Yep I agree u can always just fire 'em and get another one. I've had two nannies and my son is just 3 months old. Although it should be relatively easy to get a replacement madaming gusto because the pay is sligtly higher than usual, we live in a condo (which means [textspeak!] naman lilinisin nya here? As if its super laki) , im a sahm so i take care of the baby most ofthe time, i think ang mahirap ay kumuha ng talagang matino. U can always fire 'em nalang agad get a replacement but its hard to keep training helpers nang paulit ulit nakakapagod. Plus the initial investment -maybe the employer paid for the medical already, requirements, bought the helper uniforms, supplies, enrolled her sa cooking classes etc etc thats why nahihirapan the others to just fire 'em agad and get another one kasi that would mean another set of supplies, uniforms,money again for their requirements and training again (khit gaano yan kagaling ud have to teach em the rules around your house).

Sana magkaroon ng FAQs nito. Some questions that I have:
- What about part-timers na arawan ang rate? (Example, I have a lavandera that comes 2x a week to wash and iron, and I pay her a flat daily rate) Do I have to pay her SSS, Pagibig, etc?
- Pwede ba ang no-work, no-pay arrangement? Especially sa mga kasambahay na hindi tumutupad sa usapang kung kelan babalik sa day off. Plus,I know they get a paid holiday of 5 days per year, but if the maid is going on vacation for 8 days, no pay ba yung 3 days na balanse?
- What about maids na puro utang or advance? Ang intindi ko is either you stipulate in the contract na bawal ang utang or that, bago umutang, kelangan istipulate na yung deductions in a written document, including the schedule. What do you think?
- I get the impression na you can say na bawal ang cellphone during working hours? "The employer shall grant the domestic worker access to outside communication during free time: Provided, That in case of emergency, access to communication shall be granted even during work time."
- Naguguluhan ako sa "deployment expense". Sagot ba natin yun or nung kasambahay?
- "The domestic worker and the employer may mutually agree for the former to temporarily perform a task that is outside the latter’s household for the benefit of another household... Such work performed outside the household shall entitle the domestic worker to an additional payment of not less than the existing minimum wage rate of a domestic worker."  - During long weekends, we usually spend it at my parents house. Siyempre kasama si kasamabahay and she helps out as well (my parents have their own kasamabahay); does that mean I have to pay her extra?

^bakit parang pabor na pabor sakanila ang bill na yan? what about us employers? sa totoo lang tayo pa nga ang mga victims ng mga helpers na yan. iilan lang ba saaten ang nakakakuha ng matinong maid? wala pa yatang half. i was watching the news kanina sa unang hirit and my maid is also in the living room, hay naku, inutusan ko nga para di niya mapanood at baka kung ano anong demand ang gagawin. pag gusto magpa taas ng sahod, kunwari aalis at may papasukang iba para nga naman i-counter offer mo.

Take note ang dami pa nilang vacation leaves as in monthly dahil sa period nila.  >:( Kainis lang. They will be more abusive for sure.

kanina nabasa ko sa official gazatte. r.a. na nga ang kasambahay "bill" so ibig sabihin law na and kailan ba start ng implementation ito? napanood ko sa failon dati millions ang kasambahay sa pilipinas. and they can generate funds also from their sss, pagibig and etc.

kung hindi nakikita ng amo ang kasamabahay kasi they are both working paano mamomonitor ang galaw o expenses ng yaya? kapag Sunday obligado sila magpahinga kahit na kapag wala ang amo at tulog ang alaga nanonood lang sila ng tv?

kung sa education, ayaw naman magaral pipilitin pa ba? ang daming butas parang cybercrime law lang.

Ay bakit hawala yung link? I was just reading it this morning. Wala naman naka stipulate soon na menstrual leave/maternity leave etc, just the daily rest of 8 hours and weekly rest na 24 hours which can be discussed daw between amo at kasambahay Kung may iba slang arrangements.

sana  before ma avail ng kasambahay dapat matagal na sila sa employer. parang common employee after ng 6 months na probationary saka palang na coconsider na regular at saka meron ng benefits. lapit nakasi ang election at ang habol ay boto kaya siguro inaprubahan.imo.

^Yan rin ang inaalala ko in the near future kapag dumating na yung oras na mangangailangan ng Nanny lalo na't ang hirap magtiwala ngayon basta basta. Gusto ko rin yung sa US kasi ginagawa rin ng Yaya ko yun na nagseservice sila ng cleaning. Kahit medyo mahal mas ayos na yun saka feeling ko they will do it professionally kasi hindi mo siya kasama sa bahay. Unlike kapag kasambahay mo mismo eh parating manonood lang yan ng TV.

ako kasi i dont have a stay-in helper since kami lang ni hubby sa house. minsan lang pumupunta stepkids at mga pamangkin ko,like during weekends lang. so, mas ok sa akin yung parang cleaning service lang. hindi ko siya nakuha sa mga cleaning service company. she is someone i knew through a friend. okay naman siya masipag, pag naglinis ng bahay talagang malinis at malinis rin at mabango maglaba. tanong ko lang since may kasambahay bill na, covered din ba siya dito kahit once a week lang siya sa amin maglinis?  :)

(d) Domestic worker or “Kasambahay” refers to any person engaged in domestic work within an employment relationship such as, but not limited to, the following: general househelp, nursemaid or “yaya”, cook, gardener, or laundry person, but shall exclude any person who performs domestic work only occasionally or sporadically and not on an occupational basis."


my interpretation (hehe):

If you directly employ a person (not thru a cleaning service) to clean your house on a weekly basis and not on an occupational basis, she is not covered by this law. :) Because even though you are the direct employer, the definition of "domestic worker" covered by this law does not apply to her because the person performs domestic work occasionally and not on occupational basis.

Even though the term "occasionally" has not been clearly defined, i think it's good enough to serve as a counter-argument so as to exclude your "weekly helper" from this law. :) but it's better to hear a lawyer's interpretation... any lawyers here?? tama ba ang interpretation ko? hehe. to GT lawyers: Would a cleaner (directly employed, not thru a cleaning agency) who performs domestic work on a weekly basis be considered on occasional basis thus excluding that person from this law? hindi kasi clearly defined yung "occasional"...

sis meimei thank you so much for your insight. ako ganon rin ang pagkakaintindi ko.kung clearly defined lang sana we could understand more no?  kaso hindi nga clearly defined yung occasional so sana may GT Lawyer dito na makasagot.  :)

Kasi ang cleaning service naman parang mga tubero or karpintero na tinawag mo sila dahil may kailangan kang ipagawa at yung bayad kaliwaan hindi naman yung necessarily na employed sila sayo kundi parang suki mo lang na hanggang pera lang ang iaabot kaya siempre wala nang responsibility sa mga benefits and all.

Parang ngang feeling ko mas professional pa ang cleaning service kahit papaano eh! Kasi they are obliged to do the job. Unlike yung in-house kailangan kukulitin mo pa to do her job tapos aabusuhin pa. Saka yan nga maraming nakawan issue kasi kabisado nila yung bahay eh!

Kapag ganyan paano mo tatratuhin ng maayos ang maid na parang part pa ng kapamilya?

Yes, there are costs incurred & effort + time in training-breaking them into our household ways .
But such cannot be avoided, for obvious reasons.
BUT better to fire, inspite of incurred costs, a helper who does not perform satisfactorily or behaves badly.
In the long run, an amo loses more or puts her kids/family at risk by compromising her standards by keeping on a lousy-performing helper  due to her panghihinayang over incurred hiring & training costs.  IMO, mahirap pigain ang bato/walang maibubuga na maid (or ayaw bumuga, hehe),
I would rather "cut my losses" than prolong my consumisyon.

It is not that we may not be smart enough  in hiring per our requirements...but that, as noted by others, maids have become very adept at misrepresenting their skills/themselves.

napanod ko lang sa ted failon....yung ibang issue kase napag-usapan dun.....about sa pagpapaaral sa kanila...pwede isuggest nung kasambahay kung gusto nya mg-aral....pero kung di pumayag si ma'am/sir wala magagawa si kasambahay....andaming pabor sa kanila....kahit kami hirap narin makahanap ng yaya...lalo lang lalaki ulo ng mga yan dahil sa batas na yan....ang isa pang nakakainis ang dami nilang leave...pati ba naman yung monthly period? kaloka!!!! pano kung talagang tamad lang ang yaya at dinahilang 5days ang period nya? alangan naman check mo yung kepyas nya para lang patunayan na meron pa syang regla? hahaha!!!yung pasahod wala naman prob saken....kahit yung benifits...kase binibigay ko pa dati yun pag meron kami yaya..... ano naman pakinabang sa yaya nung bayad sa pag-ibig? yung SS at philhelath okay lang eh! di ko pa nababasa ang kabuoan ng batas...

^Pag-ibig kasi sis may savings component yung membership dito saka pwede mag-multi purpose loan and housing loan. Yung philhealth, kung hindi ma-hospital, bayad ka lang din ng bayad.

jaddah: regarding monthly period I am wondering kung 5 days ba talaga kailangan or baka naman kung pwede 2-3 days lang. Kasi yung 4th and 5th hindi naman na ganun kabigat yun. Saka kung gagawin nilang 5 days ito grabe naman bakasyon grande na sila tapos tayo pa magbabayad and to think monthly ito mangyayari. Eh di 3 weeks in a month na lang sila nagtatrabaho so parang 15 to 17 days lang in a month kasi isama mo pa na may weekend off sila sa bagay isa lang naman ata yung sa weekend pero kahit na ang daming leaves pa rin.

Regarding naman kung paano mo malalaman, ang gagawin ko dyan is once naman na sinabi niya yan eh! record na dapat. I mean example sinabihan ka na meron siya pero dapat sa first day niya sasabihin hindi yung basta na lang siya hihinto sa trabaho. Tapos dun na simulan magrecord. Para kapag nandaya siya wala siyang lusot.

Totally agree! Siguro nung ininterview ni Ted Failon nasa proposed bill pa yung menstrual leave, pero buti na lang at wala na siya dito sa final/approved version ng bill -

Ang hirap ipatupad noon, paano ipapakita ba ng maid yung kanyang soiled feminine napkins as proof of period?! EWWW! Saka paano kung more than the average of 4 days yung babae? I have several friends with PCOS na umaabot ng 2 weeks kung magkakaperiod.

Aba kung meron silang menstrual leave, dapat meron din tayong mga nagtatrabaho, even sa corporate! So, buti na lang talaga at tinanggal nila iyon dito sa final version na pinirmahan ni Pnoy.

I'm eager to look at the contract na supposedly DOLE ang gagawa ng template. Sana ilabas na kaagad, dahil ang dami ngang vague portions itong bill na ito.

Daig pa nga ng law na to yung corporate world. Wala naman kameng mestrual and birthday leave.

Seriously, di na ako kukuha ng maid. Magiging sakit na ng ulo ko sila for sure. And because of this law, lalo baba amg employment rate. Aminin na natin mas mdali maghanap ng work as maids, driver di ba. Dahil dito sa law ma to, marami na magiisip kung kukuha pa sila or hindi na lang. So meaning mas tataas ang unemployment. Mas rarami na naman ang squatters. Sabagay politicians love squatters... Mas maraming boto yun for them. Mas madali kasi sila mauto lalo na pag pag napangakuan sila and pag nabili na boto nila
