My brother was separated to his wife 6 years ago.. He was abroad when his wife took a boyfriend. She admitted her infidelity nung mahuli sila ng pamilya niya at pamilya namin,  kasi dun na nya pinatira yung BF nya sa conjugal house nila ng bother ko. They received and enjoyed the monthly remittance of my brother (wala naman silang parehong trabaho). They even bought a motorcycle for their use. When confrontation came ( with her and my family), since wala ang brother ko, dahil nasa abroad nga, may plan naman daw siyan sabihin ang lahat, kumukuha lang sila ng timing.. I believe, they're been living together for a year. The wife left my brother and their 2 sons and sumama sya sa BF nya.  Just recently we found out na nagkaroon na siya ng anak with the guy. My brother wants an annulment, kasi may GF na sya ngayon at gusto na rin nyang pakasalan. What could be the best ground to file the annulment and how much ang dapat nyang i-prepare?  My need pa bang magfile sya ng adultery sa wife nya?

hi sis crybaby yun tagal ng process depende talaga sa lawyer mo. Sa PR nya sa court, example kung kavibes nya taga gawa ng mga schedules at mga server bibilis ang petition mo. Mayron akong nakachat  na foreigner for her GF's annullment and yes it happened no appearance  sila pero legal ang documents hindi naman back dated pero di sila na attend.

kaso yung inoffer sakin ibang date ang gagamitin. 2011 daw kaya hindi ko kinuha kasi baka magkaproblema naman yun. tsaka kasi sa mindanao daw ipprocess.

Yes sis delikado yun madaming masisilip. Ok lang sana kung backdate yun this year din di ba. at least alam mo kung sino un judge na nakaupo and everything baka mamaya un gamitin kunyaring judge sayo back with 2011 hindi na pala siya ang nakaupo  dun hehe.saka mindanao ang layo sobra papano mo machechek di ba or maverify na naifile nga. gagastos ka ulit

@crybaby yung nlawyer na sinasabi ko, kilalang lawyer dito sa pinas. Won't mention the name na lang. Pero sure naman na "legal" yung documentation.

na-check ko yung MC ng BF ko, walang pirma doon sa may Parent's Consent (they married under 25 years old) tapos doon sa may Citizenship ang naka-type "Single".

Pwede na bang maging void ang married cert nila?

I have a dilemma.  My ex husband requested for annulment.  Ok lang naman sa akin.  He will pay for annulment fees and he also chose the lawyer who I will talk to.  Ako daw magfile since he is  abroad all the time.  Ok lang sa kanya sya ang psychologically incapacitated.  For me naman, kung wala na talaga love, why would I stay married.  But if this is not what God has planned for me, wag na i-grant.   So, sa akin is, if ma-grant, maybe this is really what God want for me.  If not granted, I will accept. 

The attorney said that the petition will be filed in Paniqui, Tarlac.  My problem is, he will put my residence as Tarlac, while in fact, my ex and I both resides in QC.  Malakas siguro sya sa Tarlac kaya doon sya magfile.  I am not confident with this kasi what if the court will find out hindi totoo tumira ako ng Tarlac for more than 6 months?  Sabi ng attorney, our case will not go through the normal process, wala daw summons or anything.  Since it's my ex who will pay for this, wala akong pake-alam kung pumalpak etong kinuha nyang lawyer.  My concern is, what will my liability is considering I will sign and conforme to the Tarlac address written as my address.  If ever the annulment will be granted, public document na yan.  Perjury ba ito? baka makulong pa ako... Ako na nga ang nagbigay ng pabor sa ex ko...

yung friend ko in the process yung annulment nia sa Bicol. 160k for 6 months. sabi nia nga dun na din ako magpannull para mura at kilala nia yung judge. kahit hindi ako dun. hehe. tira lang daw ako dun ng mga 6 months.

Sis kung walang mag rereklamo which I don't think meron dahil nga ang ex mo pa nga ang me  nasupport sa gastos then walang kaso. and all is well. Unless na mag ingay ka sa mga kakilala mo at sila ang magbuko sayo sa korte.  pero kung pareho kayong gusto nyo at walang kontra walang problema. kung sa qc ka mag fifile aabutin ka ng years. May friend nga ako bigamy na yun case nya with evidence sa marriage contract inabot ng 2 years. Pm mo ko ienlighten kita

We get married at Phil Consulate abroad, during that time I was required to have parental consent.

Pineke ko lang yung Parent's Consent na yun. Grounds ba for nullity of marriage yun?

pano ba terms of payment ng mga atty? yung s BIL ko 75%  agad ang hiningi nung ex niya, ang tagal na rin nun halos one and a half year na rin.ganon ba talaga kahit 200k ang tagal pa rin ng process.

depende sa nakuha mong lawyer. pwdeng magpromise yun na sige pay me almost 75% pero di naman nya mapapabilis kumbaga inuna nyang kumita. Usually dapat kahit 25 percent muna for acceptance fee ( take note: make sure na ang acceptance fee is included sa package)

may mga wise na lawyer na sasabihin kasama na yun pero once they got your payment saka sasabihin di pa pala kasama yun. Plus make sure na yun lawyers fee appearance kasama sa package or iclear nyo kung iba pa ang payment na yun. Mas better na kasama sa package kasi kung me schedules of hearing kayo at na reset due to uncontrollable reason you will still need to pay your lawyer.

all these things i got from mga kachat ko na on going sa annullment. before kasi yun gov.ph me forum dun and dun ako nag start makipagpalitan ng experience kasi at that time habang on going ako sa petition ko. nag uupdate kami dun.


It's is better na acceptance fee first. ( para sa mga payments like filing fee, raffle fee etc) then next payment? kapag me No collussion interview ( meaning walang sabwatan kayo ng respondent) or another option everytime may hearing dun kayo mag next payment after your acceptance fee. para alam nyo na gumagalaw ang petition nyo and your last payment should be kapag palabas na ang decision.:-)

sino ang petitioner? si ex or ang BIL. kung sino ang respondent makakatangap siya ng summons, copy ng petition, no collussion hearing, pre trial. trial. everytime may hearing papadalaha ng copy ang kabilang partido. may copy din ang petitioner nasa lawyer nya yun.

yung  ex ang petitioner. sabi ang natangap lang daw niya yung parang request letter para daw sa psychological test nung march 2011. yun lang wala ng iba. december 2010 niya binigay yung pera. (tanda ko pa kasi galing sa amin yung kalahati nun     )

may iba pang certificate or form na need i-fill up para sa parent's consent kasi yung nandoon sa MC, naka-type lang parent's consent pero walang signatures.. tapos ang nakalagay doon sa Citizenship ng Parents, "Single".

valid ba o void yung marriage na yun.. para sana di na gumastos ng malaki..

I have a lawyer friend who got her Nullity of marriage cases dismissed in Paniqui Tarlac. she filed it beofre it was under investigation. When it was transferred to another judge, all her 4 cases were dismissed.
