hi, what if nakapangalan yung title/deed of sale sa parents nung illegitimate child?

like this scenario (para kaseng joint property siya, and ang naka state yung name below dun sa deed of sale):
MOTHER's name(kabit/not married to guy)/FATHER's name(married to other woman and has 2legitimate children)

However, the mother died first. They both have a son naman. Kanino dapat mapunta yung property? Di ba dapat sa anak nung 2 person nakabuy nung property o dun na lang sa living FATHER which is married and has living wife and 2children. Baka kase mapunta lang sa kanila which is dapat sa pamangkin ko(illegitimate child). Since pera naman nung nanay niya yung pinang-buy nung property. Paano or pwede ba mai-transfer sa pamangkin ko yung property?

based lang to sa explanation sa akin ng isang taga-BIR nung inaayos namin yung title when my dad died...

if married kasi sila, before the death, 50-50 sila. when someone dies, the surviving spouse keeps the initial 50% na share nya in the first place and gets 50% of the deceased's 50% (25% of the property) and the children will get the other 50% (25% of the property). meaning, if married sila, 50% (share talaga nung guy) + 25% (50% ng deceased spouse) = 75% will go to the guy and 25% lang will go to the child.

since di naman sila married, the guy still keeps his 50% but the child should get the full 50% of the deceased.

of course, it would be better to consult with a lawyer.

Nasa stage palang ng processing of extrajudicial partition si husband & his siblings, 5 of them. Lahat doon naka-indicate ang properties na paghahatian nila bale 1 in QC and 2 in Caloocan. For notary na yung doc pero a cousin of his BIL  advised na mas maganda daw kung separate doc each property/area kasi masisilip pa ng BIR at malalaman pa daw nila yung other property baka mas mahal ang singilin na tax sa kanila. So they are planning to revise it. Meron pa syang namentioned about free patent act para mas mababa ang babayaran nila na tax for transferring title. bale each individual is only allowed ng 250sq meter (but he will double check pa) ang mangyayari the property in QC (320sq m) nakapangalan sa 2 siblings then yung sa Caloocan 3 sila since dalawang lote yun tig-360sq.meter kulang pa sila ng isa kaya ilalagay na lang nila ang name ng pamangkin niya will act as a front lang kasi sa docs naman nakalagay na di pwedeng ibenta without the signatures nilang magkakapatid. Di kaya magkaproblema in the future ang ganitong set-up?

Ganito pala kadugo ang transfer ng title  plus the fact na kailangan may budget ka talaga.

i have a question, may property ang lolo ko under his name sa Mindoro. he is already dead and left no will. he has 4 children and pumayag na lahat na ibenta yung property. however, one of the children (my dad) is dead na rin. kami lang ng mom ko ang heirs nya and payag rin kami na ibenta ang property.

nilalakad ng isang tito ko now [textspeak!] estate tax ng lolo ko and biglang kinukulit nya kami ngayon ng mom ko kasi hinihingi raw ng BIR ang birth certificate ko (which I understand), land holdings certificate ng dad ko, certificate of residence ng dad ko and paperwork ng bahay namin here in manila (property declaration, tax clearance, etc) na pinundar ng parents ko na nakapangalan na sa akin ngayon. (nilipat na sa name ko [textspeak!] property after my dad died)

bakit kelangan yun eh wala namang kinalaman [textspeak!] property sa manila sa property sa Mindoro since sariling pundar na yun ng parents ko at from the start, sa pangalan na nila yung bahay.

ano ba talaga ang process ng estate tax kung patay na ang isa sa mga heirs (my dad) and may heirs ring naiwan yung namatay na heir (kaming 2 ng mom ko)?

also, pwede pa rin ba kaming habulin ng BIR for estate tax ng property ng lolo ko na never naman nalipat sa name ng heirs nya? hindi kasi naming sinama yun nung inayos naming [textspeak!] estate tax ng dad ko since hindi naman sa pangalan ng dad ko yung property sa Mindoro.

^sis, in your case, 2 extra-judicial settlements would be required.  1 for the estate of your dad (his share in the mindoro property) and 1 for the estate of your lolo (here, you will be parties as heirs of your dad. is the property an agricultural land? if yes, that may be the reason why the bir is asking for  a land holdings certificate. no valid reason for the certificate of residence and docs of other properties. actually kasi yung bir minsan kasi hindi required and no legal basis yung docs, hinihingi nila. they just like na pahirapan mga tao. =)

with regard to the estate tax, you have to pay for the estate tax for your dad's share sa mindoro property. as for the estate tax on your lolo's property, you will also have to pay for that (divide 4 kasi 4 shares/children). pero the bir cannot run after your other properties. yung payment naman gagawin once i-process yung transfer ng titles to the heirs' names.

need help mga sisses, san ko ba pede ipa consult yung problem ko regarding sa pag papa process ko ng transfer of title. dami kong hindi maintindihan especially sa BIR part. mejo napabayaang property ng parents ko na kame ang mag aayos. kung meron ditong maalam sa gantong process please i need your help. thanks in advance. wala din ako kakilala to enlighten me.
