major laws nga dito sa pinas e di na masyado napapatupad paano pa mga minor law like this?

Agree sis! ambitious lang masyado ang government natin ngayon at kung anik anik na petty laws lang ang pinupush..pero yung mga major na problema hindi naman kayang solusyonan..isa na diyan ang GUTOM.. :-[

May nasabi  si sis aquacharly about preggo maids. Which reminds me - May kaso ba ako pag if I stipulate na yung mga mabubuntis Ay mate terminate ang contract? Yung bahay ko kasi Ay 3 floors at ayoko naman nadisgrasya yung buntis sa pagakyat-baba. Tapos ako magbabayad pag may nangyari.

May experience kasi ako na 1 maid tinago ang pag buntis tapos nag spotting so dinala ko sa doctor and pinagamot ; laki din ng gastos! Na trauma ako dun, so ayoko na talaga ng buntis, delikado dahil manual labor ang nature ng trabaho nila. Pwede ko ba ilagay yun sa contract na contract will be terminated pag nabuntis (in the interest oh her health, etc etc)?

Sali ako mga sis. I don't fully understand itong Kasambay Bill yet but I think they say maids with over 5K na sahod ay no need to apply for SSS and other benefits on the part of the employer. Bahala na si yaya/maid ang magshoulder nun. Tama ba? :/

^^ You still pay, but pay only for your/employer share kasi afford na nila to pay for their contributions.  You must remit both employer and employee contributions. You cannot say later: ayaw pa deduct eh.  The employer is legally  mandated to collect and remit. It is a criminal liability if you don't -- fine and imprisonment.

We must cross-interpret with SSS, PhilHealth & PagIbig laws & provisions.  Dyan mo ma define the existence (if any) and define the criminal liabilities.

I persist, see more omments below.  But lest I overlook later:  I will not vote for the authors & sponsors of this IMO 1-sided unfair bill, ever,  till death.  Like Lina, after his squatting law, wala na sa big families namin ever voted for him. 

My husband said we will adjust to this law.  Times have changed.  We will find ways to cope. Though he says, we employers will find ways to acquire household services --  at some inconvenience now.  Ang mahihirapan talaga -- mga not so productive helpers because the KBill prices them out of the market --  they become too expensive hindi sulit. Mas gugutumin their families.    To be adversely affected thereafter -- the lower middle class 2-income households --  kasi the maids have been priced higher, the shortage worsens. It is bad for us all --  as an employer, I will lose valuable service from a certain segment of working wives/mothers. 

IMO, compliance will be halfhearted --   employers and maids will find ways towards a mutually acceptable modus vivendi.  If employment conditions are to the maid's advantage - she is apt to forego the provisions less required by her current circumstances if demanding for what she does not critically need (in her own view) and/or her amo cannot gladly give -- will just force her amo to reconsider/terminate her employment. 
But it sure gives syndicates, preying maids and unscrupulous lawyers more teeth to harass/exploit employers.

Yeah i agree with you about the squatting law. I simply dont get why would I compensate them while they are stealing my land right? See what happened at the Pinaglabanan, the entire squatters area there was burned down na lang. I think a lot of lawmakers are making laws that will help them gain votes on the election. Lets face it, the more squatter, the more pogi points for them. Obviously those from middle class and rich circle wont for them but in our country mas lamang ang squatters di ba? Mataas masyado ang poverty line.

I asked my current HH here and she said she's happy with what she is getting from us. 5k, free shampoo, lotion, deodorant, napkin, medicine. When we travel even abroad if need pa ng isang kasama, join sya. So sabi nya mismo kawawa lamg yung other helpers but she is not one of those kawawa. Oh and also whenever na uuwi sya sa province, sagot namin tickets nya, plus with pasalubong pa yan (clothes,biscuits etc) for her family. So ano pa hihingin di ba? Kasi we dont treat out hh like HH. We treat them as family.

The SSS nga i voluntereed paying for it, and she said wag na sya na lang daw kasi 120 lang naman daw yung voluntary. I told her need nya pag ibig and philhealth. Sabi nya di nya need ang pag ibig, di naman daw nya mapapakinabangan yun so we agreed yung philhealth na lang nya babayaran ko. Hay may mga HH na lumalaki agad ang ulo because most of the provisions here are in favor of them. Di nila naisip na lalo sila mahihirapan maghanap ng amo because of their pag inarte. Nagawa lang yung law na to yung ibang hh dito sa a,in akala mo sino na. Aba matitigas na ang nga ulo at nagdedemand na ha.

Good thing my helper is a distant relative. I never hire someone I don't know. Anyway, I already gave her a raise from P4,000 to P5,500 after her 3rd month. We agreed na it'll be up to her to pay SSS, PhilHealth, etc.

Hindi ba naiisip ng mga nag-aapply na helpers na ito na lalo silang mahihirapan maghanap ng trabaho kapag nagdemand sila? Akala ba nila tatanggapin sila ng amo ng ganun ganun lang? Yung mga malakas ang loob magdemand kapag hindi nakahanap ng trabaho yan ang naging desperada na yan saka niya maiisipan na hindi siya dapat magdemand it come to a point na iisipin niya na kahit anong salary.

Oh yeah mag inarte sila para lalo sila mawalan ng work di ba...

The one taking care of my kid is my aunt. Ayoko kasi pagkatiwala sa iba yung bata. Tsaka yung food namin ganun rin sa hh ko. Sabay sabay kame kumain lahat in one table except lang pag may guest kame, di sya sumasabay kasi di na kasya sa table haha.. But other than that, join sya. Pag local trips namin as family super lagi yan kasama. Di sya pwede iwan. So sabi nga nya masarap buhay nya compared sa ibang maids daw ng neighbors namin.

My help enjoy more than what the KBill provides EXCEPT for the 1 day off every 6 days of work, and payment once a month only.
(we are now at 24-hr leave every 15 days; 12th month off with full pay; once a month salary payment)

Those are my objections to the KBill; AND
         The 1month only probationary period.
         The requirement to give them time to study (should be my option, depending on my household service requirements). 
         And the requirement to keep records for 3 years.

Yeah i think aquacharly our hh got better perks than this law. Plus may 13th month pa and bonus yung sa akin.. D lang ako agree sa schooling. Paano pa yun gagawa sa bahay kung buong araw nasa school. Pag uwi sa bahay gagawa ng projects and assignments pa. Oh well basta ako,i will not add more hh and drivers kung magdedemand sa akin kung anong gusto nilang makuha. Aba sila ang may need ng work hindi naman ako di ba :)

Ang SSS, philhealth and pag-ibig ba dapat ayusin na agad or after 6 months or 1 year of service ang isang helper?

I have recently fired a helper of not more than 1 week of service in my household. Paano, super tamad at balahura. Paano naman ako gaganahan sa bill na ito kung ganung klaseng mga HH ang nakukuha ko. tsk tsk

^Leven. Exactly my point!  Yung mga maids kasi they will believe want they want to believe at mas madalas sa hindi mas naniniwala sila sa mga sabi-sabi kesa sa explanations ng mga amo nila. At base dyan sa maling paniniwala na yan, dun sila gagawa ng mga hassles sa mga employers.  Kaya ko nasabing puro problema dala nitong bill sa mga employers.

sisses meron na po bang IRR ang law na ito?  I tried researching sa internet , wala akong makita.

Can someone give us a sort of manual or hand outs as a guide for the draft of contract which we can follow. Ang hirap kasi dahil baka may makaligtaan ilagay sa contract at mahirap din mag translate ng legal terms . Most maids naman hindi masyado marunong ng English or even straight Tagalog .

I asked my maid to get her SSS number, the problem is ayaw nya asikasuhin because wala siyang copy ng birth certificate nya. Alangan naman ako pa maglakad nun? Kung siya nga tinatamad asikasuhin ako pa? Paano kung gsnito sitwasyon, saan ko ihuhulog SSS, Philhealth etc? Saka upon hiring ba , dapat may SSS , etc contribution na kaagad ?

Dilemma ko rin kung pano ko huhulugan ang mga yan kung wala naman syang docs.  ::) Basta sa akin pag ayaw asikasuhin ni hh yang SSS, PhilHealth and PagIBIG na yan. Hindi ko na problema yun, alangan naman ako pa ang pumila sa mga offices nun for her noh. OA na ha!  >:(

Exactly!  But based on a news article I've read, an official from the labor department said na tayo daw dapat ang magbabayad (pipila) for these.  When he was asked paano yung mga busy sa work, find a way daw.  Ngeek!  Although, yung mga papeles ng kasambahay, dapat yata kumpleto na upon hiring.  Di ko lang alam what to do if yun nga walang mapresent sa employer.

Yun nga ang sakit sa ulo diba? Bakit tayo ang hahanap ng paraan? Sila ang may kailangan ng trabaho diba? Eh di sila ang maghanap ng paraan para magkaroon ng trabaho.

Pag tayo ba nagapply sa mga companies pwede ba nating sabihan ang isang company na sila ang gumawa ng paraan para ma-kumpleto ang requirements natin para makapag-apply? Minsan nga sinasabi pa ng company "incomplete application/requirements will not be entertained".

Anyways, i have another scenario... if may sagot kayo please do share. Coz if feel na parang tinatali tayo sa Kbill na ito.

Si yaya, nakipagkwentuhan sa akin.

Yung kapatid niya na yaya din, binigyan na ng SSS and Philhealth ng amo niya. Si amo ang nag process at nagcocontribute sa SSS ang PHilhealth, after 3 months umalis sa work ang kapatid niya. Presently wala pang work yung kapatid niya (3 months unemployed). So inshort, walang work, walang pera, tigil contribution sa SSS and Philhealth. Hindi naman siya makapag voluntary contribution dahil nga walang pera.

So paano na ang SSS and Philhealth? Hindi naman nila mapapakinabangan ang SSS and Philhealth if incomplete ang contribution ng HH. Magiging "active" lang ulit ang SSS and PHilhealth ni HH if they can contribute again, and fill in the months where they missed the contribution.

Eh what if one year hindi nagbayad ang HH ng contribution dahil one year siyang unemployed? Will it be shouldered by the new employer?

So, dito na papasok ng problema ng "future amo" niya. Kunwari papasok ulit ang sister niya na HH, siyempre si "new amo" na ang sasalo ng SSS ang Philhealth ni HH. Should the "new amo" fill in the missed contribution from the time the HH stopped paying the SSS and Philhealth? If yes, so if one year missed ni HH ang contribution, babayaran ni "new amo" ang one year missed contribution for SSS and Philhealth?

Sis happy femme of course di sasagutin ng new amo yung missing contributions. Just like in any company if naging unemployed ka di na nila problem yung missing months without contribution.
