^Agree.

MEDICAL CERT.   Will I trust her piece of paper?   Kung ang  amo wants peace of mind walang contagious  disease yan --  we already do that, we send them to docs we trust for tests...  no need for the law to say so. Sa mga hindi particular abt that -- kahit wala Med Cert ok ok, hired.  Redundant provision, IMO.

But ang worry ko yung mabuntis yan pagnaka off at may paid maternity leave charge to me! 

CLEARANCES.   We already require NBI Clearance when we hire.  We do not nga need a law to acquire sentido common like that.  (Barangay/Police Clearances -- hahaha P100 lang meron  ka na nun. )

CELLPHONES Pag minimize ng cellphone use during work hours -- nasa pag discipline mo yan or convince/manage ng house staff mo. May strict amo like me, may maluwag.  Bakit pakialaman ang management style? They even go to the extent of hiding behind doors/stairs or kunwari walis backyard, sidewalk pero I see my neighbor's maid texting texting texting. 
We also don't need a law to understand that personal emergencies must be accommodated. We are in the Phils where  we do not lock up helpers like Flor Contemplacion. 

SEC.10.  As CHICAFABULOSA cited why the heck are you gonna share CONFIDENTIAL INFO  with  a maid?  What amo does that?! Really?  I need a law to realize that?
Or, are they referring to tabloid confi info like how many panties I own, if we gotta eat tuyo every day, if hubby showers every day? San ko demanda yan to get 10thou? San kukuha yan ng pambayad sa kin? Pakulong???  Get real, pano pigain ang pera sa mga yan?  Sa current amo? Susko.

TERMINATION OF SERVICE.

The prevalent poblem nowadays is that maids don't stay  around long enough.  Pag sita konti:  uuwi na ko Ma'am
May mag text: malaki sweldo dito!  Konti trabaho dito -- nasa office mag asawa araw araw!  --  Uuwi na ko Ate, may emergency/sakit asawa ko.
Holy Wk/Xmas up to NYear --  unahan ka pa magbakasyon.  Non-negotiable sa karamihan yan.
What Termination? Pag nag off yan, hindi na yan babalik! Where do I go: Isumbong mo kay Tulfo?
Provoke ka pa nila to fire them! Break things, answer back rudely, stops working - nakahiga, nakasimangot.  We wanna keep! Honest to goodness working maids!  What amo wants to terminate ba?

Untimely Termination by the kasambahy? Oh, this makes me smile? Basta hindi yan sisipot after nkuha sweldo at nag off.  Ano pa forfeiture of wages? Ano pa reimbursement of expenses?  Hahaha -- the maids knw, really know,  how to get their complete sweldo, plus more if umutang/advance. Tapos disappearing act! Lolz, WALA pa ko alam maid pumayag forfeit sweldo kasi she terminates en punto her agreed upon period of employment.  Pano kaya enforce ito ng DOLE?  Abot pa kami CA?

SEC 17. Kung on the Wanted List hindi mahuli or hindi hinuhuli -- san mo pahanap, at gastos ka pa
lagay, to locate the maid pag may ginawang hindi ok? Define.  Kung nakaw,  hindi ba gawa na natin police report?  O, minura ako tapos  lumayas or kinain lahat ng ref contents -- hahanapin ko for what? An apology?  We  have enough laws in place to define   what are misdeeds, and what procedures are required to acquire remuneration or consuelo pound of flesh for clearly defined misdeeds. 

All perspectives are heard here. Oo I read all. And the more I learn of this bill -- IMO, which is NOT a cybercrime hahaha.  --  it's redundant/stating the obvious of [textspeak!] is already happening;  parang making a mountain out of a molehill? 

Out of touch? We amos provide employment. We enable helpers to raise/help their families. The government cannot provide employment for all, we provide for those with minimal skills.
May garment industry pa ba tayo?
May shoe industry pa ba tayo?
Sige, unionize nyo, sige use a model that is applicable, not  here, but  to wherever Flor Contemplacion suffered -  it eill come to psss:  a lot of low skilled unemployable people's families will suffer more.  Eventually market forces rule: papayag na rin yan to forego the unreasonable legally mandated perks.

Ako: walang kasambahay.  Take that at face value.   No registration, no contract is the answer to an unreasonable and unfair law.  There is no slavery, no lock- ups like Flor Contemplacion's.  Kung hindi happy boarder ko --  go.  She/They do not need a law to know san sila pupwesto.  Common Sense is not acquired through legislation. Every kasambahay knows that.

It's the lawmakers who are out of touch.  I have a suspicion that these congressmen and senators do not manage their households kaya napaka-idyllic ng scenario presented in the Kasambahay Law.  This law presupposes that all househelpers are meek, disciplined, walang spite or malice sa katawan, hindi marunong.  Mga helpers ngayon, maraming excuses to get away with presenting birth certificate - ay nasunog po ang munisipyo sa province namin o kaya, masyado kaming poor hindi kami narehistro ng magulang namin and so on and so forth.

Re chismisan, even if you do not disclose confidential information to your helper (and sino naman stupid amo will do this, the makers of the law, perhaps :P), kung gusto niyang magchismis hindi mo mapipigilan at mapapatunayan.  Paano mo papatunayan ang chismis if sila-silang mga HH magchismisan?  And the fine, please naman, how will the maid afford to pay 10k-40k???  Will that fine repair the damage done?  Heck, NO.

And the written contract is even more strange.  Not all helpers are literate or intelligent (hindi sa nang-iinsulto ako, it's a fact) enough to understand the terms of a contract so kung hindi nagkaroon ng meeting of the minds eh di effectively walang contract.  Gagastos ka pang kumuha ng abugado to review the contract?  These lawmakers may have no idea how much is the hourly rate of a lawyer.  You can have a valid and binding agreement even without a written contract for as long as the parties understand, agree and have a meeting of the minds.

Sorry pero this piece of legislation is crappy, to say the least.  This coming from an employer who has dealt with all sorts of helpers - maid na magnanakaw, mahilig magpa-advance, nag-vacation di na bumalik siempre sunk cost na my expense for the travel allowance, air fare and advance, sinungaling, chismosa, text addict, hindi kumakain ng bangus at tilapia (really!), matakaw (5 kg of rice gone in just 5 days), mabigat ang kamay (may mga nasirang appliances and stuff na hindi ko naman pina-reimburse sa kanila, what for di ba eh di nga nila afford), etc.  And take note, these maids magaling mag-pretend dahil kahit gaano pang katagal ko in-interview, lumabas lang ang sungay weeks or months after hiring.  Real world scenario.   So many maids are mautak nowadays.  Uutakan ang amo and not the other way around.  What is my protection as an employer under this law?  WALA.  Thus, it is not fair, right?

marose17 and aquacharly You said it all.  Kahit anong anggulo mo tignan talagang dehado mga employers dito.  Contracts doesn't mean anything to them, basta naisipan nilang umalis, aalis at aalis yan.  Saan mo nga naman hahanapin pa ang mga yan.  Even to the extend na magsakit-sakitan or pretend to be losing their minds (nababaliw), happened to my brother.

Pati nga yung weekly off medyo dehado din mga employers.  Paano those who wants overnight offs?  So weekly yun ganun?  Or worst yung mga Friday night umaalis ng house then Sunday nights na bumabalik or worst Monday na bumabalik.  Madami-dami din ang gumagawa nito.  So para ka na lang nagpart time cleaning service.  Wala ka naman magagawa kasi nga di tumutupad sa agreed time and day ng balik, bigla na lang magtetext na di pa makauwi.  Ano pa magagawa mo eh wala na nga sa house niyo?  Kapag sinabi mo namang o kaltas na sa next day off mo, asahan mo na biglang may family emergency yan at goodbye na.  Ganyan na ang mga maids these days.

As for cellphones, wish lang natin pwedeng isurrender sa mga employers.  Kapag yan agad ang bungad mo, good bye na.  Don't expect you'd be able to hire a maid.  Bawal sa oras ng work?  Naku!  Lahat ng paraan alam nilang gawin just to be able to text and call.  Para di mahuli, maghead set, if you reprimand them, "Ma'm/Ate, radio lang po ito, mp3 player".  Or nagkukulong sa c.r. na kunwari naglilinis (with the water running ha), pero ayun nakacellphone.  At marami pang iba.  Tama si marose17 iba na mga maids these days.  Mas mauutak pa yan sa mga employers/amos.

^ sis marose17 tama.. i was discussing the law with y new maid kahapon and pati siya parang di comfortable sa setup. sa huli sila pa din ang masusunod. at yang mga maid na yan ay gagawa ng gusto nila. they have all the excuses in the world.
nakakasawa na ang excuses at alam na din natin yang mga excuses na yan. basta ako din, bibigyan ko lang siya ng sss if naka 6 months na siya.

Naku we cannot control yung mga maids na yan. Ako nga eh pati bf ng ex maid ko pinatira nya sa shop ko before. At ang kapal pati pagkain pala tinatakas pa sa house ko. Kasi at that time ginagawa pa yung shop ko so walang tao except workers. Pag afternoon dinadalhan nya ng food workers ko dun. Aba yun pala andun ang lalaki na yun. Imagine my horror no..

Agree!  Just a couple of weeks ago, a tindero from the market was recommending his cousin's wife to us para mamasukang kasambahay.  Humingi lang ako ng bio-data and baranggay clearance (since malapit lang sa amin yung binigay na address, I want some assurances lang), ayun biglang umiba ang ihip.  Ok lang daw if wala kaming tiwala at alanganin kami kasi ipapasok na lang daw sa iba at marami naman daw naghahanap.  So pano pa kung hiningan ko ng lahat ng documents and magpasign ng contract?

Wow daig pa nila ang may phd at years of experience sa work place kung magyabang! We've had maids din na ganyan grabe kala mo dyosa kung magdemand.My mother'slast helper had a son na nakatira sa mama nya. The mother brought the son sa house and tried to ask for money 4,000.Tapos sabi ng maid sa mother ko bigyan na daw ng 4,000 or else pa paalisin sya ng mama nya or iiwan sa house namin ang bata. My mother didn't give them money so iniwan ng mama nya ang bata sa house. Sapilitan.Ang point nila ayaw nyo kame bigyan ng pera pakainin nyo yang bata. Panalo di ba?May demands?

So asan sa Kasambay bill na yan ang protection ng employers sa ganitong scenario? Biglang lalayasan ang amo at may blackmail pa nalalaman. Panakot nilasa demands nila "aalis nalang ako ate!" or"pinapaalis na ako ng asawa/nanay/tatay/kuya/ate ko kasi hindi nyo sila pinautang!"

the protection is the contract signed by both parties.
umalis yung kasambahay without fulfilling the contract, you can sue for breach of contract, nasa record na niya iyon.
thats why its important to follow the kasambahay law. kung wala or kulang sa papeles huwag tangapin ang kasambahay, kung ayaw purmima ng kontrata, huwag rin tangapin.

kung ang nakalagay sa kontrata off ng sunday, from 0700 to 0700 monday, pag late or hindi na  bumalik, breach of contract yon.

So paano kung ayaw ng maid sundan yung Kasambahay Bill and okay na siya sa existing terms niyong mag-amo?

I'm thinking of making a contract na she is agreeing to our terms and will not follow the current Bill and I will not be held
liable kung ano man mangyari. Pwede kaya yun?

Na overheard niya mga HH niya (2HH), naguusap kasi medyo aware sila sa Kbill dahil naririnig na nila sa news.

Naguusap daw yung dalawang HH na magnunursing daw sila, balak daw nila pumasok this coming SY2013. Kakausapin daw nila friend ko dahil gusto daw nilang mag-aral since they heard about the bill daw.

Nakakatawa kasi may plan B pa daw ang dalawang HH, kung hindi daw papayagan sila ni Ate at Kuya mag nursing eh mag culinary nalang daw sila. Kasi naiinggit daw sila kay Juday sa Master Chef!

Ang gusto kong itanong rito kung halimbawa may mag-apply pa lang na maid kung pwede itanong agad sa kanya kung may plano siya mag-aral. Tapos tanggi yung amo sa una pa lang kung pwede hindi siya tatanggap ng working student. Kasi may dahilan siya kung bakit kailangan niya ng maid eh.

Yan na nga ang isa sa mga potential problems nitong bill.  It would be prone to misinterpretations therefore prone to abuse.  Marami kasing broad and vague provisions dito, gaya niyang pag-aaral na yan.  Nung una din pagkakaintindi ko is employers ang magpapaaral, pero upon reading the section again parang hindi naman.  Parang ang ibig sabihin lang is dapat payagan silang maging working students.  Kaso nga malabo at minadali ang bill na ito kaya kanya-kanyang interpretations.  Laking sakit ng ulo!

Kaya magandang advise talaga rito before hiring maids, kailangan talaga basahin at intindihin ang kasambahay bill tapos consult a lawyer. Then kung may contract dapat pabasahin rin sa maid mismo both english, tagalog or kahit their own dialect version para walang lokohan. Like baka mamaya ang akala ng maid amo ang magpapaaral if gusto magworking student pero yun pala yung payagan lang kahit walang tuition galing sa amo.

Exactly. Medj magulo/istorbo may working student maid.  I tried that before -- send them to school. Susko. 
May nag drugs. May na preggy -- ako pa inaway ng nanay kasi  pinalabas ko to go to school.
Meron como nag aaral naging hoity toity sa kapwa maid -- kagulo sila.
Meron lumaki ulo --chooses what household tasks she will do, umarte dating: colegiala daw sya, pag
may texts/exams -- won't work at all. 
May security issue -- cuento cuento about househokd scheds, at nagpappunta ng "boyfriends". 

Nowadays  -- ayoko na. Mag ipon ka tapos leave my household to study. 
Kaya AGREE ako with PURPLE POWER --  no to working student maids.

Engineering pa yung pinag-aralan niya ah! tapos yung napangasawa niya ganun rin Engineer. After nun nakapag Brunei pa silang buong pamilya pero ngayon ibang iba ang nangyari may financial problem sila ngayon tapos yung anak nagwowork na namomroblema rin sa finances. Compare sa mga kasabayan niya sa tindahan noon eh! ngayon puro mga umasenso na sa America kahit yung iba sa kanila hindi nakapagtapos. Then yung iba sa US na mismo nakatapos at naging Presidente na ng kumpanya, samantalang sa tindahan noon sila yung hirap na hirap dahil sa totoo lang against pa nga sa Kasambahay bill yung working and sleeping hours nila.  ;D Maswerte lang Lola ko hindi niya inabot ito.
