Here's the process based on my experience.

1. SEND I-130 form to Service Center - Service Center will depend where your petitioner is, as for mine, we submitted it to California Service Center

2. NOTICE OF ACTION 1 (NOA1) - This will be coming from the Department of Homeland Securities. NOA1 is an acknowledgement receipt that they received your I-130 form, usually you'll get it a week after you submitted the I-130.

3. NOTICE OF ACTION 2 (NOA2) - Notice if the petition filed is approved or not. Length of time you'll receive this may vary from 2 - 8 months, depends on the Service Center

4. CASE NUMBER - If you're here in the Philippines, this will start with MNL200xxxxxxx. NVC assigns this.

5. CHOICE OF AGENT - The applicant, the one being petitioned, will be the one who'll sign the DS-3032. You need to assign an agent who will receive all future correspondences from NVC, it could be anyone (applicant, your petitioner, or a lawyer). As for my case, I was the Choice of Agent, so my hubby and i could save money and time. Since all the forms (except Form I-864 a.k.a. Affidavit of Support), will be filled-up and signed by me. I received this 2 weeks after i was assigned the case number. Payong kapatid, if you feel secure that all your papers are legal & in order, don't hire an attorney na. Kayang-kaya nyo ng i-fill up ang forms, since all the information will only be about you.

6. AFFIDAVIT OF SUPPORT - Your petitioner will be the one who'll receive this. He/She will need to pay $70.

7. FEE BILL FORM - The petitioner could pay this in cashier’s check or money order in U.S. dollars, drawn on a U.S. bank. $380.00

8. DS-230 PACKET - The choice of agent will receive this (if you're not the choice of agent), but it's the applicant who will sign. Make sure that you follow instruction when filling this up: write your case number at the top-right portion of each page. When you mail this, be sure that you have attached a photocopy of your passport, NBI clearance, etc. with your case number again at the top-right portion.

9. APPOINTMENT PACKET - a.k.a Packet IV. While waiting for this, you could also check the status of your case online:   Interview Appointment Status

NOTE:
*If you're under California Service Center, and still waiting for NOA 2, check the processing dates in    THIS LINK

* If you're a nomad, just like me, try to trace your place of residence since you were 16 years old. Not the exact address, just the city, town, country. As well as you're employment information for the last 10 years. You will need this in filling-up the DS-230.

* While waiting for your Appointment Packet, request already for a copy of your: Birth Certificate, Marriage Certificate, NBI Clearance. But take note that these will only be valid for 1 year.

* When you have your Appointment letter, you could already take the medical exam at St. Lukes Extension Clinic.

hi sis.. :) question lang po... Once nabigyan na ba ng case # starting in MNL, mga gano po katagal yung waiting time para sa next step which is CHOICE OF AGENT?

You're welcome mga sis! ;D

Happy Valentines Day sa inyo sis.

@magic dragon, sana nga may mag hire sakin. LOL Para may trabaho na ako nakawait when my parents arrive here. He he ;D

@bachoy, depende kasi yan sa category, I know pag petitioning a spouse of an LPR (and same din pag F2A) pag meyron na silang MNL# as early as 3 days or after a week or 2 may matatagap na silang email for DS3032.

Here's a link @ visajourney, watch some of the signatures that has an I-130 for spouse.

Here's link for F2A's.

For F2B, you can look at this timeline here.* Though she didn't put when her parents sent the I-130. And when the NVC received her papers from USCIS after approval (NOA 2). But you can guesstimate.

Also I think she opt out when her mother turn US Citizen, she filed at USE Manila to opt out and reject the change of category from F2B to F1. Since F1 has a longer waiting period. And you can opt out too (write a letter) if you're below 21 when the I-130 was filed (F2A tapos na age out ka kaya F2B), you are covered by the CSPA.

*Note: And if we say her PD is 2002, her petition is originally F2A so when it turn F2B she filed a letter to be covered by CSPA act. Kaya kahit na change to F2B cya, her papers was process as an F2A though not as fast as the usual F2A kasi na over na cya ng 21 though covered pa din cya sa CSPA.

Sana nalinawan ka sis sa explaination ko. :)

Hi sis lyn, sori a kulet ko.

1) her mama filed I-130 petition 2003 f2b category.
2) h2b already received the notice of action sometime 2006.
3) from 2006 - 2009 he is receiving letters to maintain single status from nvc/ uscis not sure kung kanino sa dalawang department.
4) last june 2010 yung mama ni h2b received a personal letter from a friend from usa na bumilis daw yung PD. Although hindi sila naniwala agad.
5) last october 2010, h2b received letters from nvc that his case has available visa and then instructed him to start processing by establishing communication with nvc -- done with this.
6) november 2010, he received again a second instruction to send the ds 230 or the choice of agent form. He chooses the petitioner (mama) since dun siya sa states based and the nvc replied that it is okay na.  I mean nakuha na nila yung notice ng choice of agent.
7) december 2010, they were asked to pay the affidavit of support or aos, fill out the form then send to nvc $88.-- done
8.) he then received the letter to pay the $404 for the visa processing fee and submit the biographic form, visa application form, birth certificate, cenomar, nbi clearance, photocopy passport, petitioners document like noa, all together with the cover sheet and already sent to nvc cmr.

After all this according to the next procedure, we will wait for the packet around 6-8 weeks then wait for the manila us immigration for the scheduled date of interview.

Now my question is, affected ba ito ng retrogression na sinasabi? In what way? According to his family, not affected siya since moving ang processing niya and nearly done. Please give me your views.  Thank you sis a.
Tnx sis a muah, please be patient. :-[

sis ato pasagot ha.. sadly affected ang case niyo ng retrogression. current date for F2B sa visa bulletin is 01AUG99. Your husband's PD is 2003. Visa number would only be given to those whose PD is current.

In my case, natapos na namin lahat. Choice of Agent, DS230, paid IV bill, sent necessary docs. our case was completed last october pa and yet no interview sched until now.

Same thing with my bro-in-law (F3). his case was completed last dec but wala pang interview sched. His PD is JUL1992 and current VB is DEC1991

@sis ato

Now, 3 years old na daughter namin, and I have no regret at all sa naging decision ko na yun kahit ano pa ang nasabi ng iba. ;)

His sis, tnx sa views mo.  So ngayon kasal na kayo? Thank you just the same sa pag share mo sis.   :)

So waiting nalang kayo for NVC to have his case complete. So next step will be the interview.

When the I-130 ba sis was filed under 21 pa yung h2b mo? Tapos na over age cya? But before na overage cya did he submit to opt out? Kasi if so, pwede pang pinacress yung papers nya. If not, affected nga kayo sa retrogression sis. :(

I have a q's for you sa #5. You said NVC gave him a letter that his case has available visa na? Yun ang wording sa letter?

Yung sa #3, kaya sila naga-ask to be sure na yung category nya is still F2B. At hindi cya nagasawa, also to see interested paba at may communication bah. They need communication kasi lalo na after 1 year just to see may tao paba dyan...

@bachoy, yup sis ang pinaprocess ng F1 is 15DEC94 pa. :-\

For them to tell you a go ahead para maka schedule kayo for the interview nyo. Since may online interview scheduling na sila for other visas not just for tourist.

When the I-130 ba sis was filed under 21 pa yung h2b mo? iba yung petition an yun. family petition yung nangyari sakin na over 21 na, yun yung petition nila llola to daddy and family.

We're trying to convince them to come here this March and not April. He he :D

@sis ato, (Your H2B answer this noh, hi h2b welcome to GT) okay I see now. When the I-130 was petition over na cya sa 21 so yes, affected cya sa retrogression sis. :(

If sabi Eligible for Processing, that's it. Eligible for processing...it is processing naman ngayon since nandoon na sa NVC wait nalang kayo sa case complete. Tapos malalaman nyo if may available slot sila na visa for you. USE Manila will contact/gave you a letter na may available visa # na and you can go ahead and schedule your interview. :)

Medical is just walk in, first come first serve. Even if you have just the NOA 2 you can take it with you to have your medical but may expiration yung medical kaya mas best to wait when your PD is current. :)

Good luck to both of you on your visa journey. ;) We'll pray together that the VB will move fast, Very Fast... He he :D My sisters will be in this same boat soon...

@she69, When he filed for your papers USC na cya sis? or LPR palang. If LPR palang he needs to update the petition and call USCIS that he is a USC na and submit supporting docs. If USC na cya when he filed, let him call USCIS what's happening na sa kanyang case, why he still didn't receive anything. Usually you'll get an NOA2 na since 6 months na wait nyo. Or maybe it's already in the Mail sis, pa check sa mailbox yung hubby mo. Hehe :D

Anong category nyo? K3, CR1 or IR1?

Tnx sis lyn.
