I've read the bill already especially the one that is signed by Pnoy.  hahahah mabuti walang monthly period leave.

as I understand the employer can terminate the helper because of disobedience and by performance. So dahil hindi pwedeng singilin sa kanila ang mga binabasag na furniture then the employer can terminate the helper kapag paulit ulit na nangyayari ito? Pwede ba yun?

Yeah i think so, pwede mong iterminate because of "performance".

Sabihin mo sis, "performance level" kasi kung makasira ng gamit.

May HH kami, inutusan kong linis ang electricfan. Nagulat ako sis, dinala sa garage ang electric fan namin at gumamit ng hose. Hinose ba naman ang electric fan, imaginin mo sis yung mga taong nasa welga tapos hinohose ng bumbero. Ganun sis ang peg niya! Kaloka!

naalala ko yung HH ko noon.. sabi ko iligpit ang mga food na naka-expose at ilagay sa ref, then bumaba muna ng bahay (paalis ako punta office) kasi darating ang maintenance para mag-spray ng pamatay ng roaches, ants, etc.. after ko magpaliwanag, nag-ask sya, ate, pati ba loob ng ref pa-spray-han? hahaha.. kaloka!

I want to know nga kung kelangan in writing ba yung 'performance' issue..  Kasi legally diba kelangan ma-memohan ka, because those memoes are the proof of your dispbeience?

I think it will not be difficult to fire them.  Teka, in the 1st place,  ayaw naman talaga natin mag fire if performance is ok.  But for me to kick her out for her lousy performance, or kasi mapanira --  tapos kelangan ko pa ng "proof" susko.

Madali lang yan -- tanggalan mo ng tv, hindi naman legally mandated may tv.  O di aalis na yan.
Sungitan mo lang, hwag ka ever smile, tarayan mo ang tono mo -- but do not shout at her or  make mura.  Ano masasabi nya that will sound like she is on firm grounds?

Ayaw umalis?  Baka kasuhan pa amo na basta tinapon sya without advance/sufficient notice di ba.
Eh kung biglang gawin mo 3x a week galunggong -- yung ok ang quantity and quality ng food pero hindi na pwede kaartehan nila na in their own homes they cannot afford anyway.  O di aalis yan.

So far wala pa kong na-encounter na hh na ayaw umalis, mentality ng mga yan madali lang makahanap ng malilipatan. Alam din nila na mas marami ang naghahanap ng maid kesa sa mga hh na naghahanap ng mapapasukan and most of the time eh sila pa nga ang kating-kati na umalis. Pag na-sense ng mga yan na hindi ka basta-basta magpapaalis ng maid especially kung may balanse pa sila sayo like bales, advances etc. eh ayan na, simula na yan. Nandyan yung nakasimangot all day, late bumangon, nagdadabog, nakakasira na ng mga gamit(na parang sadya naman), pag kinakausap mo parang hangin ka lang na kunwari wala silang narinig, isama mo na yung never ending na palusot at marami pang iba!

^Well, yes, generally they are quick to leave for the slighest reason/imagined slight.

However,  I think we were referring to "performance memos" or something of that nature to prove incompetence as grounds for dismissal  --   that may be implied/required  pending the release of the KBill IRR about firing  a helper, without the mandated advance warning.  If I recall correctly -- a helper must be given 15 days' advance notice?  But the helpers only require to give a 5-day advance notice if they are leaving. 

I have had the unfortunate experience of needing to fire out a helper on the spot.  Not that i wanted to kick her out like a cat, but she was threatening the other helpers (natatakot na nga matuloong a couple of them with her in the same room)   -- for not covering up her mistakes.
Given that situation, I do not think it is feasible to give advance warning; and let the helper stay on for another 15 days.  Neither do i think it is fair that given the circumstances, i have to be the one to compensate her for not giving her advance warning.   Eh di bwisitin ko na lang para kusang umalis.

Wala pa bang IRR Ito mga sis? May darating akong bagong yaya in a month, kelangan ko na sana ng contract sample! Kalokah Ito!

^wala pa, sis. around early May pa ang deadline to release the IRR (within 90 days from the effectivity of the law; the law's effectivity is after 15 days of its publication in the official Gazette; the law was published on Jan 18)

 Kasi di ko talaga malaria Kung paano ko babayarn monthly given lack of time (maaga aalis ko to office, tapos gabi na uuwi. musta naman?) and if pwede ng unusable na Lang si kasambahay to pay her own.. Laking stress Lang...

^no, you can't hold it off. the law is already effective (15 days after its publication, so 15 days after Jan 18 ang effectivity). habang wala pang IRR, you just have to rely on fully understanding RA 10361. sana makatulong sayo kahit papano yung Q&A na ni-release ng DOLE. please see links below:

ang 8 hours ba na work e continuous? kung cook yung kasambahay mo paano ang breakfast, lunch, at dinner? e between breakfast to dinnertime more than 8 hours ang pagitan?

kung 1 lang ang househelp e, mamamalengke ng very early in the morning (start ng work), paano na siya mag-cook ng dinner nun lagpas na sa 8 hours
