pa-help  po please. here's our story...

Yung parents ng husband ko got a loan from the SSS nung early 90's. After a few years they went to Canada. At first nagpapadala sila ng money sa youngest brother ng hubby ko for the monthly payments for the loan. Ang nangyayari pala eh tong si youngest brother binubulsa yung pera and ang ending iilitin ng SSS yung bahay at lupa nila unless they pay. So kinausap ng hubby ko 2 brothers nya para reconstruct yung utang. Wala daw silang pera para maka-help sa pagbabayad monthly. So to cut it short, hubby paid for everything.
Now, dead na both parents nya. Hindi nasalin sa name ni hubby yung lote. Ngayon yung brothers nya gusto magtayo ng bahay sa lupa na binayaran ng asawa ko actually the eldest brother nagtayo na lang basta ng walang paalam. nakita namin may pader na. We don't live there kasi umuupa kami sa isang commercial/residential area for our business kaya gusto na sana mabenta ng asawa ko yun at bumili na lang kami sa ibang area.  Is there a way na makuha ng husband ko yung share nya? Di naman niya kukunin lahat. Gusto niya lang mabalik yung kanya talaga. Yung sibs niya kasi walang inatupag kundi magn-isa ng kapwa.
He has only the receipts from the SSS as proof and a speacial power of attorney from his dad dati that says na yung hubby ko ang mag-pay ng dues ng said property.
Sana may answer sa problema naming ito...

1st.. bad move na binayaran niyo pa yung utang.. hindi niyo naman kailangan at hindi din kailangan ng parents niyo..

2nd.. since nasa pangalan pa ng parents mo, automatic,   of equal parts ang hatian ng property since patay na sila


nakanino ba yung title? kung nasa inyo ng hubby mo.. benta niyo nalang asap.. o kaya sangla mo .. natural, hindi dapat alam ng mga kapatid niya... yun lang way para makuha yung money niyo ulit..

ang sama ko ba? :P

^actually sis, nung time na yun nandun business ng hubby ko. May autoshop at softdrink business siya dun sa compound na yun. At wala pa din ako sa buhay niya that time kaya nagkaganun at wala naman kasing ibang pundar parents niya kundi iyon at kotse na binulok din ni youngest brother kaya nanghihinayang siya na mawala ng ganun na lang. In retrospect talaga since tamad talaga eversince mga kapatid niya eh sana hinayaan na lang niya or nagpa-deed of sale na lang siya sa parents niya. But I guess mabait tong asawa ko at ayaw pasamain ang loob ng magulang eh ayun nagpakabayani.
We do have the title pwede bang ibenta hehe? Kasi we don't want to live in that neighborhood anyway...

mabebenta yan..  lalo kung hindi alam :-X

yun nga lang kawawa yung mga kapatid ni hubby mo...  kung gusto niyo talaga mabawi pera niyo with a clean  heart, kausapin niyo na lang yung mga kapatid, bayaran yung 1/3 ng value nun...  or, ibenta ang property tapos equal share..

pwede din naman huwag mo na lang pakialaman.. mukhang ok naman ang buhay niyo eh.. hayaan mo na sa kanila yun.. 

best move na lang is to keep the title, (para nasa inyo ang alas)  then patayo ka ng house dun(kung may space pa..  kasi mukhang walang mangyayaring bayaran eh...  tapos iparent mo na lang

^actually kinausap niya na before brothers niya na about that.  Respeto lang sana kasi alam naman nila na good as gone na yung bahay kaya lang binayaran pa nga ng asawa ko.
He won't get naman more than his share eh kung sakaling ibenta. Ang problema lang yung mabait niyang kuya nagpatayo ng bahay sa harapan pa ng lote. Di ka na binayaran yung magandang pwesto pa ang kinuha. Ang bait di ba?
Personally, gusto ko mabenta to teach them a lesson. Kapal kasi ng mga mukha eh. Pero I doubt that it will ever happen. Bahala na si Lord sa kanila I guess :)

in the absence of a unilateral transfer to your husband ( via Deed of Sale/Deed of Donation)
the property is subject to settlement of estate.
hati-hati sila, in equal share, pro indiviso.

maybe you can have a settlement formally,
or bigay na lang ninyo sa kanila.
it appears you are more blessed than the rest,
anyway.

i guess ganun na nangyayari...annoying lang kasi they know naman the real story pero ganun pa din ginagawa nila. mabait lang sana sila sa asawa ko at ok na pero hindi eh. oh well ganun talaga ang buhay hehe

i have question re the transfer of title. Inilipat sa amin magkakapatid yung title ng bahay from my mom. So meron na kaming deed of absolute sale ng bahay tapos naka-notarized na kaso hindi pa namin nabayaran yung mga fees para maintransfer na sa amin. Effective na ba nasa amin yung magkakapatid yung title kahit hindi pa bayad yung fees?

Transferring real property via a Deed of Donation, with the objective of paying no/less taxes -- is already passe.  Donations cost just as much as sales, in terms of taxes.  So best to go via the regular Deed of Sale route.

If a property is to be transferred now by parents both alive, to an adult child... well, who can stop them?   Life is unfair, lol.  Kidding aside, inheritance does not even factor in yet... remember, buhay pa pareho ang parents.  If they want to give it all to 1 child, and exclude all the other kids... that is their prerogative/right .. while they are still both alive.  But once at least 1 parent drops dead.. ayan, the inheritance laws come into play.. whether the dead/alive parent likes the face of a child... yon yon, may mana each and every legitimate & illegitimate child, accdg to division rules set down by law. 

How to make the transfer to an adult child now, with both parents alive, suit-proof from the other siblings?  Consult a lawyer.  Sometimes, the answer lies not in the obvious legal rights, but in the potential damage that can be caused such as...   pano naman na buy ni Ate yang property na yan from Nanay & Tatay eh wala naman syang ganyang kalaking pera... or, it has happened with rich famlies:  BIR!  lol

As for the technical errors.... go to the LRA. write a letter, wait for theiri response/course of action.  Needless to say,  you will pay over the table, and under the table...  IF the problem lies with the Developer -- nagkamali ng pasok sa pagpagawa ng TCT,  write a letter, make a demand for correction.  Pag ignore ka, file a complaint with the HLURB.  Yan lang naman intindihin ng mga Developer -- the HLURB, coz their License To Sell (even for another development) is affected.

What do you mean "effective na ba nasa amin yung magkakaptid yung title"?  Darling, to all intents and purposes, wala kayong TCT.   Transferring ownership/title from 1 entity to another is a PROCESS.  Hindi basta:  o sige, may Deed of Sale, o ayos na.  No, you gotta use that Deed of Sale and other documents for the BIR that will say how much taxes you will pay for the sale/transfer of ownership.  Capital Gains.  Tapos may Transfer Taxes pa, then you eventually present all docs to the LRA and file for issuance of new TCT in the name of the new owners.

Asan ang father nyo in this transaction?  The surviving legal spouse  gets 50% PLUS the share of 1 legitimate child in the remaining 50% ha.   Hindi puedeng basta nag deed of sale ang mom nyo, ignore your father.. ayos na. 

Ask a broker friend...  meron DEADLINES as to when to pay the transfer taxes, the capital gains tax, VAT or whatever,  etc. Hindi puedeng nagpirmahan kayo, tapos nagpa notarize tapos sige antay until you have funds for the transfer tax.  May penalties yan ha...

^Hiwalay na parents ko. Yung house ( 4 door apartment) namana ng mom ko from her parents nung single pa siya so hindi siya conjugal property. Tama ba?

2-3 years ago nagpagawa mom ko ng dead of absolute sale para ilipat sa amin magkakapatid yung title. Lahat kami may pirma na and nanotarized. Hindi lang na-process dahil kulang yung funds and hinarang ko na din kasi magkakaroon ng rights yung bro in law ko sa house.

Ngayon gusto ng mom ko mapunta lang yung house sa akin while single pa ko since married na yung other siblings ko. Ayaw niya mapunta sa mga asawa ng mga kapatid ko yung bahay in case na maghiwalay daw.


Hindi kaya magkaroon ng conflict sa future yung first and second deed of sale? Pag naprocess yung second deeds then complete yung requirement like we paid the transfer taxes and may new tct na. May copy kasi yung bro in law ko ng first deed of sale. Ayaw lang namin siya maghabol sa hindi naman niya naipundar.

^hmmm as far as I know, kahit namana ng mother mo yung property while she was still single, nagiging conjugal pa rin yan. yan ang sabi ng isang friend ko, kaya nga ang unfair nga daw ang law natin, lugi ang babae.

but anyways, isang friendly advice lang sis, gat maari, gawan mo ng paraan maipa-transfer na yan sa name mo, kasi legal documents lang panghahawakan mo pagdating ng panahon.

yung problema mo sa pagkakaron ng karapatan ng mga BIL mo, kung mapapamanahan ang mga kapatid mo, wala ka ng control kasi dun, magiging conjugal din yun sa sister mo at sa asawa nya talaga. so kung ayaw talaga bigyan ng karapatan yung mga BILs mo, wag pamanahan na lang mga sisters mo, which I think magiging problema pagdating ng araw.

ang nakita ko lang na flaw sa ginawa ng mother mo, dapat hindi muna pina-notarize, ganun naman palang hindi pa maipapatransfer ang title, tulad ng nabanggit ni sis aquacharly, may penalties kang babayaran kapag hindi mo naipatransfer agad in 45days after notarization. since sinabi mong 2-3yrs na na-execute ang notarized DOAS nyo, i don't have any idea pano kino-compute ang penalty but definitely meron na talaga yan.

sa case ko naman, our house and lot, nakapangalan sa dad ko. hiwalay na sila ni mommy, not yet annulled though but on the process of annulment. may ibang family na rin dad ko and we're not in speaking terms. he was the one responsible in paying our monthly mortgage before but then hindi niya binayaran ng ilang years. when we learned about this, muntikan ng iforeclosed yung house namin, buti na lang naparecontsruct yung loan. So we're the ones paying na for the monthly mortgage.

We're worried na baka bigla niyang bawiin yung property title ng house and biglang ibenta when we're the ones paying na. How can we be assured that the property will be transferred to us? Since they are on the process of annulment na ni mommy, iyon yung priority na makuha namin.

^hi sis, i'm no legal person. pero mukhang sa analysis ko sa situation mo, annuled or not annuled, equal share naman makukuha ng mom and dad mo eh, meaning tig 50% sila eh. hindi naman makukuha ng dad mo yung property 100% kahit nakapangalan sa kanya, dahil may habol ang mom mo dun dahil conjugal yun di ba. on the other hand, hindi nyo rin naman makukuha ng 100% din yung property dahil may share din obviously si father. so kahit kayo pa ang nagbabayad ng amortization neto, may share pa rin si father mo.

ang hindi ko lang sure dito ngayon eh kung papaano ang magiging shares nyo kapag nakuha na nila yung tig 50% nila. I am sure may portion kayo sa share nila kahit annulled na sila, seek legal advice sis.

^^thanks sa reply sis younis and i'll be looking din to your suggestion. :) we're just hoping our dad could transfer the title fully to us, that's the only thing we want out of him. we won't be needing his support naman since all of us graduated without his help and are already working now.

What if in this scenario...

Last Will and Testament made by the father + Alive father = wanting to transfer the property to Marie BUT does't want other siblings to know it.

What is the best deed of donation or deed of sale?

Eventually in the future siblings will contest or maghahabol, what would be the best donation or sale?

I know this is a conflict between the siblings, but is the Last Will and testament can be a strong proof to win or own the property already even other siblings are naghahabol?

hello mga GT sisters
problem ko rin ang deed of donation na noong 2005 pa napa notarzed, but until now hnd nmin napa transfer, 3 kaming magkapatid maghahati sa lote in QC. So mlaking gastos pa pala yun dhl ipasurvey pa ulit for measurement, then isub divide sa 3? ako ang nagbabayad ng taxes since 1970's up to present. Now, since 3 kami maghahati, db dpat share kami sa lahat ng gastos pati yun ibinayad sa back taxes dapat bayaran din nila ako? And now, im pretty sure wala ilalabas na pera for their share, pwede ko ba kunin na lang sa parte nila sa lote yun? And, possible rin kaya na mauna ako pumili ng pwesto ng lote na yun? @nikki pwede ba malaman sino ang atty. mo, magkano ba singil nya? @raspberryglace04 and banker, what is your opinion here? Thanks. Kung may penalty pa yun deed of donation na yun, malaki na yun for now?
