 

LAhat tayo nag-rarant.. Hahaha!!  Ako naman, I try to see the good in this law.  Its really HEAVILY FLAWED.  I have to agree na its one sided and should be amended.  Yung gumawa ng law ata parang never nagkaron ng kasambahay eh!!  diba diba??

What I find the SILLIEST sa SSS is that the previous helpers can claim back benefits of their OLD employers!  Meaning if umalis na yung helper mo sayo, pwede ka pa niya habulin!  For me, WHAT THE HELL FOR?

Also yung PENALTY ng back benefits!! Dapat if you ask me - WALA ng penalty!  Lalo lang mawawalan ng gana yung amo na iregister yung kasambahay niya kasi ang laki ng babayaran niya!!  CRAZY!!

I heard on the radio na yung isang katulong na 13 years nagsilbi sa amo niya, pinapaalis nalang siya kasi 37K pesos daw yung total back benefits na babayaran! 

Hay, this law should have been thought of first BEFORE nagawa..  Yung IRR daw sabi ng DOLE they held forums daw with amos and kasamabahays... HELLO?! SINONG AMO KAYA NAKAUSAP NILA?

Hahaha hindi pa din ako agree for this reasons:

1. ang helper mas mababa ang cost of living sa province
2. ang helper pag nagkasakit sagot naman ni employer lahat ng gamot, gastos minsan pag nabuntis at nakunan sagot pa din ni amo unlike sa normal employment
3. ang helper may advance - usually lista sa hangin. Ang normal employees hindi pwede mag advance.
4. Ang helper pag nagbakasyon sagot ang pamasahe etc. Ang normal employee hindi.
5. Anong protection ng amo kapag bigla nalang lumayas ang yaya sa bill na to, edi wala.

Madaling sabihin na gawan ng paraan pero pano kung lahat na talaga ng paraan nagawa mo na pero hindi pa rin kasya ang sweldo mo? Pano kapag single mom ka tapos sa call center ka nagtratrabaho na ang sweldo ay 15 gross pa ang sweldo tapos kailangan mo bayaran ang kuryente, katulong, gatas, renta ng bahay, diaper, groceries. Madali mag sabi na gawan ng paraan pero mahirap pag nandun ka na sa sitwasyon. They should have made better bills than this. Ang dami dami pang pwedeng pag tuunan ng pansin puro pagpapahirap sa ordinaryong middle class worker ang ginagawa.  hehe, peace. naiinis lang talaga ako kasi naman they keep on playing this on tv. syempre pano ko mag aadjust kapalang sa bill kasi wala pa sa budget mo, the more your yaya watches this, the more they would feel na ginugulangan mo sila.

ALSO, this was not implemented way back so why the need to pay for penalties etc? feeling ba ng gobyernong to eh ang yayaman ng lahat ng may katulong? san ka naman nakakita na kakaimplement palang may penalties na agad.
