ay ano ba yan sisses ang hirap magreact sa bill nato kasi pag di marunong umintindi yun kausap mo feeling nila maldita ako,, di naman siguro magtatagal ng 8 to 10 yrs ang hh ko kung ganun ako,,

sabi ko sa hh ko kahapon oh pano yan bawal ng magtext habang namamlantsa, magmanicure habang nanonood ng tv at etc pag naipasa na ang K BILL na yan :)

Sumasakit ang ulo ko sa bill na to ah...  pero since wala pa ako help dito sa bahay, i can make use of this bill sa mga bago.  ang problema, may papayag ba.   :-[   pwede kaya gumawa na lang ng contract/job offer sa househelp, and let her sign, a proof that she agrees with your rules?


like SSS, Philhealth, pati ba Pag-ibig, siya na bahala kumuha nun.  Without those numbers, wala siyang benefit.  Hello, ang hassle kaya kumuha ng mga yun, dahil karamihan sa kanila walang birth certificate.   :o  kung meron man, kailangan authenticated sa NSO.  so since employers are required to pay the share, dapat kumuha din ang mga HH ng NBI clearance and Barangay clearance, as well as medical certificate.  That is just to ensure that the people we entrust to take care of our home, are also reliable and trustworthy.   Para naman may habol tayo kapag sila ay nagloko.

or kung ayaw din nila kumuha ng mga numbers na yan, kasi nakakapagod or "Ate, di ko alam yan kung paano", well perahin na lang natin.   ;D  Gumawa na lang ng waiver or contract na the katulong understands these conditions.  Employer can still give those contributions at bahala na si HH kung gusto niya ba ihulog ang mga contributions sa mga offices na yun. 

Sample computation:

like sabihin natin ang starting
                               base salary niya is 2,500
                                               SSS        300
                                         Philhealth      150
                                         Pag-ibig        100

Offer Pay is P3,050 plus other Benefits
 
4 days off per month
with 13th month bonus, and free round trip fare kung umabot siya ng 1 year.  otherwise,  one way lang.
annual increase according to her performance.
Food, Toiletries, First Aid medicines are provided.
TV/mani-pedi/Texting/ whatever should be done only in their break period.  Total of 1 hour.  Nothing more.


work hours: 7am - 7pm : 12 hours, so she has 4 hours over time  (Tama ba na 8 hours lang dapat work nila? I forgot kung ano sabi sa bill eh), she will get additional 20% of her hourly rate.

Overtime Pay: (((Daily Rate / 8 hours)  * 20%) x # of hours OT)
                         (P96 daily rate/8 hours) * .2 = 2.4 x 4 hours
                        = P9.6 OT Pay everyday

Kung ayaw niya mag off, paid off with 20% additional of her daily rate. 
   (2500/26 working days = P96  daily rate + 20% = 115)
So assuming, ayaw niya magoff for the entire month, she gets
  P115 x 4 rest days = P460
at assuming everyday siya may OT even sa rest days niya,
   OT pay = 9.6 x 30 days = 288

Total Net Pay = P3798

Ngayon, kung gusto niya mag off lagi at walang OT lagi, she gets P3,050.  pasok pa din sa minimum.
any changes of the salary and benefits means a change of contract.  dapat may pirmahan lahat.

I think ha with the K-bill may  personal contribution din dapat si HH for philhealth pagibig SSS aside from the matched contribution ni emPloyer. Parang sa office. So it's either you add more to cover her "personal" contribution on top of the salary + employer's contribution or you tell her she should shoulder her personal contribution out of her base salary. I don't think they'll agree na out of their base salary cause that will mean a lower take home pay

Currently kasi ang setup namin, my maids make individual contribution as if they are self employed. I shoulder that and their salaries are intact.

^pareho tayo, they will say NO  to SSS membership if I deduct their counterpart contribution. But to keep  it at the bare minimum for my shouldering the entire contribution -- - they enter as Self-Employed.

But given this KBill -- Hindi na ko payag dyan. .  Hello.

PINKBERRIES, puede na wage wise -- hello, we pay more than the 3thou per month actually.
It is the 1 day off after 6 days & the 9-6 hours.

Just accounting for the contributions, the OT & 2x monthly wage payments --  the bookkeeping & record keeping is extra work ha! 

HALLOWEENCAKE: que stay out or stay in -- same rules apply. :(

Mahirap ito i-offer sa mga lumang Househelp lalo na yung mga 4k and above na ang salary. 

Pero what about sa mga bago HH who wants to work for you?  Sabi ng bill, minimum of 2500 eh.   ;D Maliit lang naman ang contributions ni HH, so I can just shoulder that.  Para attractive pa din, kahit 2500 lang ang base salary. 

Like sabihin ko kay new HH, " Starting Pay mo 2500, but ill be giving you 300 for SSS, 150 for Philhealth, 100 for Pag-ibig.  Ikaw na bahala Inday kung gusto mo ba ihulog doon, wala kasi ako panahon para pumila to pay those."   ;D


with other benefits pa, hindi na siguro ako makasuhan niyan  mga sis ano?

^if you read the bill, sa intindi ko,  the amo is responsible for record keeping for 3 years - that goes for salaries & the contributions, pati contracts, and clearances.   Dapat pati resume of skills & certified proficiencies ano? .
Kahit sya magpay - you still need to follow-up to be able to keep 3years' worth of running records.

P3000 for MManila di ba per the bill??

I talked about this with my husband and he suggested instead of giving them their annual increase, we will cover their personal contribution. That way intact pa din their base at the same time we meet the requirements of kbill. Hindi namin kaya to give both now. Anyway their base salary is way more than what is required. I haven't discussed this with them Pero feeling ko di sila papayag. Siyempre it's better if they have that extra money

We used to have one helper na no read no write talaga. Then dito sa Base kailangan kasi lahat ng nakatira may ID so dapat kumuha ng NBI clearance, Barangay Clearance, tsaka Birth Cert. Dumugo talaga ilong ng asawa ko kasi siya man ang kasama magfollowup lahat. Ni birthday niya hindi niya alam pati edad. Hindi rin marunong magsulat so kailangan siya ang magfill up lahat ng form. Pati ata spelling ng name niya feeling namin wrong spelling yun..kasi Epipanya daw, di kaya Epifania yun...Pati yung edad niya hindi tugma sa birth date niya...ano pa kaya kung SSS, pag-ibig at phil health. Sabi ni Hubby di nalang daw kami mag helper at baka makasuhan pa siya dahil mali mali nalagay niya...lol

OA naman yun! di ba kaya ka nga kumuha ng HH kasi busy ka at marami kang ginagawa... eh bat pati pag file ng records nila iaasa pa sa amo... magisip nga sila... darating ang time na sasabihin sa iyo ng HH mo... Ati, paki kuha nga yung file ng SSS ko, may-e-chichick lang ako!

@aquacharly  okay 3000.  noted.  :)  3 years record keeping, hmmm ang tagal naman nun, nakakastress naman kung ako pa pupunta sa mga agencies na yun to pay for one househelp.  hayy

@leven sis, naexperience ko din yan.  kumuha kami ng authenticated birth certificate niya.  ilang beses hindi na process kasi hindi makita sa record.  yun pala, ibang spelling ang nakalagay.

^kaloka ano? Instead of having more time with your family may dagdag work ka pa. Pero ako I keep their salary record. Na trauma na ako sa previous maid. So kada suweldo they sign an index card indicating their salary + deductions

totoo yan... maraming HH na wala or may problema sa birth certificate. Bukod sa inconsistent ang mga info, meron din wala talagang birth cert, di pa na register... ilang taon na... haay naku!

paano pa kaya kung SSS number... swerte ako ngayon kasi yung SSS ng HH ko, pinapasabay ko lang sa bayad sa opisina, so no worries ako... yung pag file na lang ang aasikasuhin ko... Haaay naku ulit!

@hunny_ally  maybe i can do that, keeping their salary records + deductions.  pero ang contributions, mahihirapan ako niyan.  kasi mas gusto ko na sila na lang ang magbayad.  grabe ang pila sa mga agencies eh.

or i can ask their receipts na lang kaya... tas push ko na lang siya to pay it on time.   Pangmayaman na ang magkaroon ng HH ngayon.  hayy  :(

To add more sa sakit ng ulo nga mga amos:

I will give an example sa isang friend ko. As much as she would like to give SSS and Philhealth sa tindera niya, hindi magawang bigyan kasi according kay tindera hindi na daw niya makita ang birth certificate niya tsaka parang manghihilot lang daw ang nagpa-anak sa nanay niya. So ang ginawa ni friend, pinagawa niya si tindera ng sulat na kaya siya walang SSS and Philhealth because of the reason na hindi niya ma-comply ang requirements. And para hindi siya mareklamo sa DOLE ng tindera niya.

Months passed, umalis si tindera. Then three months later, may reklamo na siya sa DOLE, si tindera ay nagfile ng reklamo na hindi siya binigyan ng SSS and Philhealth ni friend. Pinakita ni friend yung ginawang sulat ni tindera kung bakit walang SSS at Philhealth si tindera.

Sabi daw ng taga DOLE, if walang birth certificate ang employee dapat mag file ng "late filing" sa NSO para magkaroon daw ng birth certificate si tindera. Hindi daw porket ayaw ni tindera eh hindi na raw magbibigay si employer ng SSS and Philhealth, mandatory daw.

Sumakit ang ulo ni friend, kasi ang ayos ng usapan nila ni tindera. Pero nung umalis na sa kanya, ayun at binanatan siya ng reklamo.

The case is still ongoing, and yung humahawak ng case ni tindera ay parang humihingi pa ng "lagay".

We will be experiencing this kind of example if matutuloy ang K-bill na yan.

^anither q, who will shoulder the filing for the birth certificate? Si amo? Nakaranas na ako mag-ayos ng birth certificate (wrong entry) and madugo siya. Had to go from one office to another. Not sure of the process for late filing. Baka kailangan magpunta ng yaya. Paano if far flung barrio? Sagot ko pamasahe? Lol! Ok Lang for new hires. Eh di policy ko I won't hire you if incomplete docs. Paano those currently on board? I'll tell them you can continue your employment with me til you complete the docs cause ayaw ko ma-DOLE?

Are they even releasing implementing rules and guidelines for this bill?

^^wow! ibig sabihin ba nun e wala ring kwenta ang mga waiver na pinapipirmahan (like sa hospital kapag nagpadischarge ka)? i was thinking magpapirma na lang ng waiver kung mahirap talaga e. kaso mukhang di rin pala pwede?

@happyfemme  kaloka yun sis!  oo nga, sino mag shoulder ng expenses sa mga requirements na yun?  late registration, medyo mahal yun especially pag matanda na at wala pa rin birth certificate.  penalty charges daw kasi yun.

Kakabasa ko lang ng Kasambahay Bill, grabe kailangan ko yata iprint ito para maalala ko lahat.  Sa dami  ng benefits, lalo ako firm na 3000 na lang ang starting pay ko dito and 2000 lang sa province.  But still, hindi ako sang-ayon sa maternity benefits.  eh hello, hindi lang sila nakaupo eh.  Kung makunan pa yan, lalo magastos. 
 


Art. 142(B). Medical certificate, police clearance, NBI cleanrance, barangay clearance and birth certificate as prerequisites for employment.  As prerequisites for employment in domestic work, all prospective applicants should secure the following documents.

(a) Medical certificate attesting to the physical and menatl illness of the domestic worker to be secured from a licensed physician;
(b) NBI clearance;
(c) Barangay clearance; and
(d) Duly authenticated birth certificate from the National Statistics Office (NSO).



At least nakasaad doon na hindi amo ang magproprocess nung mga requirements.   
Probably yan ang maging new policy ko, lalo na sa maging bago, kung walang documents, no work!  Good luck naman kung makahanap ako ng maid na meron lahat nun.

Yun nga din mga sis ang tumatakbo sa utak ko. Alangan naman tayo pa? Hindi ako kumuha ng HH para taga-process ng mga documents nila.

What if nag nosebleed ka na kaka-process at nabigyan sila ng birth certificate tapos magugulat ka "ati, aalis na po aku". So, luhaan nalang tayo? Tapos sila may birth certificate na! *high blood mode*

Kung sila nga mismo hindi nila ma i-spell ang mga panganalan nila ng maayos eh tayo pa kaya? Meron nga akong HH kilala siya sa pangalang "chaking". Sabi ba naman niya "chaking" daw talaga ang pangalan niya ever since napunta siya ng Maynila. May magulang ba na papangalan ng ganun sa anak?

Meron naman kaming HH na nilalagyan ng "H" ang pangalan, gaya ng "shielah", "annah", "jhosie". Ewan ko tuloy kung anong tamang spelling. Akala siguro ng mga HH, ganun-ganun lang ang filing, na kapag may correction eh buburahin lang ng pambura ng lapis.

And true, because of "late registration" feeling ko din may mga charges nga.

better treat them as ordinary applicants na lang. if hindi complete documents, bye bye.. ako amo, hindi dapat ako ang mamroblema. if they want work, they better process the documents themselves. (philhealth, bir, sss)  hindi ko na problema iyun  :P

ang magulo sa pagbabayad ng benefits (philhealth, sss)  as employers, pwede kaya sa bank na lang dumaan? ang hassle pumunta sa government agencies para lang magbayad.

sa isang normal employee na once a week lang ang day off, pangangailangan pa ni maid iintindihin?
