^I think it's 8 hours of rest not 8 hours of work.  Tapos yung 8 hours na rest pwedeng not continuous, meaning counted na doon yung mga nap time and/or tv/telebabad time nila.  At least, that's what I got from the bill itself kasi yung sa link with the Q and A wala nang ganun na nakasulat, so it's a bit contradicting.

meimei  I'm just curious, since you seemed to be very well-versed with the bill, how are you implementing this in your own household?  Like an example of your set-up in terms of their work load to abide by the 8 hours rest period and also the 24 hours day off every week.  And also your system in paying for the SSS, PhilHealth and Pag-Ibig.  Para naman for the rest of us to have a concrete and actual example of a household implementing this bill.  That would be a big help.  :)

@meimei parang di ko kaya i explain yan sa mga kasambahay ko. e simpleng utos nga lang na wag kung saan saan ilagay yung used diapers ni baby, tapon kaagad sa basurahan hindi nga kaya ipasok sa utak, eto pa kayang do's and dont's ng bill na ito. I mean hindi sa dine degrade ko sila pero ako kung minsan ayaw ko na mag utos at mas lalo akong na iistress.

ang 8 hours ba na work e continuous? kung cook yung kasambahay mo paano ang breakfast, lunch, at dinner? e between breakfast to dinnertime more than 8 hours ang pagitan?

kung 1 lang ang househelp e, mamamalengke ng very early in the morning (start ng work), paano na siya mag-cook ng dinner nun lagpas na sa 8 hours

just to add on to the previous answer to your question:

"SEC. 20. Daily Rest Period. – The domestic worker shall be entitled to an aggregate daily rest period of eight hours per day."

aggregate yung 8 hours of daily rest, hindi consecutive. and alam mo sis, actually yung 8 hours na yun, is 8 hours out of 24 hours, so actually yung tulog pa lang niya (as in yung sleeping time, hindi "nap" time) included na dito. :) yung 8 hours hindi yan kukunin sa waking time lang. the law is just saying na dapat may aggregate total of 8 hours na rest si helper per day. so yan lang yung minimum, eh normally naman more than 8 hours of aggregate rest ang binibigay talaga natin, so good na tayo dun. :)

mga sis, hindi naman required na birth certificate ang isusubmit eh.


SSS Requirements:

A person registering with the SSS for the first time as a prospective employee should accomplish SSS Form E-1 (Personal Record) and submit it together with the original/certified true copy and photocopy of any of the following: baptismal, birth certificate, driver’s license, passport, Professional Regulation Commission (PRC) Card or Seaman’s Book. In the absence of these documents, any two of the following, one of which recent photo and date of birth, are acceptable. (see list here: https://www.sss.gov.ph/sss/index2.jsp?secid=109&cat=2&pg=null)


Philhealth requirements:

Birth/Baptismal certificate or ANY of the following (see list here: http://www.philhealth.gov.ph/downloads/membership/pmrf.pdf)


Pag-ibig requirements:

hindi rin required sa Pag-ibig ang birth certificate, (so pag may SSS na, mas madali na i-apply ito).


and as i said before, hindi rin naman required yung nasa Sec 12 na Pre-employment Requirements, ang sabi sa law "the employer may require", pero kung thru agency saka lang magiging required (and meron pa ngang provision dun sa Sec 12 na kung walang birth certificate, may alternatives).

i highly suggest to read the law thoroughly kasi kaya ko rin lang nalaman ang mga ito kasi binasa ko rin lang naman at ni-research. :) hindi rin naman ako abogado. pero the law is pretty much understandable by us employers, di naman kailangang abogado ka para maintindihan mo yung law.

Thanks sis for the links! Covered ba ang part timers dito, like my lavendera na 2x a week nagpupunta? Di ko kasi sure if she is also working for another employer on a full time basis, so parang freelancer ba ang Turing sa kanya? Thanks ha, I'm really struggling with this...

I spoke with my lavendera kanina, sabi niya namamasukan siya sa iba't ibang amo during the various days of the week. So parang 3 kami na amo niya, iba ibang araw.  May mga araw na minsan Hindi siya pinapatawag ng ibang amo, so pag ganun sa bahay Lang siya. I suppose pag ganon, di ko na siya sagutin sa SSS, etc? Kasi parang ang gulo pag ako magbabayad tapos Baka yung ibang amo magbayad din or worst, magka triple triple ang hulog... Tama ba ako sis?

^hmmm... honestly, yan ang hindi ko talaga sure. i can't give you a specific legal provision to back it up. baka hindi rin naisip nung mga nasa kinauukulan, hehe, kasi kahit sa Q&A walang nag-address niyan, and i highly doubt na maa-address yan ng IRR na ilalabas. meron nga namang lavandera na namamasukan sa iba-ibang amo. ang sigurado ako, hindi dapat tatlong employer ang magbabayad ng SSS niya, hindi pwede yung ganun. ang mahirap diyan, wala siyang primary employer, so baka walang mag-shoulder at all ng benefits niya.

SEC. 4. Definition of Terms. – As used in this Act, the term:
       (d) Domestic worker or “Kasambahay” refers to any person engaged in domestic work within an employment relationship such as, but not limited to, the following: general househelp, nursemaid or “yaya”, cook, gardener, or laundry person, but shall exclude any person who performs domestic work only occasionally or sporadically and not on an occupational basis.


jazzyfish  Based on the section I posted above,  I think your lavandera is not covered by this bill.

^Honestly?  Very specific naman yung term na sporadically.  It means, she would be categorized as "self-employed".  Common sense and logic because lahat ng nasa bill not applicable sa kanya.  Dun pa lang sa part na stay-out siya and 2x a week lang pumapasok, tapos dami pang "amo" understood na yun.

And this is just one of the reasons why most of us employers here were "complaining" about this bill.  Maraming gray areas.  No two households are set up alike.  There are a lot of variables.  Kaya we are discussing it here and asking for SPECIFIC and ACTUAL examples.  Yung tipong a household who have already tried implementing this bill into their own household.  Kasi I'm sure everybody have read the bill a thousand times kaya hindi rin masasabi na hindi lang naintindihan yung bill.  BUT we are scratching our heads because medyo malabo yung part na ng application/implementation sa bahay na mismo.

So I will always go back to my usual example situation, kasi ito IMO ang isa sa pinaka problematic (or at least potentially) part ng bill.  The 24 hour weekly day off.  On paper, it sounds so logical and easy to abide by.  But in actual situations?  I don't think so.  Just reading the other thread, ang daming complaints about maids na upon day-off di bumabalik on time or worst di na bumabalik.  So pano na yan?  Goodbye pamasahe, agency fees etc. na for sure.  Registered in DOLE and Baranggays??  Is that  a joke? Not that I'm looking down on the maids, but di ba most of them have no permanent address?  So ang dali lang mawala.  Provinces?  If they write, say Gubat, Sorsogon, where in world would you find them there?

These are legitimate gripes and complaints.  Not imagined slights or "acting like victims" of this bill.  Not unless somebody could post an ACTUAL application of this bill in their own household with relative success, then I would still continue to say that bill is a big joke and done so not for the benefits of the kasambahays (much more the employers) but rather done to garner popularity and votes.

Ay naku yung maid ko wala ni isang id kaya di ko alam pano sya magaapply ng sss. Pahirap naman tong bill na to... Di ko alam kung pano ko sisimulan gawin. I agree with you sis cherrhys mahirap pag actual na yan kasi di nila pinagaralan lahat ng pasikot sikot. Sa SSS pa lang ng maid eh pahirapan na. Kasi yung maid ko nung dumating sa akin last yr, straight from the province at first time dito sa manila. Normally di ba ang dala lang naman nila katawan at damit nila. Pati nga pamasahe kami nagbayad. Tapos yung iba pa sa kanila sa hilot lang pinanganak. And as if naman meron silang bank accounts, credit cards, passports, etc. kapalit ng birth certificate para makakuha ng SSS. Nung hinihingi ko complete name and details nya para try ko magrequest sa nso ang sabi kesyo may problema daw ata sa birth certificate nya, ang nakalagay daw eh lalaki sya. Ay ewan ko na lang sa bill na to good luck.

^Exactly!  Yung bill kasi "possible" maging applicable sa mga big cities (like here in Metro Manila) kasi mas may access and kahit paano mas may alam ang mga tao dito.  Sa province kasi mas iba priorities nila kasi nga sa hirap ng access and all that.  Marami pang provinces na sobrang backwards like no electricity at all, so they don't really care about bank accounts nor getting ids and stuffs.  Papasok pa dyan yung kakaibang practice nila sa province na iba yung nickname sa real name.  Like yung yaya ko now, real name niya "Arlene" pero ginagamit niyang nickname "Gina" eh buti eto alam niya nickname lang yun at wala sa birth certificate yun.  Eh dati meron kaming nakuha (at tumagal sa amin ha)  all along she uses "Jean" as her name, lahat ng papers niya ganun.  But when we asked for her birth cert. since we planned to get her a passport, di talaga mahanap.  It turned out her real name was "Jennifer".  Tapos parang di pa alam ng karamihan sa lugar nila na yan ang registered name niya kasi lahat "Jean" ang tawag sa kanya eversince.  Her father died na rin, good thing nandyan pa si mother niya.  Kaloka lang pano nakuha yung iba niyang papers.

^ Magiging cause rin pala ng unemployment rin pala yan sa mga maids - yung mali-mali ang nakalagay sa birth certificate.

Di kaya dumami na lang ang patago ang hiring sa maids - yung as in walang SSS, 13th month, Philhealth at Pagibig tulad ng dati? Parang ang hirap din sa government hulihin yung mga lalabag sa kasambahay law - unless magdemanda ang maid?

^Kaya rin siguro maraming fixers.  Kasi tulad na lang niyang basic na birth certificate, problema na agad.  Yan pa naman ang number 1 na papeles na kelangan natin kahit saan. 

For sure madami yang gagawa ng patago.  Kaya the bill would eventually defeat its main purpose which is to protect.  Kasi ano ba usually nangyayari kapag patago na, abuses.  Lalo na if kelangan talaga ng trabaho tapos samahan pa ng di naman kabisado ang bill, syempre basta fair sa pandinig nila yung salary more or less papayag na yun.

Kung yung mga "real" business nga hirap na sila ipatupad yung tamang SSS/PhilHealth/Pag-Ibig (even taxes nga) contributions, pano pa itong household set-ups.

^Ate, kasambahay bill pa rin? :P Hahaha, I miss you na. Mukhang pinahihirapan ka ng husto nitong bill na to a, shucks buti na lang wala ako yaya. Moving up day nung 2 sa Saturday, did I mention na andito lang kami sa Manila? When you have time, let's have lunch naman!

Seriously, dapat now na kuhanan ng mga papeles na ganyan ang mga kasambahay? ang alam ko wait muna sa barangay nung employment contract a. O baka talagang yung mismong nagpatupad nito e in doubt din kung pano simulan to. Wala pa bang nakapag-apply na talaga nyan sa mga bahay bahay nila. Shet, oras pa lang ng tulog talong talo na kame sa mga kasambahay. May morning nap, afternoon nap, lahat na ata ng nap merun sa mga to. Wow talaga, wow na wow!

^Hi, Dolly!  PM mo na lang ako or message mo sa FB para makapagplano sa lunch date na yan. ;D  Ako naman sa Friday ang moving up day nila kambal (the older ones).

Actually, di pa naman ako problematic sa bill more on nakikita ko lang yung mga potential problems nating lahat bilang mga amo.  Kasi nga wala pa naman actual na nakakagawa nito eh.  Iba kasi yung binabasa lang yung bill sa ACTUAL ng ginagawa sa mismong bahay na.  Kahit kabisadong kabisado mo pa yung bill, wala pa ring comparison yun sa actual na buhay.
